APPROVAL OF MINUTES from the meeting of July 2 and July 16, 1990,
as corrected.
PROCEDURE TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS
1. The proponents in applications which are not contested will have five
minutes to present their evidence. Additional time will be granted upon
request if, in the opinion of the Con¢nission, such additional time will
produce evidence important to the Commission's consideration.
2. In contested applications, the proponents and opponent will each be given
ten minutes to present his case unless additional time is requested and the
complexity of the matter warrants. The Commission's considerations are not
determined by the length of time a participant speaks, but rather by what
he says.
3. Staff Reports are part of the evidence deemed received by the Commission in
each hearing. Copies are available to the public prior to the meet:.ng.
4. The Commission will withhold questions until the public hearing is closed.
5. The Commission reserves the right to deviate from the foregoing if, in its
opinion, the ends of fairness to all concerned will be served.
6. All documents are presented to the Planning Commission for review in
connectien with any hearing, including photographs or other acceptable
visual repreaentati~ns of non-documentary evidence, shall be retained by
the Commission for the public record and shall be available for public
inspections
7. At the end of the scheduled hearings, members of the public will be allowed
to speak on items of interest which are within the jurisdiction of the
Planninr. Commission, an:? ~r agenda items. Each speaker will be allotted a
maximum of five (5) minutes to speak.

OPPOSITION CONCERNS: Felt previously imposed condition should be upheld
to retain hill.

COMMENTS OF PEOPLE IN FAVOR: Hill as exists is an eyesore and iaoks like
a manufactured hill, need additional.park area for soccer field; existing
hill is maintenance and liability concern for adjacent homeowner's
association.
STAFF COMMENTS: Parks Department nee•~is flat usable park aria;
misunderstanding about site originally.
COMMISSION COMMENTS: Previous action of Planning Commission should be
upheld; park area is important, but not at expense of previous property
owners who were promised the hill would remain for view concerns.
ACTION: Resolution offered to approve modified hill (Concept Exhibit C)
failed to carry.

OPPOSITION: 2 people present
OPPOSITION CONCERNS: Change in use from office and felt property was
purchased with intent of changing the use; lose of privacy and decrease in
property value. Also concerned 'that if this use is not successful, it
could be converi:2d to a motel since that is the business the owner is now
in. Owner of adjacent office building did not agree use should be changed
from office because the unite in his building are always rented and he felt;
if this property was properly maintained, it could be a success.
PETITIONER'S COMMENTS: Explained original intent when property was
purchased was to develop a motel, but that was denied. Clarified use is
retirement living facility with basic services such as housekeeping,
hygiene, providing tra:,aportation to medical and dental a
supervision of resident's schedule and activities and monitoringefood
intake and special dietary programs; (not a rest home for the elderly);
that they are licensed by the state and the license will be for no more
than 49 residents. No doctor required on site; state regulates that at
least 75~ of residents must be 62 yearn of age or older. Someone younger
could be a resident, depending on their condition and needs for care. Same
as previous application, except number of rooms reduced from 30 to 25;
there ie a beauty shop included and the size of the rooms has been
increased and the recreation room size has been doubled and there is new a
courtyard for outdoor seating.
COMMISSION COMMENTS: Concerned about existing mature trees on the north
property line; (Applicant agreed to retain existing mature trees). Concern
if this property will be affected by freeway widening. (Applicant
responded they have a letter from Caltrans indicating this property will
not be affected.) Concerned this could become single room occupancy
project or shelter for homeless people, which would not be appropriate for
this area.

OPPOSITION CONCERNS: Already have a liquor store where people can
purchase snacks, and do not need a snack shop ai this location. There is
a drug rehabilitation facility in this center and they have a lot of
undesirable people already in the neighborhood: and vagrants sleeping
behind the trash bins; that they were promised years ago that the service
station would be closed at 9 p.m. and it never has been and now they are
proposing to be open 24 hours a day. Concerned about traffic which is bad
now with people trying to avoid intersection at Riverdale by going through
their tract; did not think shopping center could handle additional
traffic; and this could create a place for juveniles to hang out.
PETITIONER'S COMMENTS: Noted studies have shown that snack shops do not
bring in more traffic.
COMMISSION COMMENTS: Noted beer and wine would not be sold.
STAFF COMMENTS: Traffic Engineer - Plan does not show 8 spaces, b:tt i:here
