COMMISSIONERS PRESENT: All
PROCEDURE TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS
1. The proponents in applications which are not contested will have
five minutes to present their evidence. Additional time will be
granted upon request if, in the opinion of the Commission, such
additional time will produce evidence important to the Commission's
consideration.
2. In contested applications, the proponents and opponent will each be
given ten minutes to present his case unless additional time is
requested and the complexity of the matter warrants. The
Commission's considerations are not determined by the length of time
a participant speaks, but rather by what he says.
3. Staff Reports are part of the evidence deemed received by the
Commission in each hearing. Copies are available to the public
prior to the meeting.
4. The Commission wi13, withhold questions until the public hearing is
closed.
5. The Commission reserves the right to deviate from the foregoing if,
in its opinion, the ends of fairness to all concerned will be
served.
6. All documents are presented to the Planning Commission for review in
connection with any hearing, including photographs or other
acceptable visual representations of non-documentary evidence, shall
be retained by the Commission f'or the public record and shall be
available for public inspectio:is.

OPPOSITION CONCERNS: Invasion of privacy; 5-foot high wall inadequate;
easy access over wall, traffic congestion; loitering, crime; high density
in area now; increased impact. on services such as electrical, water,
sewers; limited access for emergency vehicles, parking, high density
apartment complexes throughout the area {7 in immediate area); currently
is a nice quiet reaidental area, lot of children in the area, concerned
for safety of children walking to school. indicated the bike path is
currently fenced and 36 a~l~itional apartments would add more people and
chances for access wold be increased. Felt a commerical use would be more
acceptable due to igh concentration of apartments in the area.
PETITIONEF.'S COMMENTS: No access to Magnolia, more than adequate parking
(2-1/2 epacas per unit). Only 4 or 5 of the condo units next door have
one window facing subject property. Building located 30 to 35 feet away;
10-ft. unused bike path currently is a nuisance with a lot of debris and
bike path is an easement owned by the City of Anaheim, and could be
landscaped, Felt development of property would lessen loitering.
COMMISSION COMMENTS: Hellyer - Felt developer should have discussed
project with neighbors znd resolved their concerns; questioned whether
apartments are the appropriate use of this property and suggested maybe
commercial use would be more acceptable. (Applicant disagreed anc? added
this is a flag lot, and there is sufficient commerical use on Lincoln
already). Residential use increases population density and increases

Feldhaus - :r'elt RM3000 requirements should be met, consistent with
adjacent condos. Nest Anaheim population density is too high already.
STAFF CONASENTS: Traffic - Bike path will be developed within a couple of
years when channel is rebuilt; (bike path goes to Gilbert, along part of
the school property, along the golf course to Brookhurst Community
Center); ultimate development of bike path may include a pedestrian
crossing. Commerical use would increase traffic during the day and
apartments would increase traffic in the mornings and evenings.
Henninger - Did i,ot feel required findings coudl be made; disagreed with
opposition that people who live in apartments would be bad for area and
that they are na different than people who live in condos; agreed that
privacy is a concerr_ and massing of buildings is just too dense. Felt
project should be redesigned after developer meets ~~ith neighors.

properties. Increased traffic; adjacent commercial properties have
problems with drug dealing, prostitution and crime; windows would be
looking right into the neighors; high crime area with prostitutes, etc.,
dance bar located there; previous proposal for paint shop offered trees
along the north wall for a landscaped buffer and would have a scurity gate
with only employees allowed to park in the rear; an 18-unit apartment
project was denied because it was too much on too little; 3-story project
would look right into their properties and setback should be 60 feet; 300
sq. ft. motel room too small; parking is a problem and no parking allowed
on Lincoln; accidents due to lack of visibility; guests at motel arrive
late, leave early and party late at night, many school children in the
area. High density promotes undesirable activities; property value
decreased because of development of Teri Circle. Overdevelopment in Weat
Anaheim.
PETITIONER'S COMMENTS: Not aware of sign requirements and could comply
and two waivers not required; similar to motel across the street; tried to
screen noise and the swimming pool noise from residents with the motel
building; moat of the windows face the street; and only 4 units have
windows and they could install obscure windows; noise from air
conditioning units only concern. Explained could redesign project and
eliminate waivers; traffic is throughout the day and does not come at one

time. Explained access back area would be through slic~g glass door
in a unit, but they could eliminate one unit to provide access to the
rear; trash truck turnaround area at the front close to Lincoln; trash
area located 10 feet from apartments. Felt parking would be better when
the property is developed because it ie not being managed now.
COMMISSION COMMENTS: Questioned pool & spa location (Opposition
explained City Council required pool & spa to be relocated to center of
apartment cortiplex).
Hellyer - questioned need for motel in that area; could not make finding
for hardship; would contribute to existing problem of transients, etc.
Henninger - questioned who is the market for a motel in that area.
(Applicant responded, not legal to rent by the house)
Boydtun - did not feel this is the right place for a motel.
