designation. Current GP designation is Low Density for
single-family residences. Not typical practice to qo back to
RSA-43,000 Zone; due to irregular request, probably would need a
general plan amendment to consider the density.
RS-7200 would allow about 4.3 unite; RS-5000 would allow about 6.5.
ENGINEERING - Sewer easement area can be used for driveway, just
cannot have structures on it. Private street could be 20 feet wide
for four or lees unite, not more than 300 feet long; fire department

attorney with the School District nixed the idea and felt there was too
much potential liability; made suggestion to additionally insure, through
hie liability policy, one-million dollars, but the school was unable to qo
along with it; submitted euggeetlon to try and move the trash location
further in eo there would be no possibility that the truck would impact
the traffic on Gilbert; spoke to resident to the north and he agreed that
he will not use hie trash cane anymore and would put hie trash in the
dumpster; this will eliminate 2 stops on Gilbert on Monday mornings; also
willing to work with anyone else on the street that wants to use the
dumpster in an attempt to eliminate the no. of pick ups on the street.
He referenced Condition no. 18 regarding the 6' block wall. Mr. Hill, to
the north, prefers to keep existing block wall which ie 4-1/2' to 5' high;
request to delete condition no. 5 regarding the turn area on-site, and to
some degree no. 12 regarding the trash enclosure.
Would not have a problem with putting dumpster to rear of property in the
future even if it meant tearing down the old one and relocating it to the
rear.

area rather than to have any trash trucks stopping on Gilbertt discussion
took place as to other possible alternatives if the properties either to
the south or north were developed some time in the future= would applicant
be willing to accept condition where he would offer to pay that person's
trash fees if they would use his dumpster as an incentive and that should
eliminate one of the stops on the street] would like to nee a block wall
go in= applicant is offering 3 affordable units and 2 Section 8 units]
discussion took place regarding future alternatives if either the south or
north properties were acquired.
Commissioner Hellyer indicated he has a problem with the density, eo he
will not support the motion.

staff report and indicated tha± some changes were made to the driveways
and would like the opportunity to review that with the Traffic Engineering
Department; he referenced condition no. 10 an9 stated they want the items
complied with within 90 days from the date of the resolution and he would
like 180 days.

forklifts ie also allowed, but does not see this as an extraor~inary
situation given the zoning of the property; do have a diesel flatbed and a
crane, both of which they try to keep moved forward in the lot eo they are
~t underneath the people's windows at nights they have tried to eliminate
the problems ae much ae possible; they asked to have a meeting with the
residents that were complaining, however, they never received a reply to
their request; the people who were complaining turned a deaf ear to their
efforts to see if they could come to a reasonable conclusion.

To the east, their property abate a trucking company and they have
"hundreds" of diesels in ~snd out of the property all day; dose not know
~ how they differentiate the smell of their diesels with the smell of the
~ diesels from the trucking companyi tar is not stored in barrels; they
receive it in kegs and they are in a solid state; tar kettles and asphalt
kettles are not started up prior to them leaving the yards do not drive
with them hot or with the burners going; he does not know where they got
the information or why they perceive that these things are started up in
the morning and left to heat underneath their windows and indicated this
is simply not true.
The applicant indicated that they do not have any particular hours of
operation because seasonally th~sy change the hours to correspond with
daylight savings time and/or the temperature that the men have to work
with; in the winter time they cannot worlc i there ie dew or moisture on
the roof eo t'cey may start later in the day; in the summertime the crews
can start at first light thus ending as early in the day as possible;
under contract occasionally they have to work jobs at night; c~ay have to
leave for job site at B:OOp.m. or l0:GOp.m. or midnight depending on what
the contract calls for.
COMMISSION COMMENTSs Would have to build a trash storage area and have
the plane approved; testimony given by applicant indicates that the tar is
not hot and people were imagining the fumes; they have been storing
kettles along the north wall against the residential area] discussion took
place ae to the hours of operations this is in the wrong area of town;
they have not been a good neighbor; property values are affected and the
,.,, neighbors are inconveniencsd; they have repeatedly asked for relief and

STAFF COILMENTS: Melanie Adams, Public Works-Engineering, explained that
their Field Inspector wenL• out and one of the driveways has been
reconstructed to 15-foot radius returns, but the other has not and needs
reconstruction.
Pamela Kessler, Code Enforcement Officer, has been out to the Bite on
several occasions. She stated the first time she went out there was
12/12/90 and work was being conducted outside of the building; they were
loading and unloading trucks; there was outside storage consisting of
roofing supplless they had a service area for their trucks which consisted
of open barrels of diesel fuel, open barrels of discarded oil,
miscellaneous truck and auto parts. She stated at the time they saw 5
cold co:umercial tar kettles, but when they called AQMD they did say they
had a permit for up to 25 portable tar kettles; about 80t of the inside of
the building is being subleased and ie utilized for the storage of ceramic
tile, so they basically ass utilizing the outside of their building except
for offices.

twice there were liot to the touch commercial tar pats were in the late

STAFF COMMENTS: Melanie Adams, Public Works-Engineering, explained when
the street is widened and the widening encroaches into the building, then
the City would take on the cost of modifying the building. She was not
