1. The proponents in applicatiens which are not contested will have five
minutes to present their evidence. Additional time will be granted upon
request if, in the opinion of the Commission, such additional time will
produce evidence important to the Commission's consideration.
2. In contested applications, the proponents and opponent will each be given
ten minutes to present his case unless additional time is requested and the
complexity of the matter warrants. The Commission's considerations are not
determined by the length of time a participant speaks, but rather by what
he says.
3. Staff Reports are part of the evidence deemed received by the Commission in
each hearing. Copies are available to the public prior to the meeting.
4. The Commission will withhold questions until the public hearing is closed.
5. The Commission reserves the right to deviate froc; the foregoing if, in its
opinion, the ends of fairness to all concerned will be served.
6. All documents are presented to the Planning Commission for review in
connection with any hearing, including photographs or other acceptable
visual representations of non-documentary evidence, shall be retained by
the Commission for the public record and shall be available for public
inspections
7. At the end of the scheduled hearings, members of the public will be allowed
to speak on items of interest which are within the jurisdiction of the
Planning Commission, and or agenda items. Each speaker will be allotted a
maximum of five (5) minutes to speak.

COMMISSION COMMENTS: Commissioner Mease stated the applicant could
obtain a copy of the taps regarding the opposition and listen to
their concerns if he so desires, also the applicant can appeal the
Planning Commission's decision to the City Council; petitioner has
resisted giving them geotechnical information.
STAFF COMMENTS: Leonard McGhee, Senior Planner, tried to contact the
applicant, however, he was unable to locate him. Applicant was aware
there was a meeting today as they spoke with him last Thursday.
Selma Mann, Deputy City Attorney, stated the recommendation is that
the Planning Commission's subsequent actions may be subjec! to a
challenge on the basis of due process problems by the applicant, such
as, if the applicant hoe new information to offer the Commission or
if the Commission's action is based upon information given by persons
in the audience today and the applicant does not have an opportunity
to respond.

She stated they have had insufficient information provided by the
applicant despite numerous opportunities to provide some soil studies i `~~',.

~ assurance that this "granny" unit is being used by his mother-in-law

PETITIONER'S COMMENTS: The last CUP expired withou•: paying the fees
and he had to resubmit; he explained he did not have the funds at the
time; has 3 children and dose not have anymore traffic then anyone
else in the neighborhood; a bus picks up hie mother-in-law and takes
her to the Srail Institute twice a week; hie children has friends and
he wants them at hie house so he knows where hie children are.
COMMISSION COMMENTS: If this ie approved, the conditions statb that
the person occupying the "granny" unit must pay no rent and moat be
62 years or older; the only issue before the Planning Commission
today is the "yranny" unit; if there are additional problems
regarding traffic, noise or working on care, then concerned
individuals should contact Code Enforcement and they will investigate
those concerns.

STAFF COMMENTS: Bruce Freeman, Code Enforcement. Code Enforcement
records indicate that they have been with Mr. Messina for the past 3
years trying to get the "grancy" unit matter resolved; this has been
an ongoing problem; there have been conaidc+rable complaints with the
neighbors in the area with a constant flow of people to the ~ {?~
residence; at the last PC meeting they did indicate other family
members visit on the average of twice a month with up to 9 ar 10
people; they have had no other complaints since the last meeting
other than failure to comply with the CUP requirements.

PETITIONER'S COMMENTS: Approached exhibit board and explained the
exhibits; the old building had to be removed because there were
~~ underground storage tanks too near its foundation; when they moved
the tanks, the building started to cave and they had to remove the
building for safety reasons; the new building is designed in a new
configuration; new station to be a full service station rather then a
self serve station; would like to work with City to relocate the
transformer to another location; if he dedicates 2-1/2 feet and the
church dedicatee 2-1/2 feet, would like utilities undergrounded.
Mr. Templeton explained it would be up to the property owner whose
service it is to provide them with a transition from the underground
to the overhead fed service, but if the applicant could provide them
with conduit then they could put in their conductors and service it
from the underground source.
Petitioner - For the good of the neighborhood, he agrees with this
easement on the condition that he dedicate 2-i/2 feet and Utilities ~a~
tries to get 2-1/2 feet from the church, however, if they cannot
obtain the 2-1/2 feet from the church, he will dedicate the whole 5
feet.

COMMSSSION COMMENTS: Ie Utilities looking for an easement just to
maintain the lines? Is there an easement on the church property and
Mr. Templeton indicated there was not. Can wires go ~:ver the
building and Mr. Templeton explained they cannot go over the building
on the other property--they can pass over the building of the
property which it serves. Commission - If underground utilities, can
building qo above the wires and Mr. Templeton indicated it could
not. Commission - Applicant has already lost frontage on Anaheim
Blvd. Commission - Applicant could dedicate 2-1/2 feet and so could
the church.
Parking issues were discussed and it was agreed that parking will be
across the street; applicant owns the property across the street and
will provide a reciprocal parking agreement.
STAFF COMMENTS: Bob Templeton, Electrical Engineering, stated there
is an electric power pole on Cypress right at the property line and
there is a secondary service going up to serve the building to the
north of the gaa station; Utilities typically takes a 5-foot easement
to cover the secondary overhead lines; there was never an easement
granted in that area; if an easement crosses someone elsee property,
then an easement is always taken for that ae a portion of the service
that crosses the other property; can look to church to see if they
could dedicate some proparty also; are in the process of
undergrounding all of Cypress Street which ie a continuation of the
Olive Street project.

the Code allows the driveway to be part of that 20 feet; they are
proposing 1 parking spot within that 20-foot landscaped area in order
to solve the trash pick up problem.
