1. The proponents in applications which are not contested will have five
minutes to present their evidence. Additional time will be granted upon
request if, in the opinion of the Cammiaeion, such additional time will
produce evidence important to the Commission's consideration.
2. In contested applications, the proponents and opponent will each be given
ten minutes to present hie case unless additional time is requested and the
complexity of the matter warrants. The Commission's considerations are not
determined by the length of time a participant speaks, but rather by what
is said.
3. Staff Reports are part of the evidence deemed received by the Commission in
each hearing. Copies are a;=ilable to the public prior to the meeting.

OPPOSITION: 1 person present
OPPOSITION CONCERNS: Adjacent property owner requesting reciprocal
access to both properties or simple access across the theater
property, and it is not just the acceea easement which is an issue,
but the internal circulation between the two properties, and the
driveway location; that there was a condition on their development
that they close their existing driveway and have access over the
theater property; the document they received on July 19th shows the
proposed easement which restricts their acceea and gives the
applicant the ability to relocate their driveway anytime he wishes;
that they have declined to continue negotiating with the applicant.
Adjacent property owner presented several exhibits showing results of
relocated buildings, etc. and acceea. Explained they have 67 surplus
parking spaces, but project was approved with a parking waiver; that
their development plane were approved by the Commission and went to
City Council on consent calendar, and there was no opposition, but
the City Council told them to work with neighbor. He presented copy
of letter accompanying site plan to Mr. Sanborn in June 1990.
Explained the had a meeting with Mr. Sanborn, his father, and the
bank and Mr. Sanborn's father disagreed with what was agreed upon;
and that Sanborne wanted to approve their leases and restrict the
uses on their property so they withdrawn from negotiations.

COMMISSION COMMENTS: Henninger felt both conditional use permits
ahc•sld be set for new public hearings with plane revised to comply
wi~ch the accesses as recommended by the Traffic Engineer since both
~' rroperty owners could not agree on access.
STAFF COMMENTS: Traffic Engineering - agreed with access agreement
with adjacent property owner signed and with the other development
going ahead and with 118 additional parking provided, should not have
parking problem on whole site. Will restripe compact spaces and
replace those with regular spaces, and provide additional 116.
Explained median required in Resolution PC 89-159 was to reduce
traffic conflicts and was proposed from the existing median all the
way to Imperial, right in and right out only. If there ie no
agreement, recommended one driveway for each parcel, as far as
possible from each other, moat easterly driveway on theater property
being closed and installation from existing median island all the way
to Imperial, and fully improved La Palma with costa to be borne by
both property owners. '

City Attorney - Meet with both property owners and proposed
modifications to Conditions 21 and 23 and stated both parties have
agreed to execute an agreement for internal circulation and record it
and that the condition in the original CUP is still in effect and the
bonds have been posted by the theater applicant to cause the
extension of the center median in LaPalma and the Traffic Engineer is
in a position to cause that center divider to be extended.

westerly city boundary, Do not have any definitive readings for this
portion of Beach, but there is a general problem in Weet Anaheim and
it appears it would be prudent to have a sewer study.
Agreed that a condition would be acceptable -that prior to issuance
City Attorney -pointed out the applicant has agreed to do whatever
is necessary after the City's study is completed and if he chooses to
go ahead with the project without the newer study, it would be
necessary to have another. public hearing to amend that condition. ~~
COMMISSION COMMENTS: Hellyer suggested a conditian that the
applicant would agroe to do whatever mitigation is necessary
satisfactory to the City Engineer.
Questioned the number of kitchens proposed and applicant stipulated
