1. The proponents in applications which are noL contested will have five ~~
minutes to present their evidence. Additional time will be granted upon
request if, in the opinion of the C.ommiasion, such additional time will
produce evidence important to the Commission's consideration.
2. in contested applications, the proponents and opponent will each be given
ten minutes to present their case unless additional time is requested and
the complexity of the matter warrants. The Commission's consideratior.e ar=
not determined by the length of time a participant speaks, but rather by

3. Staff Reports are part of the evidence deemed received by the Commission in {
each hearing. Copies are available to the public prior to the meeting. ~
4. The Commission will withhold questions until the public hearing is closed.
5. The Commission reserves the right to deviate from the foregoing if, in its
opinion, the ends of fairness to all concerned will be served.
6. A?1 documents presente9 to the Planning Commission for review in connection
with any hearing, incla.ling photographs or other acceptable visual
representations of non-documentary evidence, shall be retained by the
Commission for the public record and shall be available for public
inspections.
7. At the end of the scheduled hearings, members of the public will be allowed
to speale on items of interest which are within the jurisdiction of the
Planning Commission, and/or agenda items. Each speaker will be allotted a

OPPOSITION• 1
OPPOSITION CONCERNS: Referenced a letter he sent regarding shed
structures.
PETITIONER'S COMMENTS: Car dealers and motorcyle dealers all have
these units out front for display; in order for them to be
competitive with other dea'_ers they need to put motorcycles out in
front; they are in a lirht manufacturing area, not retail and people
driving by will not sea them; the retail portion of the building is
very limited (approximately 1/3 of the building); they also do
repairs but will not be doing any outdoor repairs.
COMMISSION COMMENTS: Applicant was asked to justify the waiver for
putting motorcyles on display.
Masse - He referenced the letter the opposition spoke about regarding
the existing shed structures; asked applicant if he had a problem
with bringing shed up to City Code and applying for a building
permit; the applicant ayreed to bring the sheds up to City Code.
Concern expressed regarding motorcyles taking up one parking space
plus metorcyles parked on the sidewalks.

Henninger - Thought that the storage directly behind the sidewalk
with the 10 motorcylc~ was appropriate; most motor vehicle sales
establishments do have some outdoor display and that these motorcyle
establishments are unique in that they can store the vehicles inside
at night; would look favorably on the 10 motorcylea being displayed
in a backup area directly behind the landscape adjacent to the
right-of-way, but not the 5 motorcycle s~orage area that is further
back.
STAFF'S CDMMENT~: Jonathan Borrego, Planning, stated the 2 parking
spaces that they were using for display were counted towards their
parking.
Alfred Yalda - Traffic Engineering, indicated he was not concerned
about the loss of any parking spaces because this type of use
normally generates only motorcyles rather than automobiles.
ACTION: CEQA Negative Declaration - Approved
Waiver of Code Reauirement - Approved - (5-1)
1. From 70 parking spaces to 43 spaces
^_. Applicant to stipulate to a maximum of 10 vehicles and/or jet
skis being displayed outside.
Note: Commissioner Mease voting NO and Conmissioner Houas
abstained. Commissioner Mease indicated he did not see this use
as being consistent with the area and that they were premature
in granting this variance.
Conditional Uae Permit No. 3476 - Granted
Jonathan Borrego made the following changes to the conditions of
approval:
Condition no. 2 is not applicable because property is zoned
industrially and are exempt from the street tree fees.
Condition no. 14 - Expand wording to say: "That prior to the
commencement of activity authorized by this resolution or within
ninety (90) days," etc.
Commissioner Henninger offered a motion, seconded by
Commissioner Messe and MOTION CARRIED for staff to bring to the
next work session, a study of motorcycle uses to see if it is
appropriate to provide, by conditional use permit, motorcycle
sales with outdoor display.

Henninger/Hellyer - Add the following conditions:
1. That existing sheds on the property will be checked for
building permits and if they do not have building permits
they will be brought into Code conformity or removed at
the discretion of the applicant. To be determined within
the ninety (90) day period if they are to Code and then an
additional six (6) months thereafter to bring it into
Code.
2. All wast•: fluids shall be handled in strict conformance
with health department standards.
3. Existing signage to be repaired.
VOTE: CUP F-0 (Commissioner Bouas abstained as she had not had a
chance to listen to the tapes of the previous hearing on this
item).

expressed in past public hearings regarding density and the widening
of roads and will not be reiterated here.
COMMISSION COMMENTS: Henninger - Have done a good job in revising
plane and trying to accommodate the Commission's requests and
satisfying neighbor's concerns; Zemel leave Vista Del Sol width as it
is.
PETITIONER COMMENT: Fire Department •9 id not indicate to them that
having less than an 18-foot road width would be a problem for them.
STAFF COMMENTS: Alfred Yalda; 2 feet will not be a problem when
maleing turns, and it is a small distance that they will travel; they
pr~fPr 24 feet, however, it is the Commission's call.

Condition No. 1 - amended to show the installation of the specimen

There are no trees to be removed around Vista Del Sol.
Borrego - Request that the installation of those trees be tied tq
something a little bit more definitive then the finalizing of the
grading; he understands from Engineering that could actually drag on
for some time if the petitioner chcases to do so. one of the things
that the Commission may want to consid_r would be to require that the
trees be replaced prior to the issuance of any building permits and
that the trees cannot be removed until after the grading permit has
been approved so that the trees are not removed early.
Henninger - Reword to say "the sooner of the issuance of the building
permit or 60 days after the completion of the grading and that the
removal of the trees not take place until after the issuance of the
gradiny permit." Strike sentence that says "the replacement trees
shall be placed in yard areas closest to Vista Del Sol and location
to the satisfaction of the property owners."
