The proponents in applications which are not contested will have five i minutes to present their evidence. Additional time will be granted upon request if, in the opinion of the Commission, each additional time will ' ' produce evidence important to the Commission's consideration. 2. in contested applications, the proponents and opponent will each be given ten minutes to present hie case unless additional time is requested and the complexity of the matter warrants. It states there are no restrooms, however, there are 4 restroome; improper drainage was due to standing water caused by the recent rains; they do not need arty drainage for this type of work ae this person works with metal and sandpaper; lack of storage was also mentioned. He stated they do store autos inside at night; the next norning the; are working on one or two of the cars and the other coca are parked on the private parking lot area and are outside of the space. Regarding the spray paint booth; Mr. Mendoza does not paint cars on the premises; he pays a person who hoe a spray paint booth on Rose St. in Anaheim; he takes the vehicles to that location and brings them back to finish up the detailing; he does, however, spray a water based primer; the Fire Department did question him or, this, however, he showed them he was using a water based primer and the Fire Department agreed that is not a hazardous material. He spoke with the AQMD and according to rule no. 19 a business is allowed to spray up to 1 gal. a day of a water based primer. Applicant suggested that they make the stipulation that at all times he maintains hie operation within the guidelines of the AQMD, which allows 1-gallon per day of the water based primer; if his business -- expands to the point where he is spraying mora than 1-gallon of primer, then they would make other arrangements. 4/06/92 Page 11 A discussion of the fees listed in the conditions took place and Mr. Borrego explained that these £eea are required by Code and if Mr. ~~ Courtney can submit proof that they paid these fees in the past, then they could waive them. He was also informed that the fees for street lighting and trees are tied to building permits and in this case if there is no building permit necessary, which he did not believe there woe, then the fees would not be due. He stated it should be noted, however, that a spray booth would require a building permit and at that time, the fees would have to be paid. Mr. Yalda explained that the City Council ie the only agency that can waive the traffic signal Lase. COMMISSION COMMENTS: Commissioner Melee stated the Plane show parallel parking along the south property line against the fence with a 20-foot driveway for vehicles to go through. There was concern that a car could not get through Y~here. Condition no. 3 states they are to install a spray booth. He stated this could be reworded to say that the petitioner shall install a spray booth if required by any regulatory agency (and obtain all related permits) and that all work shall be done within thr: premises. Another condition should be added that any parts or vehicles shall be stored inside. Commissioner Henninger stated they were not operating their bueineee the way they should have been operating and that ie why they are here today; they were doing a lot of work outside and not taking care of business the way should have. He hoped all of their promisee get transferred into reality. STAFF COMMENTS: Pam Render, Code Enforcement Officer, stated there is some general clean-up to be done; she was not familiar with spray booths; Code says inoperable care should be stored inside. Bruce Freeman, Code Enforcement, stated the proposed parking spaces that are outside of the building are being tied up by vehicles that the repair shop ie working on and not allowing any place for customer or employee parking; he is parking vehicles he is working on in a private alley that ie adjacent to it; this tells him that he dose not have adequate parking on the property. Code Enforcement is asking that no work be done on the outside of the facility, i.e., no water sanding, no spraying, etc. They are also asking what kind of filtering system they are using and with dry sanding, do they have some kind of vacuuming system? If automotive facilities are doing any kind o.`. painting, it should be done inside of a spray booth because it already hoe an exhaust system and the fumes do not qo into the atmosphere. ~~~ 4/06/92 Page 12 f~ Would like applicant to stipulate that he not have any outdoor etor~ge of any type on the property and that all usage shall be conducted within the building and no work will be completed on any vehicle outside. would like applicant to com~. back within one year and would be terminated at the end of one-year unless a time extension is granted. Mr. Borrego stated there is a condition of approval within the application, i.e., condition no. 6 pertaining to parking, design and layout and one of the things the applicant will need to do within the set period, ie to restripe the parking lot and hopefully that will alleviate some of the problems. Also there should be no storage of vehicle parts outside. Chairman Hellyer suygested they poet that is does not go through. Greg Hastings, Zoning Division Manager, suggested they eliminate conditions 1 and 2; that Code requires it in case there ie a building permit and that will be caught through another mechanism. PETZTIONER'S COMMENTS: Requesting condition no. 1 be changed to f permit them to do business 2 days a week instead of 1 day a week; they help the Health Dept. provide MRI scans and radiology services i helping Medical patients and low income patients; they would like the permit to be extended for 2 years. Employees park off-site when the unit is there. Ma. Caseie (land lord) explained that Mr. Phelps' lease (owner of ~, coin shop) will expire soon and they are planning some changes; Dr. Hoffman is willing to take over that space as soon ae it is available. i When they originally applied for this use, they went to the neighbors and asked them to please contact them directly and they would take care of any problems; no one approached them with their concerns. They have tried to comply; this ie a raceasion and they will have to let people go if this dose nc:; fly. `~J 4/06/92 Page 15 COMMISSION COMMENTS: They are in receipt of 4 letters from the neighbors in opposition to this use. One of the neighbors expressed ~ frustration Tor months. The original uee was granted with a parking waiver, i.e., the Commission gave them the ~~aefit of the doubt; the neighbors say that the parking ie not adequate. This is impacting other peoples lives. STAFF COMMENTS; Bruce Freeman, Code Enforcement, stated this action is a direct result o: Code Enforcement initially and is back before the Commission because the applicant, over the past year, has continued to bring the trailer in for additional days; it was stipulated by the original uee permit that if the applicant wanted to bring the trailer on-site any other days he would have to come back and eliminate one of the conditions; over the past year Code Enforcement has had calla in regards to the trailer and some of these inquiries are why is the trailer there more than 1 day a week? They made 38 inspections of the apartments on the north side and of those inspections, they contacted 8 residents who complained of excessive noise from the MRI unit; 3 resident`s complained that the truck drivers make excessive noise when delivering the trailer to the property; one of the issues is that he playa the radio loud and constant braking noises from the system itself; 2 businesses lorated on the subject property stated when the trailer is parked at the location that there is inadequate parking. One tenant stated if something ie not done, that she will have to move and she has been there for 3 years. Other complaints are that the driver that delivers the vehicle has no respect for the privacy of the tenants in the apartments to the north aide of the property and also complaints from tha occupants of the strip center itself saying that when the trailer is there they do not have ample parking on-site; they have been working with this problem since November of 1989. Jonathan Borrego, Senior Planner, stated at the IDC meeting, the question was asked whether or not there had been any Code Enforcement action on this property and whether there had been any complaints regarding this unit on the property and the answer to both questions by the representative was N0.
