PROCEDURE TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS
1. The proponents in applications which are not contested will have five minutes to present their
evidence. Addklonal time will be granted upon request N, in the opinion of the Commission, such
additional time will produce evidence Important to the Commission's consideration.
2. In contested applications, the proponents and opponent will each be given ten minutes to present
,'~ their case unless additional time is requested and the complexity of the matter warrants. The
' Commission's considerations are not determined by the length of time a participant speaks, but
rather by what is said.
3. Staff Repor'is are part of the evidence deemed received by the Commission in each hearing.
Copies are available to the public prior to the meeting.
4. The Commission will withhold questions until the public hearing is closed.
5. The Commission reserves the right to deviate from the foregoing H, in ks opinion, the ends of
fairness to all concerned will be served.
6. All documents presented to the Planning Commission for review In connection wfth any hearing,
including photographs or other acceptable visual representations or nontfocumentary evidence,
shall be retained by the Commission for the public record and shall be available for public
inspections.
7. At the end of the scheduled hearings, members of the public will be allowed to speak on Items of
interest which are within the Jurisdiction of the Planning Commission, and/or agenda Items. Each

OPPOSITION CONCERNS:
1. Not opposed to development of a church, but is extremely opposed to an
amphftheater proposed 1500 feet from her back yard and asked that the
amphftheater portion be deleted from any approval g(ven today. Proposed
amphftheater faces south toward existing home. Old not feel conceptual plans
could be approved because they are too vague and this could have potential
for adverse Impacts on the residential properties, both existing and planned for
the future. There are many cosmetic Issues that need to be addressed such
as exterior building materials, orientation of pathways to observation areas to
prevent intrusion Into private back yards and parking lot Iight(ng.

2. Concerned about approval of conceptual plans and would like to see more
details. Also, concerned about amphitheater; asked what the property could be
used for if the church failed; asked about the repeated continuances; this is a
dangerous fire area and they will have to have an agreement for fire protection;
lightning Impact on residents; stiff report indicates area not aesthetically
significant; no permanent waste disposal facilftles proposed in Phase I, but in
Phase II; access on Santa Ana Canyon Road, that area is growing and will
become very congested.
PETITIONER'S COMMENTS:
Explained one request is for approval of the 'general concept fora "biblical botanical
garden" with a portion of the garden used for church services; that the garden will be
open to the public, without charge; and that the request is for financing purposes. He
explained they would also like to have approval for one building on one acre for tax
purposes because in the Mello•Roos District, property zoned for church use is taxed
at a higher tax rate, so ff the whole project is approved, the congregation would have
to pay signff(cantly more taxes. He explained in Calffomla there is no zone for
churches, and conditional use permits could be revoked at any time, so the lenders
need some assurance that the church is going to be permitted before committing to
the loan.
Concerning the proposed amphitheater, he explained right now they worship outside
in a temporary amphitheater, weather permitting, but the permanent plan would be that
the amphffheater would Just have the overflow. He explained they would be a good
neighbor; and the amphitheater would not be noisy. He agreed to delete the
amphitheater from the "generel concept" approval.
This conceptual approval would set the confines of what Is allowed on the property,
making flnancing Basler. The multi-purpose building would be a community center in
that part of the Ciry and would be made avaliable to the community as scheduling will
allow; and h will have a Junior high school size gymnasium.
He agreed to meet with the neighbors and schedule sound tests because he did not
want to be a bother to the neighbors.
COMMISSION COMMENTS:
Henninger -
(a) explained staff is very concerned about the aesthetic Impact on the canyon;
(b) he felt the colored exhibits presented today give a pretty good concept and did
not understand why more detailed plans were not avaliable for staffs review.
Asked that the applicant request a continuance and then bring in more detailed
plans. (Applicant requested a 2-month continuance.)
(c) pointed out there is a pond crossing the property line (Applicant explained that
is an existing catch basin, and stated they had a great deal of the slope come
down onto their property during the rains.)
(d) questioned the reason for changing a small portion of the property causing
higher taxes. (Applicant explained he needs to know how much he can build
on the property for flnancing purposes and ff the general concept for the whole
property was approved now, he could tell the Investors that the congregation
is large enough to be able to afford ft. Explained there is no zone fora church
and they are permitted by CUP and Investors need to be assured the
congregation can support a botanical garden on 50, 60 or 70 acres.)

~'y Asked about access. (Applicant explained they own one road and have a
easement to the drlveway; that on the east side, they have a year by year lease
and in the SpecHic Plan for the Irvine Company, they have a commitment to
add that acreage Into the garden and that will become their main entrance; and
that there is a recommended 'Park & Rlde' area, and he hoped they would be
able to use that area on Sunday.)
Masse -
1. Asked what the uses of the multi-purpose building would be. (Applicant
explained h would be used for indoor meetings, gymnasium, games,
banquets, nursery, offices, etc., but that the sanctuary would be outside in the
garden in good weather.)
2. Questicned the garden being proposed beyond the church property line.
(Applicant s::plained they had worked that out with the Baldwin Company to
continue the garden which would soften the look of the slope and noted they
do not have an actual agreement. He further explained they have a drainage
problem now when h rains.)
Caldwell -
1. Questioned approval of a conceptual plan. (Staff responded typically the
Commission does not see conceptual plans);
2. that he is not opposed to a church being developed on that property, but
wanted to see more detail drawings.
Mayer -
Noted the applicant had mentioned several community activities which might
occur on the she and she felt the uses mentioned could have an Impact on the
neighbors and she would like those Issues addressed.
STAFF COMMENTS:
Greg Trombley -Engineering -Explained right now the property is zone Open
Space and when it changes to a religious facility, the tax rate will be Increased
through the Mello Roos District. He responded to Commissioner Masse that
nothing would happen at the next Mello Roos billing ff this is not approved
today. tie referred to a resolution passed by the City Council that ff they build
a structure on one acre, they will not be assessed for religious property on the
entire sfte.
Jonathan Borrego -Planning -Explained the property is zoned for open space
and they are presently using temporary trailers. Explained before committing
to approval on Phase 1, there are additional technical studies which need to
bs provided, particularly soils analysis and hydrology study, and those are in
the Mftigation Monftoring Program and fled to the approval of Phase 1.
Applicant asked about temporary parking on land which he has dedicated to
the City. (Commissioner Masse responded that is not before the Commission
today.)

COMMISSION COMMENTS: Beydstun - Thought a 5-year time Ilmit would be appropriate.
Taft -Stated this is an extremely clean and beautifully landscaped
property.
Peraza -Pointed out all work must be performed inside.
STAFF COMMENTS: Jonathan Borrego -Planning -Explained other businesses in that
area do have a 3-year time Iimft, and that staff recommended a 3 -
year time limit because there is a large land use study underway
which might have an impact on permitted uses In the Canyon
Industrial Area; and that Redevelopment is conducting the study
and the 3-year tiros limit was recommended by the
Redevelopment Agency. He suggested the applicant contact
Redevelopment because Bryan Properties do have a lot a land in
the industrial area and that study may have an impact on other ~
properties they own as weft.

REVIEW: Request for final plan review of roof-mounted equipment, exterior to 4-19.93
elevations and materials for a previously-approved service station/carwash facility. ~
Property location is Savi Ranch Business Park. ~
Michael Kollln, architect, was present to answer any questions.
Jonathan Borrego, Senior Planner, asked about coordination and further review of their
plans by Redevelopment in order to alleviate some of their concerns over their choice
materials.
Della Herrick, Planning, explained the Redevelopment Commission did have a problem
wfth the original proposal for black and white and wanted earth tone colors and asked
the developer to bring back new color schemes, and that they would be discussing
the flags, pointing out flags are not permitted and a variance would be required.
Commissioner Boydstun felt this matter should be continued until after it has been
reviewed by the Redevelopment Commission.
Jonathan Borrego, Senior Pianner, explained they need to submit landscape plans
before they get a building permit
