PROCEDURC TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS
1. The proponents in applications which are not contested will have five minutes to present their
evidence. Additional time will be granted upon request if, in the opinion of the Commission,
such additional time will produce evidence Important to the Commission's consideration.
2. In contested applications, the proponents and opponent will each be gNen ten minutes to
present their case unless additional time is requested and the complexity of the matter
warrants. The Commission's considerations are not determined by the length of tim: a
participant speaks, but lather by what is said.
3. Staff Reports are part of the evidence deemed received by the Commission In eaci~ hearing.
Copies are available to the public prior to the meeting.
4. The Commission will wfthhold questions until the public hearing is closed.
5. The Commission reserves the right to deviate from the foregoing if, in fts opinion, the ends of
fairness to all concerned will be served.
6. All documents presented to the Planning Commission for review in connection with any
hearing, including photographs or other acceptable visual representations or non-documentary
evidence, shall be retained by the Commission for the public record and shall be available for
public inspections.
7. At the end of the scheduled hearings, members of the public will be allowed to speak on items
of interest which are within the )urisdictlon of the Planning Commission, and/or agenda hems.
Each sperker will be allotted a maximum of five (5) minutes to speak.

-- PETITIONER'S COMMENTS:
Referted to Staffs concern regarding traffic and referenced other
convalescent hospRals and their traffic counts and stated he did not think
traffic to this site would be a problem. He explained this property was
designated for a neighborhood shopping center when he purchased it
and was not notified when that designation was changed. Explained the
property is 10 feet above the roadway and wfth the wall, he did not think
the building would be seen. There is a school, two shopping centers and
a nursery in the area and this is the only residence within two city blocks.
Felt this building will look better than the ones he visfted, adding he has
included brick and a file roof. Asked if the Commission would conskier a
waiver of the setback to the school site since there is a 20-foot slope.
STAFF COMMENTS:
Suggested the petitioner meet with staff before revising the plans.
COMMISSION COMMENTS:
Messe - Felt a convalescent hospital might be a good use of this she, but
that this plan did not show any sensfth~ity to the single-family
neighborhood; suggested reducing the size and adding architecture that
is more acceptable to the neighborhood.

Buydstun -asked about the trash container location and the petftioner
~ explained he had removed four parking spaces in the southernmost ~
portion of the parking area and that is where the trash would be located, j
about 250 feet from the kitchen.
Henninger -suggested revised plans to make the building more
architecturally pleasing.
Caldwell - suggested a continuance so the petitioner could work wfth
staff to revise the plans and noted h appears most of the Commissioners
are not opposed to the use, but to the density.
ACTION: Continued Conditional Use Pennft No. 3623 to the September 8, 1993,
Planning Commission meeting in order for the applicant to redesign the
project and submR revised plans.

STAFF COMMENTS:
Planning staff explained the exhibft will be amended to show a modfffed
cul de sac; and there will be a separate request for abandonment to the
Cfty Council and there would be an easement for access granted to the
property owner to the east.
Commissioner Boydstun was concamed that all properties have access
and suggested a condftion be added that access to the properties to the
east shall be granted.
ACTION: The Planning Commission approved the amendment to Area
Development Pian No. 108 and adopted an amended Exhibft I, identifying
a modified cultle-sac at the western end of the deletion;
and further, made the following motion:
Commissioner Messe offered a motion, seconded by Commissioner
Boydstun and MOTION CARRIED that the Anaheim City Planning
Commission does hereby recommend to the City Council, in the event
the abandonment is approved, that a parcel merger be processed on the
Universal Alloy Property (2851-71 La Mesa Avenue) and that an access
easement be provided to the triangular-shaped property abutting the
freeway to the southeast.

Mr. Lederer, applicant, explained they do not have irrigation In the Interior
landscape areas and their landscaper had indicated that irrigation would not be
necessary; that he had submitted what he thought was the appropriate plan, and
did not know he had not complied.
Commissioner Messe asked about the existing planter and berm being in the right
of way of the crftfcal intersection.
Melanie Adams responded ft appears from looking at the plans that a major portion
of the planting would be in the crftical Intersection dght of way.
Mr. Lederer explained that Traffic Engineering dkl not know when they would be
putting in those Improvements and ft would be dftOcult to move the landscaping
back 12 feet and then have to remove ft when the Improvements are done. He also
explained they have dedicated the property.

Commissioner Henninger stated he did not think the landscaping plans are
acceptable and the applicant's request does not even come close to the Intent of
the Code with only seven trees proposed. He added he would like to see a wider
setback and some good sized trees planted.
Commissioner Taft agreed and stated the Commission has bent over backwards to
work with the applicant and he was disappointed with thess plans.
Mr. Lederer stated the CUP required 2% landscaping and they have exceeded that
2%. He added there could be no end to what the Commission wants; that on
weekends the parking lot is full and gNing up parking spaces is a problem. He
stated as the trees mature along Anaheim Boulevard, it will look more dense
Commissioner Messe agreed he would be willing to go along with eliminating the
irtigatlon, but felt more landscaping is needed.
Mr. Lederer responded he would be willing to put in trees larger than 15 gallons.
Commissioner Boydstun suggested another row of trees between the ones they
have now and suggested they be a variety that grows a crown.
Mr. Lederer requested atwo-week cont(nuance in order to revise the landscape
plan.
Jonathan Borrego asked that revised plans show the ultimate right of way and
explained there are plans on file in the Planning Department which show the
ultimato right of way which could be used.
Ms. Adams explained the trees can be planted in the area where they would
ultimately be located. She also explained they are attempting to collect on the
bond and that they could be making the improvements wkhin two years

submit revised plans.
