The proponents in applications which are not contested will have five minutes to present their evidence. Additional time will be granted upon request if, in the opinion of the Commission, such additional time will produce evidence important to the Commission's consideration. 2. In contested applications, the proponents and opponent will each be gNen ten minutes to present their case unless additional time is requested and the complexity of the matter ~'" warrants. The Commission's considerations are not determined by the length of time a ' participant speaks, but rather by what is said. 3. Staff Reports are part of the evidence deemed received by the Commission in each hearing. ~ Copies are available to the public prior to the meeting. 4. The Commission will withhold questions until the public hearing is closed. 5. The Commission reserves the right to deviate from the foregoing if, in Its opinion, the ends of fairness to all concerned will be served. ! 6. Commissioner Tait declared a conflict of interest. He lives within 1,000 feet of this protect. OPPOSITION: 1 OPPOSITION'S CONCERNS: Kevin Oura, 1072 S. Laughingbrook Court. Mr. Oura voiced his concerns that his prNacy would be greatly reduced. Mr. Oura was at the last meeting and many of his concerns were the same, therefore, they will not be repeated here. PETITIONER: The petitioner had no comments at this time. DISCUSSION: Commissioner Mayer asked Mr. Oura if he was aware of what was on the plans when he purchased his property? Mr. Oura explained when he purchased his home, he was told by the sales people in the office that Presley has never put up an apartment complex and their thought was that it would end up being a condominium complex. They never mentioned that the buildings would be placed so clt*se to his home. 12/13/93 Page 2 Commissloner Mayer stated then h is a proximity Issue and not that you did not know tf>at these were ~ going in? Mr. Oura indicated that was correct. His major concem is pry racy and proximity and potential loss of market value of his home. Commissioner Henninger stated when they voted on the waiver of the he;Lht requirement previously, they were shown a drawing and they agreed to waNe the height requlremen; baseri cn ttte concept that there was a grade difference between the adjacent street and the pad of tt~~ buildings. That grade difference was roughly equal to the height of one-story. Now this gentlemen says there is a upslope there rather than a depression. The current ground level is 6-1 /2 feet abovb the street grade, where as the graphic they saw shows ff is approximately 10.15 feet below street grade. He asked ff the grade was going to be changed? Greg Hastings, Zoning Division Manager, stated h does :~.::: along the entire street, Le., is raises as you go to the north. Mr. Oura's property is the most aff~}:te+f since this is the furthest north on that side of Sunset Ridge where there is a house-this one and the one across the street from him. Commissioner Messe stated since this is going to be continued, the applicant should come prepared to answer all the Issues brought up by Mr. Oura. Mr. Hastings stated staff agrees. OPPOSITION: None PETITIONER'S COMMENTS: ,~ Tim Qast name not audible to Secretary), of the Arrowhead Pond of Anaheim. He stated it was his _ understanding that there had only been one change and that was the size of the lettering "of Anaheim." Mr. Hastings explained that the plan on the board is a copy of the one they had In the file and the Planning Commission has the option to make any changes or the applicant can Indicate ff there are any changes. The petitioner presented a copy of the new changes. He explained this was being worked on by Bob Wagner of the Mighty Ducks and their General Manager. Bob Wagner, Corporate Sales Manager for the Mighty Ducks, Disney Sports Enterprises, 2695 Katella Avenue. He handles the corporate sales for the club and also sells the signage for the Arrowhead Pond. They are going through the process of putting up the marque In front of the facility on Katella Avenue. They were directed by the City to make sure that the lettering "of Anaheim" was of the same size as t;ie Arrowhead Pand letters to give it equal value and then the last change they received was to down size the word "of" so the word "of" does not take away from the word Anaheim. He explained there is equal size, however, there is a font style difference. Arrowhead is respective of the Arrowhead water, which Is the title sponsor of the facility. Anaheim was taken off the original font 12/13/93 Page 4 style that was given the facility before Disney got involved. Commissioner Mayer asked for explanation of tha colored rendering. They have tried to find a color scheme that compliments the building. Fred Siavoshi, Heath Company, the company that Is contracted to design and build the sign. He explained the color scheme and a discussion took place regarding the message center, visibility, etc. Commissioner Messe asked for a stipulation that they make this the only sign. THE PUBLIC HEARING WAS CLOSED. ACTION: Granted Conditional Use Permit No. 3653 and added the following condition: 1. That the approved sign shall be the only free-standing sign on subject premises. OPPOSITION: One person spoke and 14 letters were received in opposkion. PETITIONER'S COMMENTS: James Hahn, 20475 Piatorralba, Yorba Linda, 92687. He stated this is a small shopping center. One year ago they had an on-sale beer and wine license. They never used the Ilcense. They have applied for an off-sale beer and wine Ilcense. This is a small convenience market; and every customer coming into the store asks for beer and wine; they tell'hem they do not have beer and wine, so they go to the other stores. He wants to keep up the on•sale b~Jr and wine Ilcense on site. they want the off•sale beer and wine license because the store Is :au slow. They have a lot of problems with the business. Jonathan Borrego, Senior Planner, stated for the record, they have received 14 letters in opposkion. OPPOSITION'S COMMENTS: A. B. Robinson, 1771 S. Bayless Street, Anaheim, CA. He stated the neighbors are objecting to any alcoholic beverages on these premises and they have done so before. He gave some background on the property before a Iic.,nse was ever issued for construction. At one time a restaurant was given an alcohol license and ti~a rsstaurant owner said he could not operate unless he had hard liquor, therefore, the ABC would not grant them a liquor license because j the neighbors objected and they will continue to do so. i They are against any type of alcohol at that location. They also oppose some of the traffic because of the excess traffic that they currently have and the hot rodders going down through that particular portion from Kateila to Kimberly. He gave some further background. THE PUBLIC HEARING WAS CLOSED. 12/13/93 I Page 6 ! DISCUSSION: ~ Jim Gandy, Police Department, Vice Detail. He has been before the Planning Commission regarding this particular location. He stated they would protest any license with the ABC based upon the high crime and over concentration in this area. The crime rate in this area of Anaheim is 124% which is more than double the crime rate of all the other reporting districts. The amount of off-sale licenses in this particular place is 10. For the guidelines of the ABC, only 5 should exist. They do use different guidelines for on-sale and off-sale. Nine could exist for on-sale based upon the population. If the Planning Commission were to grant it, they would file a formal protest with the ABC regarding the issuance of a license. The applicant would have a right to a hearing and bring forth information that showed need and necessity for the area. He has not heard anything from the neighbors that there is a need or necessity for this type of activfty. Their position would be to recommend denial based upon the high crime and over concentration. Commissioner Messe stated the applicant montloned he hart a license for on-premises sale of alcoholic beverages. He was given entitlement by the Zoning Administrator, but did he ever receive a license from the ABC? Officer Gandy explained once a CUP has been Issued that allows h, 'hey can apply with the ABC, however, Mr. Hahn never received a Ilcense. Commissioner Boy, .,tun asked ff he was the owner and was he the owner since the time this store was put in and Mr. ,Mahn Indicated that was correct. Commissioner Boydstun stated when he first got his CUP, the Commission very emphatically asked and questioned him about the fact that this was not the place for any kind of a liquor Ilcense and he indicated at that time he did not need it. She felt the situation was worse now with the things that are going on in the neighborhood. Further discussion took place between Mr. Hahn and the Commission. He did not understand why they gave him the on-sale permit and denied the off-sale permits. Commissioner Masse stated they did not grant a CUP for on-sale. ACTION: CEOA Negative Declaration -Approved Conditional Use Permit No. 3420 -Denied request to delete Condition No. 4 of Resolution No. PC91.87. Denied based upon statements made by the Police Department and the neighborhood's request and that the Commission spelled this out very carefully when this store was first approved. Property is approxlmately 1.04 acre located at the southwest corner of Crystal Drive and Wefr Canyon Road. Waiver of maximum number of wall signs to constrict four (4) wall slgns in conjunction with apreviously-approved car wash facilfry. VARIANCE RESOLUTION NO. PC93-137 FOLLOWING IS A SUMMARY OF THE PLANNING COMMISSION ACTION. NOT TO BE CONSIDERED OFFICIAL MINUTES. OPPOSITION: None PETITIONER'S COMMENTS: Dick BeBeikes, Pacific Auto Wash Partners, 2300 Michelson Dr., Irvine, CA. They are requesting a variance on their signage for the Checkered Flag and Car Wash which is located in the SAVI Ranch Business Park. The purpose of their request is to try to deal with the peculiarities of the site as far as being below grade and having no direct street access to Wefr Canyon. They have found that the circulation and identity is much more difficult then they expected as far as customers identifying the location and also in travelling past and trying to Identify what the name of the business is. They are requesting the variance so they can place on the tower element, 2 signs, one on each side and on one slde ft would say "Checkered Flag" and below that "and Car Wash"; the other elevation would be the same sign and then on the drive•up canopy which faces Crystal Drive, (the tower is not visible from Crystal) they are requesting signage so that when customers do circulate they can identffy that this is the entrance. He referenced paragraph 14 regarding logo and lettering of both the existing and proposed wall signs. It appears that the building contains 3 rather than 6 wall signs. On the canopy drNe-up, it would only be on one elevation; on the tower they tried to keep the letters to a size so that they are are legible by traffic passing by at approximately 50 mph. They have just about the minimum sizing for that. With the staff s recommendation, h would mean reducing the size of the total sign package. He elaborated. They would like to maintain the signage and size they proposed. THE PUBLIC HEARING WAS CLOSED. 12/13/93 Page 8 ii DISCUSSION: Commissioner Messe stated he tends to agree with the applicant on the signs as far as making them on one elevation. He thought there was enough difficulty reading the checkered flag logo and ff k were any smaller h would be worse. He stated on the Crystal Drive entrance, he thought they would be better off ff it just read "Hand Car Wash' or something like that and leave out the corporate Identity logo. Then they could center k above the canopy and ft would look better. Mr. DeBeikes stated they find that acceptable. ~~ ACTION: Variance No. 4239 -Granted with the following change: That the checkered flag logo shall be left off of the canopy facing Crystal DrNe and that the lettering shall read "Hand Car Wash". OPPOSITION: None PETITIONER'S COMMENTS: Jlm Wooley (phonetically spelled) Southern California Mack Trucks, Inc., 8051 East Cerritos Avenue, Anaheim, CA. They are requesting a variance and a sign location so they can be better Identified on the comer of Lewis and Cerritos Avenue. Their customers cannot locate their business. The elevation and the under pass areas makes it difficult to idontiry their building. He submitted some pictures for the Commission's review. He gave an overview of the pictures. Commissioner Messe asked what the problem would be with a monument sign? Mr. Wooiey explained that the monument sign would not have any distinct visibility or advantage over what they have now. He elaborated. Chairman Peraza suggested a monument sign on the corner. Mr. Wooley stated their sign restriction was 8-foot and that is not a very large monument sign for their location. Commissioner Messe stated you would not necessarily be concerned about size as long as people would be able to recognize you and see yau. Mr. Wooley stated that was correct. 12/13/93 Page 10 Commissioner Meyer asked 'rf his customer base was from people who just happened to drive by and see their sign and stop in to buy one of the trucks or Is this somebody that has called ahead and then come to their facility? Mr. Wooley explained they have a customer base that would be coming specifically to their location, but they also depend on the view from the traffic patterns in ail of the streets to bring business to their location. There is also a limfted view of their truck and products at that level. He submftted pictures of other facilfties that had free standing signs. Discussion took place regarding the pictures. Commissioner Henninger stated there is a CUP involved that they were able to put in a condition that they just do monument signs and understand that the City would not like to have the freestanding signs, but he does get the sense that these folks are being unfaidy treated. He would vote for an ordinance amendment to eliminate this sort of signing. He explained as long as it is In the ordinance he does not feel right not letting these people have a sign like this. Commissioner Mayer agreed and indicated she was very much against this type of signage. These types of signs are abandoned and other people come in and buy the property and they do not put a sign in or they cannot afford to maintain ft. She hated to see another one put up. She would Ilke to see a tighter ordinance. Commissioner Messe stated the direction they are taking Is to eliminate these signs, however, they do not have an ordinance in place. Because the ordinance is not in place, there are some feelings that the Commission might permit this. They are trying to get rid of the type of signs that he showed them today. Mr. Wooley stated they have a ten year lease agreement with another ten year option. He could not comment on abandoned signage. Commissioner Messe asked ff there was a time Iimftation on the CUP? He asked ff the CUP ended would the sign come down? Selma Mann, Deputy City Attorney stated not automatically, but the condition could be `mimed along those lines. Commissioner Henninger stated there is nothing that says they could not allow this sign for a period of ten years. Mr. Wooley stated that would be acceptable. It was noted that after nine years it will revert to the old condition and that they would have the possibility at another public hearing to change the condition. They have a 2 year lease. Commissioner Messe asked ff the 20 person limit would be a problem if they should grow? Mr. Burciaga did not anticipate that they would over grow. Commissioner Henninger asked ff a time Iimk was appropriate? She has a secretarial service and decided to put it up for sale due to health reasons. They discovered there was a clause that said that the office should only be used for word processing. That limits the sale quite a bit. She has tried to find someone to buy the business also. She would like to hr•~~e the clause "for word processing use only" changed so she could sell it for other office uses. THE PUBLIC HEARING WAS CLOSED. DISCUSSION: Chairman Peraza asked ff she submitted a list of uses she would like to see. Ms. Pierce stated she did, however, she copied ft from their list of suggested uses. Chairman Peraza expressed his concern about the parking and traffic In such a small space. There are some Rams that would draw more cars then the area could handle. Commissioner Messe suggested they drop item no. 4, page 2. He explained that does not eliminate them from their possibilfties of sale if they had a potential sale, for example, ff someone that wishes to open some type of financial instftution, ft may be that their parking requirements would fit the patitioner's property. They would have to consider that in a public hearing. He added they are opening this up a little bit but they are not opening the Flood gates so the petitioner could sell to anyone. Commissioner Henninger stated for clarification that this use is limited to the 410 square-foot garage and that the resident has to be the business operator. 12/13/93 Page 15 ,~ a Commissioner Messe stated Commissioner Boydstun recommended nos. 5, 6 and 7 and he would also recommend eliminating paragraphs 2 and 4 on page 2. Chairman Henninger stated that would leave us with 1, 3, 6 & 9. Commissioner Messe agreed and anything else would have to go back before the Commission in a pubilc hearing. They do not look at the architectural side of ff. The develoaer would have to provide that. Chairman Peraza asked ff the Fire Department looked at this and Mr. Yaida stated he did not know. He stated the Fire Department usually approves it ff they have a 20-foot access and a knox box and it meets their minimum requirements for ;nstallatlon per their standard. Commissioner Henninger stated this tract was th~ subject of a certain amount of controversy. They started early on with a gate and then one of the points of .oncession was removing k from the plan and now they are bringing it back. We should have more plans and let the neighborhood take a look and see what the owner is doing. Commissioner Boydstun suggested that thought be given to moving down to Include the entrance. Mr. Shahidzadh stated for the record the pillar post for the gate has been installed; all the wiring and conduit has been Installed and all they have to do is put in an Iron rod for the gate to go back and forth. He stated Mr. Yaida Indicated they approve these gates on a dally basis. He would like to request from Mr. Yaida, 3 gates that has been proposed and has been built before any plan has been submkted. He stated wkh the location of the street and the topography, when they stack 3 cart. k will block the street. They have a huge ravine at the side of this street, therefore, if they want to back t .or the turn-around and go back to V(sta Del Sol, k would be a huge liability and hazard in that area. Commissioner Messe asked k the grading was done? Natalie Lockman, Public Works-Engineering, stated the grading was not 10096 complete, however, k is substantially complete. The pads are out there and he still has some cleanup work he still needs to do on the area. She believed that part of the facilkies for this gate was put in and when the street plan was submkted to their department to revise k to show the tum-around, that Is when they found out they wanted to put the gate In and they required that he come back and let the Commission look at the pro;act. Commissloner Henninger asked what sort of percautions did they take to guard against hazardous spills? The only thing that will be stored on site is a very minor amount of oii for maintaining the construction vehicles. Commissioner Messe asked ff there were plans on paving any portion of this property? Mr. Oiomi Indicated they are not. There may be some minor grading, but no pavement. Commissioner Henninger asked what sort of maintenance are they going to do on the vehicles at this she? Mr. Olomi stated the most they would do is some oil changes. Commissioner Henninger asked what sort of precautions were they going to take regarding the waste oil? Mr. Olomi stated he was sure k would be specifically mentioned in the specHication for the protect that the contractor has to make every effort necessary to avoid any spill of oil on the ground. Greg McCafferty, Planning Department, stated the actual staging area would require a separate environmental review, so through that process trey can recommend that she screening be done for the freeway visibility. He stated they are requesting General Plan conformance for the proposed lease of office space for the health care agency, dual diagnosis and drug abuse programs at 1174 N. Euclid. This was discussed at the morning session and they did review the staff report this afternoon and his office submitted a change which was submtted too late to go into this prnted report. He referenced page no. 4 and stated instead of reading approximately 325 clients would be treated annually, they would Ilke k to read "50 to 75 per day." They did not want to give the Impression wkh the 325 figure that only one person per day would be walking Into the clinic. Commissioner Henninger stated there is an existing facility in the Cky and there are some problems at that facility. He asked it the result of moving to this location would be the result of moving those problems to a dffferent location? Mr. Weams explained they believe that the problems are actually because of the proximky to the park where they understand there is a lot of trafficking of drugs, etc.; and that the clients that are possibly involved in these actfvkies are from Soclai Services Agency and one of the other offices. They have a very small portion of the total office space at Homer Street and that Is the portion they are moving to this new site. The existing skes for these particular programs do not have this problem. Commissioner Henninger asked k there would be lokering at these skes? Mr. Weams stated they are doing their best to prevent that. He stated part of the design for the dual diagnosis program is to have an a~;tivity room where there can be some space available for them when they come to the office prior to their appointment so they will not have to wait around outside. He explained that these clinics are on an appointment basis only. 12/13/93 Page 22 Commissioner Messe asked for clarfficatlon ff these two facilRies will be the sole tenants of the building? Mr. Weams explained one building will be the dual diagnosis program and the other building they will occupy approximately 80% of ff. The owner wili be free to lease the rest out to other medical uses. Commissioner Henninger commented that they use to put all of these uses together and he wanted to know ff they had changed that policy. Doug Barton, Deputy Director of the Mental Health Care Agency. He explained several years ago the that the SocialiServ ces Agency/ as now beeniremoved f om hcealth rare and these are two separate freestanding agencies. Further discussion took place between the Commission and Mr. Barton about the idea of the uses tradffionally being put together versus the idea of getting away from that Idea and the problems associated with putting the uses together. Commissioner Messe asked ff they have already contacted the neighbors relative to this use, both commercial and residential? Mr. Barton stated that will take place following termination of this hearing. They routinely do that. Commissioner Messe noted for the record that they did receive a document entitled 'County of Orange Health Care Agency, Mental Health and Drug Abuse Services.' Further discussion took place regarding co-locating with Social Services. ACTION: It was determined that the proposed County use is consistent with the Anaheim General Plan. G.
