hereby determine that the previously certified EIR 268 Is not adequate to serve as
the environmental documentation for this time extension request.
Commissioner Henninger offered a motion, seconded by Commissioner Messe and
MOTION CARRIED that the Anaheim City Planning Commission does hereby
deny the request for an extension of time for Condftional Use Permit No. 2713 on the
basis that a "good cause" was not shown.
The item was trailed until after the last item on the agenda.
Cheryl Flores, Associate Planner. Slated staff contacted the applicant yesterday, and the applicant
requested the staff report be faxed to him, which they did. Staff Just tried contacting the applicant, but was
unable to reach him.
Commissioner Messe stated they now have tiro choices, they could either continue or take action on the
item.
Mary McCloskey, Deputy Planning Director. She explained the item has been continued twice in order for
the petitioner to meet with staff. Staff did have a meeting with the petiticner where approximately an hour
was spent in discussing the project and it was explained to the applicant why staff was requesting doniai of
the subject request. She stated the petitioner clearly understands the sftuation.

facilities). This petition was originally approved on July 25, 1994 by the

Planning Commission has reviewed the proposal an!f does hereby find that
the Negative Declaration previously approved in connection with
Conditional Use Permit No. 3698 is adequate to serve as the required
environmental documentation in connection with this request upon finding
that the declaration reflects the independent judgement of the lead agency
and that it has considered the previously approved Negative Declaration
together with any comments received during the pubUc review process and
further finding on the basis of the initial study and any comments received
that there is no substantial evidence that the project will have a signffica~~t
effect on the environment.
Commissioner Messe offered a motion, seconded by Co:ri;nis~(oner
`v Henninger and MOTION CARRIED, that the Anaheim Planning Commission
does hereby approve a one (1) year retroactive time extension for
Conditional Use Permit No. 3698 (to expire on July 25, 1996), based on the
following:
(a) The proposed service station with car wash facility is an authorized use
subject to the approval of a conditional use permit.
(b) There have been no new code amendments which pertain to the
development of the subject property.
(c) That the petitioner has complied with all conditions of approval to be
met "prior to the issuance of building permts'.
(d) That tl~e requested extension of time will allow for the petitioner to
obtain building permits to develop the subject property as previously
approved by the Planning Commission.
Commissioner Messe asked if the applicant is in the process of pulling their building permits?
Juan Sandival, A & S Engineering, he responded 'yes", however, they might have to go through plan check
again because the plan has expired and the code has changed.

Commissioner Messe referred to Condition No. 4 in the staff report and asked Mr. Goodwin ff he
read the condition.
Fred Goodwin stated yes', but they didn't qufte understand the wording. He stated he assumed ft
meant a review of the item and then a renewal.
Commissioner Messe asked staff why Condition No. 4 was recommended for a year'?
Cheryl Flores, Associate Planner. She stated they were concerned about the outdoor storage and
staff would like to re-evaluate ff in a year. At that time, the subject use could be readvertlsed to
modify or delete the condition of approval.
Fred Goodwin stated he has a concern with Condition No. 6 pertaining to the perimeter chainlink
fencing. He indicated on the west skis perimeter the auto parts warehouse property has installed a
modem barb-wire device on top of their wall. The barb-wire would have to be removed, temporarily,
(n order for them to install the requested screening material on the west sloe perimeter.
Commissioner Boydstun asked ff the west side could be exduded since it backs up to a supply yard
and is not on a public street where it can be seen?
Cheryl Flores stated she doesn't believe the area is visible ftorr~ the street, but the code states the
storage must be screened ftom view.
Commissioner Boydstun asked for clarification ff the west skis is visible from the street?
Fred Goodwin responded the west side is a very large parking lot for their facility, but not too many
cars utilize the parking lot.
Commissioner Boydstun suggested to install a net screening (green vinyl tarp) in the west side area
which would obstruct the view.
Fred Goodwin stated they do not have any objection.
Cheryl Flores indicated it has been an acceptable screening method in the past.
Commissioner Boydstun spoke relative to Condition No. 4 and asked ff ft's necessary for the
applicant to apply for a conditional use permit, again, could the subject use come back for a
one-year review?
Selma Mann stated 'ft is deliberately worded this way in situations where staff and/or the
Commission wishes to have another look at a business. If a one-year review is made, ft completely
shifts the burden of proof around so that the burden is upon the City to proof a case."
Commissioner Boydstun asked ff the applicant would need to pay, again, for a condftional use
permit?
Cheryl Flores responded at that time a fee would not be irndved, but staff would re-evaluate the
initial study.

Commissioner Messe asked for clarffication relative to the condtional use permit fee being charged
again.
Cheryl Flores responded $3301s the current fee for a conditional use permit, and that fee would not
be charged at the re-evaluation of the initial study.
Commissioner Peraza commented he understands the applicant has indicated that there would be
no painting services at the subject facility, but he would suggest a condition be added stating that
"in case painting services are provided that the applicant would need to conform wfth Air Quality
Management District (AOMD).'
Commissioner Henninger suggested the added condftion to read "in case painting services are
provided, that the applicant would conform with all of the regulations pertaining to paint booths'.
Fred Goodwin stated they are aware of the regulations they would have to comply with and he
stated they have no objection to the added condition.
Commissioner Bostwick asked the applicant ff he would like Condtion No.1 to be extended to
120 days.
Fred Goodwin responded yes'.
ACTION: Approved Negative Declaration
Granted Conditional Use Permit No. 3818, for one year, with the following
changes to conditions:

1. That building permits shall be obtained for the existing metal canopy

STAFF'S COMMENTS:
Commissioner Bristol asked if there has been any activfty reported fn the last 12 months.
Investigator Tom Engle, Vice Detail, Police Department. He responded "yes', and explained the
activities reported have occurred from January 19, 1995 to present. He stated there have been
twenty-stx (26) reported calls for service at the subject location:
1. Ten (10) disturba:~ce of peace and fighting
2. A person with a firearm
3. A malicious mischief
4. Suspicious person

7. Eleven (11) abandoned vehicles on the property
Commissioner Masse Indicated ff the eleven (11) abandoned vehicle calls were eliminated, there
would then be fffteen (15) reported calls for service. He asked for clarification relative to the time
period of the calls.
Investigator Tom Engle responded the calls received are En an approximate one-year period.
Commissioner Bristol asked Mr. Amestoy 'rf he fs aware of the hours of operation at the subject
facility.
Mr. Amestoy responded he believes it is a 24hour operation.
Commissioner Boydstun asked ff the police report stages what time of day the calls were -ecefved?
Investigator Tom Engle responded the calls received are at all hours of the day, but most of the calls
are in early morning. The disturbance calls appear to be at 1:00 a.m. - 3:00 a.m.
Commissioner Masse asked what staffing is availabl$ at 1:00 a.m. - 5:00 a.m.
Mr. Amestoy responded "ha is the architect for the project and he is not very familiar with the entire
staffing of the subject operation."
'.,~~ Commissioner Bristol asked ffwalk-in customers are attended to after 12:00 p.m., or is it strictly
drive-through?
Mr. Amestoy stated, he believes, the subject facility is open 24 hours for walk-in and drive-through
customers.
Commissioner Bodystun suggested that the item be continued for the applicant to provide additional
information relative to the operation of the facility and she indicated a security guard may be
needed.
Commissioner Henninger suggested a condition be added stating that 'the applicant will provide one
licensed securely guard ff deemed necessary by the Anaheim Police Department.
Further discussion took place between staff and Commissioners relative to the procedures that need
to be taken after the Planning Commission recommends for the Pdice Department to determine the
amount of security guards needed at a location.
ACTION: Approved Negative Declaration
Approved Waiver of Code Requirement
Granted Conditional Use Permit No. 3821 with the fdlowing added conditions:
That within a period of ninety (90) days or prior to use of the outdoor dining area,
whichever occurs first, the petitioner shall meet wfth the Anaheim Pdice
Department to determine the need for a private security guard at subject facility.

accommodate a couple of parking spaces and to keep within the requirements of allowing back-up
space for the drive-through lane.

Commissioner Henninger stated he believes staff was unaware of the landscape setback area being
modified, therefore, he indicated a waiver may have to be advertised.
Commissioner Henninger asked staff ff the spaces do encroach into the required landscape

Greg Hastings, Zoning Division Manager. Stated there is a 14-foot required landscape setback, but
in the past'he street was widened and he believes currently the setback is not even 14 feet.
Therefore, the existing landscaping could not be reduced down ftom iGs present wkith without a
landscape waiver.
Commissioner Henninger asked staff if the parking spaces need to be moved to provide back-up
space for the drive-through lane?
Alfred Yalda, Principal Transportation Planner. He concurred with Mr. Anderson's comments relative
to making the necessary changes in keeping within the requiremonts.
Further discussion followed between staff and Commissioners relative to the parking and
landscaping issue in accommodating for the back-up space.
Rick Anderson stated they concur with all conditions, except for Cond~ooeS ~~a elan employeeing
a unfformed security guard. He explained that Burger King Compa y
every hour to check the premises.
Planning Commissioners agreed to change the wording in Condition No. 8, adding "that a uniformed
security guard shall be provided if deemed necessary by the Anaheim Pdice Department.
Rick Anderson stated they were in agreement relative to the wording change in Condition No. 8.
Cheryl Flores, Associate Planner. She suggested Condition No. 8 to be eliminated ftom Condition
No. 12 since a security guard may not be requirsd.
Selma Mann, Deputy City Attorney. She asked for a darif(cation to be made on the ftont page of
the staff report, under rzauest section, which pertains to the minimum number of parking spaces
and she explained the way ft is written is confusing. She also stated it should Indicate the code
required parking is 704 spaces.
Commissioner Messe stated 418 spaces was a result of the parking study and he agreed the
wording is confusing.

Commissioner Henninger stated the sub-committee recommends that the 'googie signs" that are being
removed within the City of Anaheim to be documented and he asked if Bret Cdscn, Anaheim Public
Information Manager, has the ability to do the documentation.
Mary McCloskey, Deputy Planning Director. She Informed the Commission that Bret Colson has the ability
to take pictures as a base photography, but not to do a full documentation as far as the history or verbal
text.
Commissioner Henninger indicated there are not too many "googie signs' and he stated with Bret Colson's
offer and in conjunction with additional time made by the Planning Department that he feels the
documentation could be made in a reasonable way, for a very minor cost.
