Mr. McDonald answered they are going to continue having the patio as a flex area. It will be oriented to the brew operation from an architectural ststnd point, but they will continue to use it for both. APPLICANTS STATEMENT: Mr. Sung stated they are proposing to dedicate 1,500 square feet of an existing retail store to amusement games and pod tables. They have set their hours to work around student's schedules to curb truancy. The proposed hours of operation are from 2 p.m. to 10 p.m. Three of their employees will provide supervision at all times. It is a well lit area and they have security cameras. He stated they have been working extensively with the Police Department to keep the crime rate down. They would like to be a part of this community. They would like to be able to sponsor shhod and community sports teams. He continued to say he expects their general clientele to be family oriented. They currently have customers ranging in age from 14 on down or 25 on up which means that parents come in with their children. He addressed the memorandum from the Police Department regardbig the crime rate and stated by working with the Poice Department they are actually curbing the crime rate or bringing h down. The instances that are sfted in the memorandum ftom the Senior Code Enforcement Officer are from 1984 and we have only been in operation since January of this year. To accurately analyze the situation he believes Code Enforcement should concentrate on what has happened since he began operating the arcade. They have been working to do everything according to the Code. No one tram the public indicated a desire to speak. Mr. Sung indk~ted that he has only been there since January, however, one of the reports that is before the Planning Commission is Pdice Department calls for service which indicates 17 calls for service since March of this year. Chairman Messe asked for some of the detail of the 17 records of police calls to the area. Investigator Engle stated over the last 5 month period they received 7 different types of disturbing the peace calls, the~s were 3 unknown tro theft. Ils, there was a trespassing call, some patrd checks, a reported burglary and attempted petty Chairman Messe asked ff that was for this address only. Investigator Engle responded yes, for 1727 W. La Palma• Chairman Messe clarffled this is Just one part of a long strip center, so there would be other records for those addresses. Investigator Engle agreed. Commissioner'Bostwick asked Mr. Sung ff he is currently operating an arcade. Mr. Sung responded yes, with 4 games and 2 pod tables. Commissioner Bostwick asked ff they are at their maximum. Cheryl Flores, Senior Planner, responded Yes. Commissioner Mayer asked ff they can continue to operate with what they have now, ff they were to deny this action. Cheryl Flores responded yes, they can continue 40 operate with 4 or less of the games and 2 or less of pool tables. Commissioner Bristd asked Mr. Sung ff the 2 phones outside of 1731 West La Palma Avenue were his. Mr. Sung responded Yes• Commissioner asked ff they were recently installed. Mr. Sung answered yes. He requested to look at a copy of the police repot ind~atlng the 17 incidents. Irnestigator Tom Engle provkied him with a copy of the report. 09-16-96 Page 10 SEPTEMBER 16, 1996 ANAHEIM CITY PLANNING COMMISSION -SUMMARY ACTION AGENDA Chairman Messe stated the applicant is trying to intensffy a use that is already there, going om our arcade games to twenty eight. That means seven times the intensification. He asked ff this was going to take place in the same square footage. Mr. Sung responded yes, in the same 1,500 square feet. He stated a fot of the phone calls in the police report were mainly patrd checks. Up until two months ago, they had a problem wffh a few people loitering outside, but they have not allowed them to come around the area and they have not had no calls sirmce then. He stated that shows they have taken care of any problems. Chairman Messe stated the applicant has testified that he has been working with 4 police officers to help try and sdve some proiAems in the area. Unfortunately, what that tells him Is that there are definftely some problems in that area. Commissioner Henninger asked ff the attempted theft was directly related to this arcade. Investigator Engle answered yes, ft was called In from that location. These are calls from that address. Mr. Sung stated he does not recall the petty theft and the burglary. They might have been called from this address, but they dkf not occur at that address. Bruce Freeman, Code Enforcement, stated a number of businesses, like the muffler repair facility at this same center, close at 5 or 6 o'clxk at night. Some of the problems that are not showing up on this police report is when an officer stops somebody or something is Called in where they are next door in the same shopping center parking lot. He stated ons of the problems the Code Enforcement Division has seen over the years with the arcades is the telephones. Commissioner Boydstun asked why did the applicant put two phones up front. Mr. Sung responded the owner of the building put them there. Commissioner Henninger asked Mr. Freeman ff wi-~at ha had said was that there are existing problems in the area and this use would aggravate them. Mr. Freeman answered that is correct. If you drive through that neighborhood You will sae the (offering that occurs in the alley. The alley has a direct access to two separate areal of t~hre eaPa~u~ ~ ~ ax. Irnestigator Tom Engle responded the percentages are the same for either liquor license or this high crime area. He asked how long can an appl be continued. Greg Hastings, Zoning DNision Manager, answered six months from the time the application was receNed. Cheryl Flores, Senior Planner, stated the application was deemed complete on August 5, 1996• Mr. Hastings stated the Commission also needs to leave Borne time for any City Council action because it is included In that time period. If someone was to return a car tonight, the manager would be allowed to test drNe the car, take ft home, and bring it back the next rooming to prepare it for delNery to another location. Management staff do not drNe their own cars, they always drNe in and out with a company car. He stated ff for any reason they do not have a car for them, they shuttle that person to one of their other stores that does have a car and he/she will take a car ftom there. Chairman Messe asked ff a waNer would be required ff the Commission approved the rental agency to have eight cars on the site. Commissioner Henninger stated they have seven parking spaces left over and ft seems there might be fivo spaces that might be comfortably parked tandem in the back. - Chairman Messe stated there are frfteen parking spaces on this lot and what we are saying is that some of theme spaces are required by the restaurant, ff we allow ten spaces to be used by a spfl over. Is that Enterprise, the restaurant would be able to use five spaces on this piece of property true? Cheryl Flores, Senior Planner, responded the restaurant, based on 16 spaces per 1000 square feet, requires 23 spaces and the rental facility requires five, the remainder could be used towards the rental cars.
