develop something that is consistent with what they believe the direction of the Stadium Area is going
ftom a quality and architectural stand point. They are here for a long term. It is the same ownership.
He stated they have read the conditions of approval and they are ail axeptable. They intent to comply
with them and have the operation open some time in the spring of 1997•

Mr. McDonald answered they are going to continue having the patio as a flex area. It will be oriented to
the brew operation from an architectural ststnd point, but they will continue to use it for both. He

APPLICANTS STATEMENT:
Mr. Sung stated they are proposing to dedicate 1,500 square feet of an existing retail store to
amusement games and pod tables. They have set their hours to work around student's schedules to
curb truancy. The proposed hours of operation are from 2 p.m. to 10 p.m. Three of their employees will
provide supervision at all times. It is a well lit area and they have security cameras.
He stated they have been working extensively with the Police Department to keep the crime rate down.
They would like to be a part of this community. They would like to be able to sponsor shhod and
community sports teams.
He continued to say he expects their general clientele to be family oriented. They currently have
customers ranging in age from 14 on down or 25 on up which means that parents come in with their
children.
He addressed the memorandum from the Police Department regardbig the crime rate and stated by
working with the Poice Department they are actually curbing the crime rate or bringing h down. The
instances that are sfted in the memorandum ftom the Senior Code Enforcement Officer are from 1984
and we have only been in operation since January of this year. To accurately analyze the situation he
believes Code Enforcement should concentrate on what has happened since he began operating the
arcade. They have been working to do everything according to the Code.

Bruce Freeman, Code Enforcemern SupervisoG stated the memo stipulates certain problems associated
with this center. Mr. Sung indk~ted that he has only been there since January, however, one of the
reports that is before the Planning Commission is Pdice Department calls for service which indicates 17
calls for service since March of this year. Over the years, there have been continual problems because

Investigator Tom Engle, Anaheim Pdice Department, stated we concur with the Code Enforcement
Division. Unfortunately, i don't have any status to compare last year's crime rate to this year's because
last year that property was vapnt. There is a 138% above-average crime rate at this location and a
215% above average crime rate across the street. The Pdice Department believes that is way to high.
Chairman Messe asked for some of the detail of the 17 records of police calls to the area.
Investigator Engle stated over the last 5 month period they received 7 different types of disturbing the
peace calls, the~s were 3 unknown tro theft. Ils, there was a trespassing call, some patrd checks, a
reported burglary and attempted petty
Chairman Messe asked ff that was for this address only.
Investigator Engle responded yes, for 1727 W. La Palma•
Chairman Messe clarffled this is Just one part of a long strip center, so there would be other records for
those addresses.
Investigator Engle agreed.
Commissioner'Bostwick asked Mr. Sung ff he is currently operating an arcade.
Mr. Sung responded yes, with 4 games and 2 pod tables.
Commissioner Bostwick asked ff they are at their maximum.
Cheryl Flores, Senior Planner, responded Yes.
Commissioner Mayer asked ff they can continue to operate with what they have now, ff they were to
deny this action.
Cheryl Flores responded yes, they can continue 40 operate with 4 or less of the games and 2 or less of
pool tables.
Commissioner Bristd asked Mr. Sung ff the 2 phones outside of 1731 West La Palma Avenue were his.
Mr. Sung responded Yes•

Mr. Sung answered yes. He requested to look at a copy of the police repot ind~atlng the 17 incidents.

Chairman Messe stated the applicant is trying to intensffy a use that is already there, going om our
arcade games to twenty eight. That means seven times the intensification. He asked ff this was going
to take place in the same square footage.
Mr. Sung responded yes, in the same 1,500 square feet. He stated a fot of the phone calls in the police
report were mainly patrd checks. Up until two months ago, they had a problem wffh a few people
loitering outside, but they have not allowed them to come around the area and they have not had no
calls sirmce then. He stated that shows they have taken care of any problems.
Chairman Messe stated the applicant has testified that he has been working with 4 police officers to help
try and sdve some proiAems in the area. Unfortunately, what that tells him Is that there are definftely
some problems in that area. He stated he does not know how much the intensfficatlon of this business

Commissioner Henninger stated he would like to hear an explarmatior+. from Police Department of the
calls.
Investigator Engle stated a 'PC call is a patrol check, a '415ihcall the is'930' call 1 ssee the~mantcall,fthe9•
call is a reported burglary, the 'T488' call is attempted petty
'931' call is see the woman call, a '602J' call is a trespassing and the 'SS" call is a subject stop.
Commissioner Henninger asked ff the attempted theft was directly related to this arcade.
Investigator Engle answered yes, ft was called In from that location. These are calls from that address.
Mr. Sung stated he does not recall the petty theft and the burglary. They might have been called from
this address, but they dkf not occur at that address.
Bruce Freeman, Code Enforcement, stated a number of businesses, like the muffler repair facility at this
same center, close at 5 or 6 o'clxk at night. Some of the problems that are not showing up on this
police report is when an officer stops somebody or something is Called in where they are next door in
the same shopping center parking lot.
He stated ons of the problems the Code Enforcement Division has seen over the years with the arcades
is the telephones.
Commissioner Boydstun asked why did the applicant put two phones up front.
Mr. Sung responded the owner of the building put them there.
Commissioner Henninger asked Mr. Freeman ff wi-~at ha had said was that there are existing problems in
the area and this use would aggravate them.
Mr. Freeman answered that is correct. If you drive through that neighborhood You will sae the (offering
that occurs in the alley. The alley has a direct access to two separate areal of t~hre eaPa~u~ ~ ~ ax.
There are a lot of problems in that alley and they spread over to the shopp g

Cheryl Flores, Senior Planner, stated the application was deemed complete on August 5, 1996•
Mr. Hastings stated the Commission also needs to leave Borne time for any City Council action because
it is included In that time period.
Chairman Messe stated that does not gNe the Commission enough time to cdlect data.
Mr. Sung stated he will not be able to support the business with just four games and two pod tables.
He stated if the permit is denied, the shop might not be able to survive the five or six months beisg~ the

Dudley Frank, owner of subject property, stated he is very pleased to have Enterprise as a tenant. They
are going to make a real good Improvement to the property. They are going to resurface and restripe
the parking lot. Keeping a good tenant there has been a problem. The drNe-through restaurant existing
there now has had some struggle and he has never seen the parking to to IsI.88Hthishappen. seen more
than fifteen or twenty cars parked there for the restaurant. He is happy

Chairman Messe asked ff the "quick prep' is an interior vacuun:;~+9 and dusting?
Mr. Willard answered, yes, when you go to a car wash they wash the exterior and they dean the interior.
Customers accept the fact that the exterior of a car is not washed because of the rain or because the
carwash is dosed, however, the interior, rain or shine, needs to bd dean. They do not intend to pull out
a hose and wash any cars, but to be able to 'quick prep" a rw;r.
Commissioner Henninger stated he heard the applicant accept the hand washing of the windows and or
the vacuuming of the interior. So that can be added to Condftlon No. 1.
We asked staff ff the building was standing alone, would Code require 5 parking spaces for ft, and if the
other 30 spaces are needed by the restauran±.

Commissioner Henninger stated then there is an extra seven parking spaces. He asked the applicant
how many employees does he intend to have.
Mr. Willard answered they plan to start with 2.3. He stated the management staff drNe company cars,
not their own. If someone was to return a car tonight, the manager would be allowed to test drNe the
car, take ft home, and bring it back the next rooming to prepare it for delNery to another location.
Management staff do not drNe their own cars, they always drNe in and out with a company car. He
stated ff for any reason they do not have a car for them, they shuttle that person to one of their other
stores that does have a car and he/she will take a car ftom there.
Chairman Messe asked ff a waNer would be required ff the Commission approved the rental agency to
have eight cars on the site.
Cheryl Flores, Senior Planner, responded the Code required parking would remain the sama. There
would be five required for this business and the remainder for the restaurant. There are fffteen spaces

parked tandem for the storage of the rental cars.
Greg Hastings, Zoning DNision Manager, stated the problem they have with tandem parking is that the
Code does not allow required parking to be tandem.
Commissioner Henninger stated they have seven parking spaces left over and ft seems there might be
fivo spaces that might be comfortably parked tandem in the back.
- Chairman Messe stated there are frfteen parking spaces on this lot and what we are saying is that some
of theme spaces are required by the restaurant, ff we allow ten spaces to be used by a spfl over. Is that
Enterprise, the restaurant would be able to use five spaces on this piece of property
true?
Cheryl Flores, Senior Planner, responded the restaurant, based on 16 spaces per 1000 square feet,
requires 23 spaces and the rental facility requires five, the remainder could be used towards the rental
cars.
Chairman Messe stated that gives us seven. He stated with the stipulation that the employees use
company cars to go home in, they will still be parking some cars overnight.
Mr. Willard answered yes, indeed, because their customers will need a car the next morning to get to
work.
Commissioner Mayer asked ff these vehicles are for customers that need to get to work In the rooming
and then return them at the end of the day.
Mr. Willarci agreed. He stated they are in the Home City Market and the dfffen3nce between that and the
airport market is that most of their referrals come from insurance companies and from oe~~ uld be n
body shops. So ff you had a car acckfent and you needed a car for twenty one days y
our car while yours is being repaired. He stated the good news in his business, unlike primary
companies, Is that ff I know your car is going to be repaired tomorrow and you will need a car tomorrow
when that car comes in we take it to the carwash, test Y and it will go to you. We have the ability to
maneuver our fleet that way and certainly to move them because we are not franchise.

Dave Smothers stated he (s the agent for Shell Service Station and the property owner. They are
proposing an approximately 1,100 square foot new food mart building on the east skis of the lot.
Subject property is situated at the northeast comer of Brookhurst and Ball Road. He stated he met wfth
different departments wfthin the City and they will comply wfth all the condftions.
He stated they are going to remove the existing gasoline dispensing equipment and upgrade as per the
EPA requirements. They wUi take out old steel piping and tanks and replace them with modem
equipment which is very friendly to the environment. He stated that is what triggered the construction of
the new food mart. It is all part of Shell's nationwide FTD C,arec*;,,aign. This is similar to how other
companies like Arco has fts AM/PM Mini Market and Texaco lies its Star Mare In order for Shell Service
Station to catch up with today's market they need to abandon the small kiosk look and go with a full
food mart wfth the exception of alcohd sales.
He added there ~:vill be some reconstructing of the planters in order to make the parking work. They will
be abandoning cne driveway and creating a large planter on the comer, changing the triangular sign to
