Specific Plan and in compliance with the Design Element of that plan.

RETROACTIVE EXTENSION OF TIME TO COMPLY WITH (To expire 8-23-97)
^ONDITIONS OF APPROVAL: Frank Souza, 14910 Garfield Avenue,
Paramount, CA 90723, requests a retroactive extension of time, to
expire on August 23, 1997, to comply with conditions of approval for
Conditional Use Permit No. 3691 (to permit a 10,000 square-foot
church with waiver of minimum landscaping requirements). This
petition was originally approved on August 23, 1994. Property is

Cheryl Flores, Senior Planner presented staff report recommendations. She stated there
is currently a dealership that would like to come in and use the same condftional use
permft, would be displaying vehicles for sale. The original business, Coast Corvette, is
also able to display 5 vehicles for sale along the west property line. Commission would
detem~ine whether this would be in substantial conformance and if so ft would be a
matter of the petitioner returning after readvertising this petftion to amend or delete a
condition of approval which restricts the amount of spaces available for display of
vehicles for sale.
Cheryl Flores responded to Commissioner Henninger's question that the business was
currently operating.
Commissioner Henninger recommended Conditional Use Permft No. 2798 for public
hearing to discuss the proposed revised use and revised parking waNer.
Commissioner Mayer asked ff the auto pawn portion would also be part of the public
hearing?
Cheryl Flores responded that the applicant did explain to staff that the business
operations in other cities did consist of an auto pawn business but that ft was not
proposed at this location.

PETITIONER'S COMMENTS:
Phillip Anthony, 14101 La Patt Place, Westminster, representing Canyon Plaza Shopping Center, stated
the shopping center is one of the rider centers in that part of town and has been at this site for
approximately 20 years. A few years ago the shopping center suffered a disappointing loss when the
anchor tenant, Albertsons, suddenly left. There has been a major effort to f(nd arY.nne~ tenant(s) and to
rehab and upgrade the center to give it a face-Ifft which has been in progreQ~ for the past sb:eral
months. There is one new tenant, a smaller market called "Farmed Market". They have redone the
landscaping and the paving (n the parking lot in front of that part of the shopping center.
Mr. Anthony further stated they would like to complete the job of improving both the buildings and the
landscaping in that part of the center. There has been much work done on the building ftonts and the
building elevations to give a new look. As part of the landscaping ~o be compatible, the issue came up
regarding the Eucalyptus trees that were originally planted right up against the buildings. Those
Eucalyptus trees have been a problem at that particular location ar,~d the recomrru~:~dation is to take
those out, put new Eucalyptus trees in other areas in the center where they would look and do better
and replace them with mostly palm trees and other landscaping. Cunantly palm trees are not on the list
as allowed replacement trees.

' Bob Nutall, architect, stated they created a new design theme to create a new look to the center while
still keeping the integrity of the original European village design of the center. A maJor problem at the
shopping center are the Eucalyptus trees that were originally planted directly In front of the facades
which are causing damage, uplifting the concrete and have created an extensNe safety hazard. He
illustrated his point by showing photo boards of the Eucalypt~t~ ~ ~#~~ep~ Board ~3 & #4
~~. Bird #2 showed the amount of Eucalyptus leaves,
depicted the damage that has been occurring as the Eucalyptus trees have matured by uplffting the
pavement, cracking the planters, causing damage to concrete curbs whk;h in tum create a lot of tripping
hazards, Board ~5 showed what they have accomplished to date and where they are gdng with the
overall design of the center. In order to complete the theme they requested thaw I~ the emaini~ng
trees and the removal of the Eucalyptus trees around the ftont of ikon tP~tP ~ are proposing.

SUPPORT:
Bonnie Callon, resident of Anaheim Hills for 25 years and also a merchant in Canyon Plaza Shopping
Center for the past 20 years, spoke in favor of the removal of the Eucalyptus trees and replace them
with something needing less care and maintenance. Mrs. Callon stated there Is a problem with the
Eucalyptus trees because they lift up the tges, people are slipping and falling. She believes it would be
in everycnes best interest to make the center look more attractNe by updating the canter thereby
making it better for everyone that comes in.

ACTION: Cormissioner Henninger offered a motion, seconded by Commissioner Peraza and
MOTION CARRIED that the Anaheim City Planning Commission has reviewed the proposal
to remove 26 Eucalyptus trees with waiver of required replacement of trees on an irregularly-
shaped parcel of land consisting of approximately t7 acres located at the northwest comer
Af Via Cortez and Barrie Ana Canyon Road having a ftorrtage of approximately 1,095 feet on
the north skis of Santa Ana Canyon Road arsJ a ftontage of 480 feet on the west skis of Via
Cortez and further described as 5701-57 ~ Eah Neng~at ee Decaaration upon finding that the

(a) That the trees removed will be replaced at a greater than two to one basis (2.27
replacement trees per eucalyptus tree removed);
(b) That the proposed palm trees in the east end of Canyon Plaza will better compliment
the existing palms and will facilitate a consistent landscaping theme throughout the
commercial center;

(c) That the safety of the property and the persons on the property will continue through
the removal of certain trees that are prone to dropping oranches;
~, (d) That principles of good forest management will best be served by the proposed
removal;
(e) That a reasonable and practical development of the property on which the trees are

(t) That the character of the immediate neighborhood in respect to forestation will not be
materially affected by the proposed removal;
(g) That the topography of the building sfte renders removal reasonably necessary;
(h) That regard for the safety of persons or property requires the removal; and
(i) Further, subject to the following condftions:
1. That twenty eight (28) minimum 24" box palm trees and thirty one (31) minimum
fifteen (15) gallon Eucalyptus trees shall be planted as specified on Exhibit No. 1
of this file and shall be maintained and nurtured to maturity.
2. That the owner of subject property shall submft a letter requesting termination of
Conditional Use Permft No. 3221 (to permit a veterinary clinic), Conditional Use
Permft tJo. 2395 (to permft on-premises sale and consumption of beer and wine
wthin a proposed restaurant), Conditional Use Permit No. 2348 (to permit on-
premises sale and consumption of beer and wine) and Conditional Use Permit
No. 1757 (to permft on-premises sale and consumption of beer and wine) to the
Zoning Division.
3. That any tree planted on-site shall be replaced in a t(mely manner in the event
that ft is removed, damaged, diseased and/or dead.
4. That Condition No. 2, above-mentioned, shall be completed within a period of
thirty (30) days from the date of this approval.
5. That wthin thirty (30) days of removal of the specimen trees, Condition No. 1,
above-mentioned, shall be complied with.
6. That approval of this application constitutes approval of the proposed request
only to the extent that ft complies with the Anaheim Municipal Zoning Code and

PETITIONER'S COMMENTS:
Alex Perez, 470 S. Anaheim Hills Road, Anaheim, stated B^Ila Cuci~~a Italian restaurant is a family run
business. They now have art opportun'dy to take the corner unit, next to their 2 units they now occupy,
with it they would like to add a full lounge to be able to serve alcoholic beverages (they currently serve
beer and wine). Mr. Perez also stated in the front and part of the sloe of t ee8 of the staff repo )which
add a large patio. He stated there is a problem with condition no. 20 (pag
states the patio area to close at 10:00 p.m.due to the noise level. He does not foresee that there will be
a problem with noise. Mr. Perez stated the nearest resident to the property is more than 400 feet away
and feels th2t is sufficient distance. He concluded by stating they are open to suggestions such as the
possibly of enclosing the patio to be able to serve after 10:00 p.m..
Commissioner Mayer how late he would be requesting to change that?
Mr. Perez responded he planned to be open during the week until 12:00 Mkiniyht, Friday and Saturday
until 1:00 or 2:00 a.m.
Commissioner Bostwick askad what the patio area was going to be enclosed with?
Alex Perez responded they had planned on a 3-foot stucco wail with rod iron alt the way a~o~nd,
however but due to the noise level issue, they are open to suggestions.

COMMISSIONER'S COMMENTS:
Alex Perez responding to Commissioner Peraza regarding condition no. 10 (page ~ stated the ABC
investigator informed him that in order for the liquor license to be issued they would need to be open for
lunch. They will probably c-pen for lunch, brunch and on Saturdays afternoons for wedding receptions.
Bruce Freeman, Code Enforcement, stated to his knowledge ABC requires that all noise and sounds be
restricted to the property Ilne, therefore, Mr. Perez does not have the 400 foot barrier that he indicated,
from the nearest resident. All the noise must be contained on the property. As for condition no. 10, ff
ABC requires lunch then he would have to fellow those guidelines as well.
Commissioner Henninger suggested condtion no. 20 remain as is at this time. He indicated he would
not want to see that patio become a bar area.
Commissioner Boswick suggested petitioner might consider possibly using glass panels rather than rod
iron as another sound attenuating material.
Mr. Perez suggested the possibility of expanding the comer unit which has 7 feet of cdumn space.
They might expand that wall to the edge of the columns, that would give them a larger bar area.
Bruce Freeman stated they have had a lot of problems with restaurant that stay open after 10:00 p.m.
and deal primarily in alcohol. Mr. Freeman stated he felt the 10:00 p.m. issue should stay as well only
because the restaurant is in a valley. There are residences on both skies of the street, above it the
sound does cam dramatically in the Anaheim Hills area once traffic dies down.
There was further discuss with the noise and ampiffied music.
Cheryl Flores stated for clarffication there are currently 2 signs, one facing westerly and one facing
southerly. This proposal is for a total of 2 signs and not 3 according to what was submitted.
Bruce Freeman responded to Commissioner Mayer by stated that there have been no complaints with
this property or restaurant in the past.

PETITIONER'S COMMENTS:
Carver Chiu, representative of Pacific Bell Mobile Services, he has been before Planning Commission
previously seeking approval of wireless antenna facilities as a part of Pacific Bell's new wireless network
for the provision of Personal Communications Services (PCS). For the past 1 ~ years they been working
to get their new wireless network in place and are now very close to having this in place. The subject of
discussion is the last of their sites in the City of Anaheim. They are proposing to install a 60-foot
telecommunication monopole antenna (which they refer to as a cylinder cell antenna). They have been
approached by the Anaheim Redevelopment Agency about the possibility of adding signage to it. They
are receptive in working with the City. Mr. Chiu stated they have developed some renderings/concept
designs which they have shared with the City. They had a revised concept drawing based on some
feedback received from Redevelopment.
COMMISSIONER'S COMMENTS:
Commissioner Henninger asked if this sign would be constructed as a part of a visual mitigation effort'?

Carver Chiu responded initially, their thinking was that the cylinder by design is intended to make the
Impact of these fac(Ifties and they had proposed the lighting, but they were approached by
Redevelopment about the feasibility of adding signage (without cost to the City) in terms of improving
- the Redevelopment efforts that are going to occur in that area.
Commissioner Mayer stated she had a concern with setting precedence for this ;°pe of signage. She
felt they should look at it more as an icon or monument marker entering the City.
There was further discussion regarding entry icon/monument marker vs. signage.
Carver Chiu pointed out that on the staff report there was a request for a waiver setback. They are
trying to get revised plans to the City but were not able to get them Into staff in time to get them in
Commissioner's packets but will be able to keep the facility setback required 5 feet, so they do ~t need
the waiver r~s part of their approval. There was a recommendation for denial on that and he wanted to
set the record straight.
There was discussion of the Caitrans realignment to Manchester.

Denied Waiver of Code Requirement on the basis that it was withdrawn by the applicant
at the public hearing and that the required setback will be provided.
