The proponents for conditional use permit, variance, administrative use permit, administrative
adjustment and tentative parcel map applications which are not contested will have 5 minutes to
present their evidence. In contested applications, the proponent(s) and opponent(s) will each have
10 minutes to present their case unless additional time is requested and the complexity of the
matter warrants. After the opponent(s) speak, the proponent will have 5 minutes for rebuttal.
Before speaking, please give your name and address and spell your name.
Staff Reports are paR of the evidence received by the Zoning Administrator at each hearing.
Copies are available to the pubiic prior to and during the meeting.

tentative parcel maps or special circumstance waivers is final unless, within 10 days of the Zoning

An appeal shail be made in written form to the City Glerk, accompanied by an appeal fee in the

A RESOLUTION OF THE ANAHEIM ZONING ADMINISTRATOR
APPROVING A CATEGORICAL EXEMPTION, CLASS 5 AND
APPROVING VARIANCE NO. 2008-04750

WHEREAS, the Anaheim Zoning Administrator did receive a verified Petition for
Variance for waiver of minimtun pazking lot landscaping for certain real property situated in the
City of Anaheim, CounTy of Orange, State of California, shown on Exhibit A, attached hereto
and incorporated herein by this reference.
WHEREAS, the applicant requests approval of a variance to construct a 17,878
square foot office building with less parking lot landscaping than required by code; and
WHEREAS, the Zoning Administrator did hold a public heazing at the Civic
Center in the City of Anaheim on April 10, 2008, at 9:30 a.m., notice of said public heazing
having been duly given as required by law and in accordance with the provisions of the Anaheim
Municipal Code, Chapter l 8,60, to heaz and consider evidence for and against said proposed
vaziance and to investigate and make findings and recommendations in connection therewith;
and
WHEREAS, said Zoning Administrator, after due inspection, invesfigation and
study made by itself and in its behalf, and after due consideration of all evidence and reports
offered at said heazing, does find and determine the following facts;
1. That the petitioner requests waiver of the following to construct a 17,878 square
foot single-story office building to be used by the Social Security Administration:

2. That there are exceptional circumstances relating to waiver (a) that do not apply
generally to other properties or uses in the same viciniTy and zone in that the proposed office
building is required to comply with Federal standards which require a'20 foot buffer zone
surrounding the entire building for security purposes which limits the ability of the site to be
developed with a strict adherence to Code requirements for the minimum pazking lot landscape
requirements while at the same time maintaining the minimum number of required pazking
spaces.

3. That, because of the exceptional circumstances identified in the above paragraph ,_ ,,_
regarding waiver (a), the strict application of the zoning code would deprive the property of
privileges enjoyed by other property under identical zoning classifications in the vicinity. ,
4. That waiver (b) is hereby withdrawn, as requested by the applicant, subsequent to
advertisement of the variance.
5. That *** indicated their presence at said public hearing in opposition; and that no
correspondence was received in opposition to subject petition.
WHEREAS, the proposed project falls within the definition of Categorical
Exemptions, Section 15301, Class 5(Minor Alterations in Land Use Limitations), as defined in
the State CEQA Guidelines and is, therefore, exempt from the requirement to prepaze additional
environmental documentation.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Zoning Administrator
does hereby approve Variance No. 2008-04750, upon the following conditions which aze hereby
found to be a necessary prerequisite to the proposed use of the subject property in order to
preserve the safety and general welfaze o~the Citizens of the City of Anaheim:

be used to determine the adequacy of the existing water
system to provide the estimated water demands. Any off-
site water system improvements required to serve the project
shall be done in accordance with Rule No. 15A.6 of the
Water UtiliTy Rates, Rules, and Regulations.
8 That plans submitted for building permits shall indicate that Fire

meeting of April 10, 2008. Said resolution is subject to the appeal provisions set forth in Chapter
18.60 "Procedures" of the Anaheim Municipal Code pertaining to appeal procedures and may be

Project Descriotion:
17,878 square foot Federal Office Building at 900 South Harbor Bivd. with code required parking of 72 planned
parking spa~es.
Request.
To partially waive the parking lot landscape requirements. To provide one landscape finger in lieu of three required
landscape fingers. AI~ other landscape requirements are met. This would allow the code required minimum parking
of 7Z cars.
Justification:
Security requirements for Federal Office Buildings require a 20' landscaped 6uffer zone between the building and
any property lines, parking areas and driveways. If this requirement were not imposed a larger building with more
parking wouid be possible on this site.
The code required streetsetbacks would yield approximately 4,875 square feet of setback. Our request would yield
approximately 7,484 square feet of satback. Our request would provide an increase of 47°/a over the code
requirement or 2,609 additional square feet of landscaping.
In consideration of this request, we would provide substantia{ly enhanced landscaping within the street setbacks.
We would provide additional trees and shrubs to provide a pleasant layered effect. Additionaliy, we would provide
additional ttees and shrubs aiong the east property line and vine pockets along the southern pmperty line. Where
code would require 11 trees in the street setbacks, we would provide 22 trees.
Where code would not require any trees in the eastem setback, we are providing 13 trees.
