ZA?008-*** A RESOLUTION OF THE ANAHEIM ZONING ADMINISTRATOR APPROVING A CEQA CATEGORICAL EXEMPTION, CLASS 1 AND APPROVING MISCELLANEOUS PERMIT NO. 2008-00240 (511 WEST CHAPMAN AVENUE) WHEREAS, the Anaheim Zoning Administrator did receive an application for Miscellaneous Permit No. 2008-00240 for certain real property situated in the City of Anaheim, County of Orange, State of Califomia, as more particularly described in Exhibit "A" attached hereto and incorporated by this reference. WHEREAS, the Zoning Administrator did hold a public hearing at the Civic Center in the City of Anaheim on April 24, 2008 at 930 a:m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of ihe Anaheim Municipal Code, Chapter 18.60 "Procedures", to hear and consider evidence for and against said proposed vaziance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Zoning Administzator, afrer due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed modification of an existing nonconforming use (convenience store/mini-market) entails replacing an existing Type 201iquor license (off-sale of beer and wine) with a Type 21 liquor license (off-sale of beer, wine and distilled spirits). 2. That Conditionai Use Permit No. 3005 to permit a convenience market in an existing commercial retail center with waiver of minimum number of pazking spaces was approved by the Planning Commission on August 29, 1988. The existing Type 20 ABC license was issued based upon approval of this CUP. Resolution. No. PC88-240, approved in conjunction with CUP No. 3005 does not specify or limit the type of alcohol sales associated with the convenience store; therefore, the proposed request is consistent with the prior approval. 3. That on Februazy 11, 1991 Commission approved the expansion of the convenience market to 1,772 square feet and amended a condition of approval pertaining to revised exhibits to reflect the expansion. On July 8, 1996, the Commission further amended the conditions of approval to allow take-out food service. 4. That because the applicant proposes to replace the existing liquor license, there will be no net increase in the number of licenses in the applicable Census Tract. Existing ABC conditions for the sale of tiquor under the existing license will be carried over to the replacement license. 5. That the sale of liquor will continue to be an ancillary component of the business and the primary focus of the operations will be on maintaining a convenience store where residents and tourists alike will be able to purchase everyday necessities such as perishable goods, general household products, packaged food products, and hot and cold beverages. Chapman Anaheim, CA 92802 The Polfce Department has recefved an I.D.G. FZOUte Sheet for MI5 File 2008-00240. The applicant is requesting to upgrade an existing type ZO beer and wine alcoholic beverage and control license to a type 21 general alwholic beverage and control license. The Police Department does not oppose this request. We request that the following conditions are placed on the MIS: 1) There shall be no e~erior advertising or sign of any kind or type, including adve~tising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. We aze applying for a fence height and pool location variance on the firont side of our home for two reasons. 1) The unusual shape of ottt lot dictated that our home face this direction. As well, The City of Anaheim told us it must face this direction with the ingress/egress on Martin Rd. That leaves us with the oniy large enough secrion of land to I~ave a yard and pool is on the Soukh/West section of the lot, this is the front/side comer of the properiy. 2) Security. We back up against Santa Ana Canyon Rd., which makes our home iughly visible. Already we have been vandalized twice, once we were tagged with spray paint and the second time someone cut our electric wires to the home forcing a repair. Three times in the middle of the night we have had people looking for the Ely House, which is neact door, pazk in o~ driveway come to our front door banging on it and yelling out names. Once when no one answered the door the person proceeded to empTy }us car out of all of its hash and leave it on o~ driveway. We have nothing against the Ely House, but our safety should not be sacrificed for it For these two reasons we are asldng the City to issue us a variance on our fence height. There are many, many homes in our area with similar fence heights. We have attached pictures and addresses of just nine homes within a three block area. There are msny, more within three bLocks. This is just a sample. On the attached plans is a picture of the proposed fence and gate. It is fhe same as all the __ _ neightiors: Block lower section wrapped in storie finisli'with iod iron inserts approximately 6' wide each and a md 'uron gate.
