A RESOLUTION OF THE ANAHEIM ZONING ADMINISTRATOR
APPROVING A CEQA CATEGORICAL EXEMPTION, CLASS 1
AND APPROVING MISCELLANEOUS PERMIT NO. 2008-00240
(511 WEST CHAPMAN AVENUE)
WHEREAS, the Anaheim Zoning Administrator did receive an application for
Miscellaneous Permit No. 2008-00240 for certain real property situated in the City of Anaheim,
County of Orange, State of Califomia, as more particularly described in Exhibit "A" attached hereto
and incorporated by this reference.
WHEREAS, the Zoning Administrator did hold a public hearing at the Civic Center in
the City of Anaheim on April 24, 2008 at 930 a:m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of ihe Anaheim Municipal Code,
Chapter 18.60 "Procedures", to hear and consider evidence for and against said proposed vaziance
and to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Zoning Administzator, afrer due inspection, investigation and study
made by itself and in its behalf, and after due consideration of all evidence and reports offered at
said hearing, does find and determine the following facts:
1. That the proposed modification of an existing nonconforming use (convenience
store/mini-market) entails replacing an existing Type 201iquor license (off-sale of beer and wine)
with a Type 21 liquor license (off-sale of beer, wine and distilled spirits).
2. That Conditionai Use Permit No. 3005 to permit a convenience market in an existing
commercial retail center with waiver of minimum number of pazking spaces was approved by the
Planning Commission on August 29, 1988. The existing Type 20 ABC license was issued based
upon approval of this CUP. Resolution. No. PC88-240, approved in conjunction with CUP No.
3005 does not specify or limit the type of alcohol sales associated with the convenience store;
therefore, the proposed request is consistent with the prior approval.
3. That on Februazy 11, 1991 Commission approved the expansion of the convenience
market to 1,772 square feet and amended a condition of approval pertaining to revised exhibits to
reflect the expansion. On July 8, 1996, the Commission further amended the conditions of approval
to allow take-out food service.
4. That because the applicant proposes to replace the existing liquor license, there will be
no net increase in the number of licenses in the applicable Census Tract. Existing ABC conditions
for the sale of tiquor under the existing license will be carried over to the replacement license.
5. That the sale of liquor will continue to be an ancillary component of the business and
the primary focus of the operations will be on maintaining a convenience store where residents and
tourists alike will be able to purchase everyday necessities such as perishable goods, general
household products, packaged food products, and hot and cold beverages.

6. That the Anaheim Police Department does not oppose the proposed use and
recommends conditions of approval that aze included below.
That the proposed use modification is deemed similaz in nature, but lesser or equal in

CALIFORNIA ENVIRONMENTAL OUALITY ACT FINDING: The Anaheim
Zoning Administrator has reviewed the proposal and does hereby fmd that the project is
categorically exempt from CEQA, Class 1, and that no additional environmental documentation is
required.
NOW, THEREFORE, BE IT RESOLVED that the Anaheun Zoning Administrator
does hereby approve Miscellaneous Permit 200~-00240, upon the following conditions which aze
hereby found to be a necessary prerequisite to the proposed use of the subject property in order to
preserve the safety and general welfaze of the Citizens of the City of Anaheun:

residences.

applicant.
11 That the gross sales of alcoholic beverages shall not exceed 35 Police/Code
percent of all retail sales during any three (3) month period. The Enforcement
applicant shall maintain records on a quarterly basis indicating
the sepazate amounts of sales of alcoholic beverages and other
items. These records shall be made available for inspection by
any City of Anaheim official when requested.

compliance with each and all of the conditions hereinabove set forth. Should any such condition, or
any part thereof, be declared invalid or unenforceable by the final judgment of any court of

competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed
null and void.
BE IT FURTHER RESOLVED that the applicant is responsible for paying all
chazges related to the processing of this discretionary case application within 15 days of the
issuance of the final invoice or prior to the issuance of building permits for this project, whichever
occurs first. Failure to pay all chazges shall result in delays in the issuance of required permits or
the revocation of the approval of this application.
THE FOREGOING RESOLUTION was adopted at the Zoning Administrator meeting of
April 24, 2008. Said resolution is subject to the appeal provisions set foRh in Chapter 18.60
"Procedures" of the Anaheim Municipal Code pertaining to appeal procedures and may be replaced by

The Polfce Department has recefved an I.D.G. FZOUte Sheet for MI5 File
2008-00240. The applicant is requesting to upgrade an existing type ZO
beer and wine alcoholic beverage and control license to a type 21
general alwholic beverage and control license.
The Police Department does not oppose this request. We request that
the following conditions are placed on the MIS:
1) There shall be no e~erior advertising or sign of any kind or type,
including adve~tising directed to the exterior from within, promoting
or indicating the availability of alcoholic beverages. Interior
displays of alcoholic beverages or signs which are ciearly visible
to the exterior shall constitute a violation of this condition.
2) No display of alcoholic beverages shall be located outside of a
building or within five (5) feet of a~y public entrance to the
building. -
3) The area of alcoholic beverage dispiays shali not exceed 25% of
the total display area in a building.
4) Sale of alcoholic beverages shall be made to customers only
when the customer is in the building.
5) No person under 21 years of age shall sefl or be permitted to seli
alcohol without someone 21 years of age or older present.
6) Beer and malt beverages shall not be sold in packages
containing less than a six (6) pack, and ~n7ine coolers shail not
be sold in packages containing less than a four (4) pack.

7) The possession of alcoholic beverages in open containers and the
consumption of alcoholic beverages are prohibited on or around
these premises.
8) The parking lot of the premises shall be equipped with lighting of
su~cient power to illuminate and make easily discernible the
appearance and conduct of ail persons on or about the parking lot.
Additionally, the position of such lighting shall not disturb the
nortnal privacy and use of any neighboring residences.
9) There shall be no amusement machines, video game devices, or
pool tables maintained upon the premises at any time.
10) There shall be no public telephones on the property that are
located outside the building and within the control of the applicant.
11) The gross sales of alcoholic beverages shall not exceed 35
percent of all retail sales during any three (3) month period. The
applicant shall maintain records on a quarterly basis indicating the
separate amounts of sales of alcoholic beverages and other items.
These records shall be made available for inspection by a~y City
of Anaheim official when requested.

A RESOLUTION OF THE ANAIIEIM ZONING ADMINISTRATOR
APPROVING A CEQA CATEGORICAL EXEMPTION CLASS 11
AND FURTHER APPROVING VARIANCE NO. 2007-04744
(1020 NORTH EUCLID STREET)
WHEREAS, the Anaheim Zoning Administrator did receive a verified Petition for
Variance for certain real property situated in the City of Anaheun, County of Orange, State of
California shown on Exhibit A, attached hereto an incorporated herein by this reference; and
WHEREAS, the petitioner requests a waiver of maximum letter height and
maximum number of wall signs to construct wall-mounted channel letter signs for a proposed retail
store; and
WFIEREAS, the Zoning Administrator did hold a public hearing at the Civic Center in the City of
Anaheim on April 24, 2008, at 9:30 a.m., notice of said public hearing having been duly given as
required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.60 "Procedures", to heaz and consider evidence for and against said proposed variance and to
investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Zoning Administr~ator, after due inspection, investigation and study
made by itself and in its behalf, and after due consideration of all evidence and reports offered at
said hearing, does find and determine the following facts:
1. That the applicant requests waivers of the following to construct wall-mounted
channel letter signs for a proposed retail store:

correspondence was received in opposition to subject petition.

WI-IEREAS, the proposed project falls within the defuvtion of Categorical
Exemptions, Section 15311, Class 11 (Accessory Structures), as defined in the State CEQA
Guidelines and is, therefore, exempt from the requirement to prepaze additional environmental
documentation.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Zoning Administrator
does hereby approve Vaziance No. 2007-04744 to permit wall signs having a greater letter height
than allowed by code, upon the following conditions which aze hereby found to be a necessary
prerequisite to the pzoposed use of the subject property in order to preserve the safety and general
welfaze of the Citizens of the City of Anaheim:

3 That timing for compliance with conditions of approval Planning
may be amended by the Planning Duector upon a showing
of good cause provided (i) equivalent timing is established
that satisfies the original intent and purpose of the
condition(s), (ii) the modification complies with the
Anaheim Municipal Code and (iii) the applicant has
demonstrated significant progress toward establishment of
the use or approved development.
4 That subject property shall be developed substantially in Planning
accordance with sign plans and specifications submitted to
the City of Anaheun by the applicant and which plans aze

through 3, and as conditioned herein.

competent jurisdiction, then this Resolutipn, and any approvals herein contained, shall be deemed
null and void.
BE IT FURTHER RESOLVED that the applicant is responsible for paying all
chazges related to the processing of this discretionary case application within 15 days of the
issuance of the final invoice or prior to the issuance of building pemuts for this project, whichever
occurs first. Failure to pay all chazges shall result in delays in the issuance of required pemuts or
the revocation of the approval of this application.
THE FOREGOING RESOLUTION was adopted at the Zoning Administrator
meeting of Apri124, 2008. Said resolution is subject to the appeal provisions set forth in Chapter

shape, topography, location and surroundings aze:
- The location of the building is towazd the back of the lot which makes
viewing the huilding difficult due to the small building at the front north
eastern comer.
- The location of the building is not viewable from a major highway as many of
Deazden's competition in the azea are. One notable example is Wal-Mart in
the "Anaheim Plaza" just off the 5 freeway. (Others shown in the attached
"Analysis of Competition").
- The current building is the only lazge space in tl~e shopping center and
therefore does not have the assistance of other lazge chains to draw customers.
In fact this building will gready increase the traffic to the shopping center.
- The locadon of this building is in close proximity to much of its competition
wluch will cause a substantial depletion in the tenant's market shaze due to the
competitors enjoying moze and lazger signage than that required by the current
code section 18.44.110 subsections .0102, .0103.
- The attached document "Analysis of Competition" illustrates several of
Deazden's competition who currently have a competidve advantage due to
more and lazger signage than allowable by code section 18.44.110
subsections.0102,.0103.

signage permit under an earlier version of the code. Ultimately the other
properties have signage that exceeds the limitations set forth in code sec[ion
18.44.110 subsections .0102, .0103 which is depriving our property of
compazable signage.

Re: Fence variance for 111 Martin Rd., Anaheim, Ca 92~08
Dear Zoning Dept.,
We l~ave recenfly finished buiiding our home and haue moved im aad are ready to start the
landscaping and finish the fencing.
We aze applying for a fence height and pool location variance on the firont side of our
home for two reasons.
1) The unusual shape of ottt lot dictated that our home face this direction. As well, The
City of Anaheim told us it must face this direction with the ingress/egress on Martin Rd.
That leaves us with the oniy large enough secrion of land to I~ave a yard and pool is on the
Soukh/West section of the lot, this is the front/side comer of the properiy.
2) Security. We back up against Santa Ana Canyon Rd., which makes our home iughly
visible. Already we have been vandalized twice, once we were tagged with spray paint
and the second time someone cut our electric wires to the home forcing a repair. Three
times in the middle of the night we have had people looking for the Ely House, which is
neact door, pazk in o~ driveway come to our front door banging on it and yelling out
names. Once when no one answered the door the person proceeded to empTy }us car out
of all of its hash and leave it on o~ driveway. We have nothing against the Ely House,
but our safety should not be sacrificed for it
For these two reasons we are asldng the City to issue us a variance on our fence height.
There are many, many homes in our area with similar fence heights. We have attached
pictures and addresses of just nine homes within a three block area. There are msny,
more within three bLocks. This is just a sample.
On the attached plans is a picture of the proposed fence and gate. It is fhe same as all the

neightiors: Block lower section wrapped in storie finisli'with iod iron inserts
approximately 6' wide each and a md 'uron gate.
