ZA3008-*** A RESOLUTION OF THE ANAHEIM ZONING ADMINISTRATOR APPROVING A CEQA CATEGORICAL EXEMPTION CLASS 11 AND APPROVING SPECIAL CIRCUMSTANCES WAIVER NO. 2008-00038 (1515 EAST KATELLA AVENUE) WHEREAS, the Anaheim Zoning Adminis~ator did receive an application for Special Circumstances Waiver No. 2008-00038 to permit four metal banners for a period of five yeazs to advertise the rental of new apartment units for certain real property situated in the City of Anaheim, County of Orange, State of California shown on Exhibit "A", attached hereto and incorporated herein by this reference; and WHEREAS, the Zoning Administrator did hold a public heazing at the Civic Center in the City of Anaheim on September 4, 2008, at 9:30 a.m., notice of said public hearing having heen duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60 "Procedures", to heaz and consider evidence for and against said proposed tentative pazcel map and to investigate and make findings and recommendations in connection therewith; and WIIEREAS, said Zoning Administrator, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed four (4) temporazy metal banner signs, in conjunction with the existing freestanding sign, are appropriate to advertise a lazge aparhnent development in The Platinum Triangle. 2. That the design of the metal banner signs is attractive and compatible with the architecture of the apartment building. 3. That *** indicated their presence at the public hearing in opposition; and that *** correspondence was zeceived in opposition to the subject request. WHEREAS, the proposed project falls within the definition of Categorical Exemptions, Section 15311, Class 11 (Accessory Structures}, as defined in the State CEQA Guidelines and is, therefoze, exempt from the requirement to prepare additional environmental documentation. NOW, THEREFOI2E, BE IT RESOLVED that the Anaheim Zoning Administrator does hereby approve Special Circumstances Waiver No. 2008-00038 subject to the conditions of approval described in E~ibit "B" attached hereto acad incorporated by this reference which aze hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the heath, safety and general welfaze of the Citizens of the City of Anaheim: -1- ZA2008-*** BE IT FURTHER RESOLVED that the Anaheim Zoning Administrator does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth.
