RECOMMENDATION: Staff recommends the Zoning Administrator determine that
the previously-approved Class 1 Categorical Exemption serve as the appropriate
environmental documentation for this request and approve a two year extension of time
for Vaziance No. 2007-04735 to expire on September 27, 2010.
BACKGROiJNID: This property is currently developed with a vacant industriai
building in the SP94-1 (D.A. 2) (Northeast Area Specific Plan Development Area 2,
Expanded Industrial Area) zone. The General Plan designates this property and
properties to the south, east, and west for industrial land uses. Properties to the north aze
designated for water land uses.
Variance No. 2007-04735, to construct an additional 80,000 squaze feet of office space
within an existing wazehouse/distribution building with a higher floor azea ratio than
permitted by Code and fewer parking spaces than required by Code, was approved by
the Zoning Administrator on September 27, 2007. The pernut expired on September 27,
2008. On September 17, 2008, the applicant submitted a request for an extension of
tune. In accordance with the Zoning Code, a Vaziance may be extended provided that a
written request is submitted within six months of pernut expiration. The applicanYs
request was received within the required timeframe.

IDISCUSSION: Code permits up to two one-year time extensions to comply with conditions of
approval. The applicant has submitted a request for a two-yeaz time extension from September
27, 2008 to September 27, 2010. The project has been delayed due to the recent sale of the
property from Pacific Sunweaz Inc. to the Panattoni Development Company.
Code Enforcement Division staff conducted an inspection of the property on May 12, 2009, and
found no code violations on the property.
CONCLiJSION: Since approval of the permit, there have been no changes to the General Plan
and Zoning Code that would affect this project. Therefore, staff recommends approval of the
time extension to expire on September 27, 2010. ~

RECOIVIMENDA'A'ION: Staff recommends that the Zoning Administrator adopt the
attached resolution, detennining that a Class 1 Categorical Exemption is the appropriate
environmental documentation for this request and approving Variance No.2009-04775.
BACKGROUND: This property is developed with an industrial business complex
containing four buildings and is located in the SP94-1, DA 2(Northeast Area Specific
Plan, Expanded Industrial Area) zone. The General Plan designates this property and all
surrounding properties for industrial land uses.
PROPOSAI,: The applicant proposes to convert 4,044 squaze feet of office space to
classroom space within an existing 48,658 square foot industrial training facility. The
training center provides tecluucal classes and seminazs for construction trades, such as
plumbing and electrical programs. Classes occur primarily on weekday evenings, with
some classes on weekday mornings and occasionai weekends.
ANALYSIS: Code requires 643 pazking spaces for the four buildings that shaze parking
on this property, as further described in the Pazking Summary (Attachment 3). A
parking study was prepazed by the City's Traffic and Parking Consultant to determine if
there is adequate parking to support the proposed conversion of office azea to
classrooms. The pazking study determined that the 579 pazking spaces provided on site
would accommodate the peak pazking demand of 415 spaces for the existing industrial
business complex during evening hours when approximately 90% of the classes are
conducted. The pazking study indicates that the increase in the number of vehicle trips
associated with the training facility would occur well after the peak of the existing uses
within the industrial business complex.

The study also indicates that the daytime peak pazking demand of 490 spaces would result in a
surplus of 90 pazking spaces.

AND APPROVING VARIANCE NO. 2009-04775

WHEREAS, the Anaheim Zoning Administrator did receive a verified Petition for a
variance from parking requirements to convert existing office space to classroom space within an
existing industrial training facility for certain real property situated in the City of Anaheim, County
of Orange, State of California shown on Elchibit A, attached hereto and incor{~orated herein by this
reference; and
WIIEREAS, this property is currently developed with a four building industrial
complex within the SP94-l, DA 2(Northeast Area Specific Plan, Expanded Industrial Area) zone
and the Anaheim General Plan designates this properiy for Industrial land uses; and
WHEREAS, the Zoning Administrator did hold a public hearing at
the Civic Center in the City of Anaheim on May 28, 2009 at 9:30 a.m., notice of said public hearing
having been duly given as required by law and in accordance with the provisions of the Anaheim
Municipal Code, Ghapte.r 18.60 "Procedures", to hear and consider evidence for and against said
proposed variance and ~.o investigate and make findings and recommendations in connection
therewith, and
WHEREAS, said Zoning Administrator, after due inspection, investigation and study
made by itself and in its behalf, and after due consideration of all evidence and reports offered at
said hearing, does find and determine the following facts:
1. That the applicant requests a variance from the following Code Section to convert
existing office areas to classrooms for an industry-related training facility:
(a) SECTION NO. 18.42.040.010

(643 spaces required; 579 spaces
proposed)
2. That the above-mentioned variance, under the conditions imposed, will not cause
fewer off-street parking spaces to be provided for such use than the number of such spaces
necessary to accommodate all vehicles attributable to the proposal under the normal and reasonably
foreseeable operation of such use because the parking study determined that the 579 parking spaces
provided on site would accommodate the peak pazking demand of 415 spaces for the existing
industrial business complex during evening hours when approximately 90% of the classes aze
conducted.

3. That the parking variance, under the conditions imposed, will not increase the
demand and competition for parking spaces upon the public streets in the immediate vicinity, as
indicated in the submitted parking study. The study states that all customers and employees were
observed to park on-site and that the parking lot is adequate to accommodate the maacimum parking
demand for this site.
4. That the variance will not increase the demand and competition for parking spaces
upon adjacent properties in the immediate vicinity of the proposed use since all pazking is contained
on-site within the property boundaries.
5. That ffie variance will not increase traffic congestion within the off-street parking
areas provided for the proposed use as the building locarions and vehicular parking azeas and
circulation will not be impacted by this request and there are no new points of ingress and egress
proposed in conjunction with this request.
WHEREAS, the proposed project falls within the deFinition of Categorical
Exemptions, Section 15301, Class 1(Existing Facilities), as defined in the State CEQA Guidelines
and is, therefore, exempt from the requirement to prepare additional environmental documentation.
NOW, T'HEREFORE, BE IT RESOLVED that the Anaheim Zoning Administrator
does hereby approve V~ r;ance No.2009-04775.
B~ IT FURTHER RESOLVED that granting of the parking variance is contingent
upon operation of the use in conformance with the assumptions and/or conclusions relating to the
operation and intensity of use as contained in the parking demand study that formed the basis for
approval of said variance. Exceeding, violating, intensifying or otherwise deviating from any of said

of the expressed conditions imposed upon said variance which shall subject this variance to ternunation
or modification pursuant to the provisions of Chapter 18.60 Procedures of the Anaheim Municipal

BE IT FURTHER RESOLVED that the approval of this application constitutes
approval of the proposed request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City, State and Federal regulations. Approval does not
include any action or findings as to compliance or approval of the request regarding any other
applicable ordinance, regulation or requirement.
BE IT FURTI~R RESOLVED that the applicant is responsible for paying all
charges related to the processing of this discretionary case application within 15 days of the
issuance of the final invoice or prior to the issuance of building permits for this project, whichever
occurs first. Failure to pay all charges shall result in delays in the issuance of required permits or

ABC Southern Califomia is a not for profit business association representing the commeraal/
industrial construction industry. We have been in business since 1974. We are located at l400
N. Kellogg Drive, Suites A and B in Anaheim. We provide business support services to our
contractor merr~ers through education and training of state and federally registered plumbing
and eledrical apprentices. We afso provide electrical craft training, industry safety and
joumeymen upgredes for our member employees.
Our administrative offices are located in Suite A and our training classroom instruction is
conducted in our classrooms in Suite B. A number of classes are held in the evening between
5:00 pm to 10:00 pm. One electrical class is held during the day from 6:00 am to 1:30 pm.
Continuing education and management seminars are held during the week for four to eight
hours and occasionally on Saturdays for four to eight hours.
