ANALYSIS: The fence would have a varying setback from 1 to 14 feet along Lincoln Avenue and 2 to 4 feet along Chartres Street and Clementine Street. The varying setback along Lincoln Avenue is due to a unique right-of-way alignment that provides for a meandering sidewalk with tree wells. The fence would enclose an existing pazking lot with 29 pazking spaces. The applicant indicates that the security fence is necessary due to the telecommunications equipment and cables that may be stored in company and employee vehicles using the pazking azea. Code permits a variance for the maximum height of fences within required front or street side structural setback azeas where the property is adjacent to a residential zone by an administrative adjustment. If no written opposition regazding the administrative adjustment is received during the required 10-day notification period which ends on August 15, 2009 at 5:00 p.m., the Zoning Administrator may grant this administrative adjustrnent. This request was originally processed as Administrative Adjushnent No. 2008-00331. A letter of objection was received during the required ten-day notification period and therefore, a public hearing was scheduled. This item was continued from the April 30, 2009, May 28, 2009, June 25, 2009, and July 23, 2009 Zoning Administrator hearings in order to provide the applicant time to further research altemative designs for the fence on the Katella Avenue street frontage. PROPOSAL: The applicant proposes to retain an eight to nine foot high wrought iron fence located within the required setbacks along Katella Avenue and Nutwood Street. The fence is setback 10 feet from Katella Avenue and is attached to an existing roof overhang. The fence is located on the property line adjacent to Nutwood Street. The fence was installed without Building or Planning Division approvals. The building was designed with its front doors, windows, and pedestrian access oriented towazd Katella Avenue. The fence obstructs pedestrian access from Katella and creates a physical and visual barrier to the building that is inconsistent with the design of the building and the development standazds of the C-G zone which limits the maximum height of fences, walls, and hedges to 3 feet within front or street setback azeas. A fence could be constructed to secure the pazking lot in the reaz of the property that could comply with development standazds; therefore, staff did not find justification for the approval of a vaziance. Staff prepared recommended conditions of approval in the event that the Zoning Administrator approves the applicanYs request. CONCLUSION: Staff believes there aze no physical hazdships or special circumstances applicable to this property that would justify the approval of this request.
