Meehan.
REOUEST: The applicant proposes to construct an addition to an existing single family
residence with a side yard setback less than required by Code.
DISCUSSION: The applicant proposes to construct a 1,189 squaze foot addition to an
existing 3,739 square foot, 2-story single family residence. The room addition would be
located 7.5 to 9.5 feet from the side property line, where a 6-foot setback to the first
floor and a 9-foot setback to the second floor is required by Code.
T'he applicant applied for an Administrative Adjustment to permit the side yard setback
deviation. Staff mailed notices to neighbors for the Administrative Adjustment;
however, upon further review staff determined that an Administrative Adjusiment would
not be required because Code permits a 20 percent decrease in the side yazd setback
through the Minor Modification process. Therefore, staff recommends that this item be
withdrawn from the agenda.
RECOMMENDATION: Staff recommends that the Zoning Administrator withdraw
this item because the project can be administratively approved through the Minor
Modification process and the Administrative Adjustment is not required.

REOUEST: The applicant proposes to construct a 7 foot high fence within the street
setback azea where a maximum 3 foot high fence is permitted by Code.
BACKGROUIVD: This property is developed with a telecommunications switching
facility and is zoned C-G (General Commercial). The adjacent properiy to the north is
zoned RM-3 (Residential, Multi-Family). The General Plan designates this property and
properties to the east, west and south for mixed use land uses. Pearson Pazk is located
north of the property across Cypress Street.
PROPOSAL: The applicant proposes to construct a 7-foot high wrought iron security
fence to enclose an employee pazking lot.
ANALYSIS: The fence would have a varying setback from 1 to 14 feet along Lincoln
Avenue and 2 to 4 feet along Chartres Street and Clementine Street. The varying
setback along Lincoln Avenue is due to a unique right-of-way alignment that provides
for a meandering sidewalk with tree wells. The fence would enclose an existing pazking
lot with 29 pazking spaces. The applicant indicates that the security fence is necessary
due to the telecommunications equipment and cables that may be stored in company and
employee vehicles using the pazking azea.
Code permits a variance for the maximum height of fences within required front or street
side structural setback azeas where the property is adjacent to a residential zone by an
administrative adjustment. If no written opposition regazding the administrative
adjustment is received during the required 10-day notification period which ends on
August 15, 2009 at 5:00 p.m., the Zoning Administrator may grant this administrative
adjustrnent. If written opposition is received duriug the 10-day notification period, the
applicant can withdraw the request or request that a public hearing be scheduled.

WI-IEREAS, the Anaheim City Zoning Administrator did receive a verified Petition
for Adminish~ative Adjustment for certain real properiy situated in the City of Anaheim, County of
Orange, State of California shown on E~chibit A, attached hereto and incorporated herein by this
reference; and
WHEREAS, the petitioner proposes to conshuct a 7 foot high fence within the street
setback area where a maximum 3 foot high fence is permitted by Code; and
WI-IEREAS, the Anaheim Ciry Zoning Administrator did hold a public hearing at the
Civic Center in the City of Anaheim on August 20, 2009 at 930 a.m., notice of said public heazing
having been duly given as required by law and in accordance with the provisions of the Anaheim
Municipal Code, Chapter 18.60 "Procedures", to heaz and consider evidence for and against said
proposed variance and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Zoning Administrator, after due inspection, investigation and study
made by itself and in its behalf, and after due consideration of all evidence and reports offered at
said hearing, does find and determine the following facts:
1. That the applicant requests an administrative adjustment from the following in order
to construct an a 7 foot high wrought iron fence:

18.62.040.020.0203 of the Anaheim Municipal Code which allows a deviation from the maximum
height requirements for fences, walls, hedges and berms in any required structural setback or yazd in
any non-residential zone that is adjacent to a residential zone to be considered as an administrative
adjustment.
4. That no written opposition was received during the required 10-day notification
period which ended on August 15, 2009.

WHEREAS, the proposed project falls within the definition of Categorical
Exemptions, Section 15301, Class 1(Existing Facilities), as defined in the State CEQA Guidelines
and is, therefore, exempt from the requirement to prepare additional environmental documentation.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Zoning
Administrator does hereby grant subject petition for Administrative Adjustment.
BE IT FURTHER RESOLVED that the approval of this application constitutes
approval of the proposed request only to the extent that it complies with the Anaheim Municipal
Zoning Code and any other applicable City, State and Federal regulations. Approval does not
include any action or findings as to compliance or approval of the request regazding any other
applicable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED tttat the applicant is responsible for paying all
chazges related to the processing of this discretionazy case application within 15 days of the
issuance of the final invoice or prior to the issuance of building permits for this project, whichever

foot 6 inches to +/- 14 feet, 0 inches, along this frontage. Fences up to three feet are
permitted within setback areas. The proposed fence would be seven (7) feet in height.
Therefore, the Applicant is requesting relief from this Code Section, via this
Administrative Adjustment application, to allow placement of a fence higher than three
feet. No other improvements are proposed as part of this application.
Various communication lines/cables are typicaliy routed and directed through
telecommunication switching buildings (such as is housed onsite), including land and
wireless telephone lines, entertainment (television), and internet services. Fenced
parking is appropriate and necessary at this location, to provide security for both
company and employee vehicles that utilize this parking area.

REOHJEST: The applicant is requesting a variance to retain an eight to nine-foot high
wrought iron fence that exceeds the maximum permitted fence height for an existing
commercial building currently operated as an alternative educational facility by the
Orange County Board of Education.
This request was originally processed as Administrative Adjushnent No. 2008-00331. A
letter of objection was received during the required ten-day notification period and
therefore, a public hearing was scheduled.
This item was continued from the April 30, 2009, May 28, 2009, June 25, 2009, and July
23, 2009 Zoning Administrator hearings in order to provide the applicant time to further
research altemative designs for the fence on the Katella Avenue street frontage.
RECOMMENDATION: Staff recommends that the Zoning Adminisirator adopt the
attached resolution determining that a Class 1 Categorical Exempdon is the appropriate
environmental documentation for this request and denying Variance No. 2009-04782.
PROPOSAL: The applicant proposes to retain an eight to nine foot high wrought iron
fence located within the required setbacks along Katella Avenue and Nutwood Street.
The fence is setback 10 feet from Katella Avenue and is attached to an existing roof

indicated that the fence was installed to deter vandalism and provide a secure site for the
school staff, students, parents and visitors.

The applicant has not submitted any revised plans for the fence. The applicant has
submitted a rendering of the building showing landscaping partially screening the
existing fence.
AiVALYSIS: Code permits a maximum 3-foot high fence within the front 15 feet along
Katella Avenue and within 10 feet along Nutwood Street. Staff has reviewed the size,
shape, and topography of this property and did not find any physical hazdships or special
circumstances applicable to this property which would justify the approval of the
proposed variance. In addition, the fence is not consistent with the commercial design
and orientation of the building. The building was designed with its front doors,
windows, and pedestrian access oriented towazd Katella Avenue. The fence obstructs
pedestrian access from Katella and creates a physical and visual barrier to the building
that is inconsistent with the design of the building and the development standazds of the
C-G zone which limits the maximum height of fences, walls, and hedges to 3 feet within
front or street setback azeas.
A fence could be constructed to secure the pazking lot in the reaz of the property that
could comply with development standazds; therefore, staff did not find justification for
the approval of a vaziance.
Staff prepared recommended conditions of approval in the event that the Zoning
Administrator approves the applicanYs request.
CONCLUSION: Staff believes there aze no physical hazdships or special
circumstances applicable to this property that would justify the approval of this request.
Therefore, staff recommends denial of the variance.

AND DENYING VARIANCE NO. 2009-04782

WI-IEREAS, the Anaheim Zoning Administrator did receive a verified Petition for
Variance for certain real property situated in the City of Anaheim, County of Orange, State of
Califomia shown on Exhibit A, attached hereto and incorporated herein by this reference; and
WHEREAS, the petitioner requests waiver of maximum fence heighf requirements to
retain an existing to retain an eight to nine-foot high wrought iron fence that exceeds the maximum
permitted fence height; and
WHEREAS, the Zoning Administrator did hold a public hearing at the Civic Center
in the City of Anaheim on August 20, 2009, at 930 am., notice of said public hearing having been
duly given as required by law and in accordance with the provisions of the Anaheim Municipal
Code, Chapter 18.60 "Procedures", to hear and consider evidence for and against said proposed
variance and to investigate and make findings and recommendations in connection therewith; and
WI-IEREAS, said Zoning Administrator, after due inspection, investigation and study
made by itself and in its behalf, and after due consideration of all evidence and reports offered at
said hearing, does find and determine the following facts:

NOW, THEREFORE, BE IT RESOLVED that the Anaheim Zoning Administrator
does hereby deny Vaziance No. 2009-04782.

BE IT FURTHER RESOLVED that approval of this application constitutes approval
of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning
Code and any other applicable City, State and Federal regulations. Approval does not include any
action or findings as to compiiance or approval of the request regazding any other applicable
ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that the applicant is responsible for paying all
chazges related to the processing of this discretionary case application within 15 days of the
issuance of the final invoice or prior to the issuance of building permits for this project, whichever
occurs first. Failure to pay all chazges shall result in delays in the issuance of required permits or
the revocation of the approval of this application.
THE FOREGOING RESOLUTION was adopted at the Zoning Administrator
meeting of August 20, 2009. Said resolution is subject to the appeal provisions set forth in Chapter
18.60, "Procedures" of the Anaheim Municipal Code pertaining to appeal procedures and may be
