Resolution-PC 2009-029RESOLUTION NO. PC2009-029 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION DETERMINING THAT PREVIOUSLY-CERTIFIED EIR NO. 330 IS THE APPROPRIATE ENVIRONMENTAL DOCUMENTATION FOR THIS REQUEST AND APPROVING RECLASSIFICATION NO. 2009-00228 (1750 ANA 1790 SOUTH DOUGLA3S ROAD) WHEREAS, the Anaheim Planning DeparCmeot did initiate a ReclassiPication on certain real properties simated io the City of Anaheim, Counry of Orange, State of California, shown on Exhibit "A", attached hereto and incorporated herein by this reference; and WHEREAS, these properties consist of property owned by the Oran~e County Transportation Agency (OCTA) and property owned by the City of Anaheim (City); and WHEREAS the OCTA property (1750 South Douglass Road) is currently used by the County of Orange as a mainYenance faeility and is in the Transitional (T) zone with a General Plan laod use designation of Institutional; and WHEREAS the City propeRy (1790 Douglass Road) is currently used for Cemporary constmction storage and is in the Industrial (I) zone witb a General Plan land use designation of InstiYUtional; and WHEREAS, the City of Anaheim Planning Department has requested approval of a Reclassification to reclassify said properties from the Transitional (T) zone and the industrial (I) zone to the Semi-Public (SP) zone, consistent with the General Plan land use designation of InsCitutional; and WHEREAS, the Planning Coznmiss9on dad hold a public hearing at the Civic Center in the City of Anaheim on March 2, 2009 at 2:30 p.m., notice of said pablie hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60 "Procedures", to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations i^ connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and repoRS offere~ at said hearing, does find and determine the following facts: 1. That reclassification of Che subject properties from the TransiYional (T) zone and the Industrial (I) zone to the Semi-Public {3P) zone wauld be consistent with the propert3es' existing Institutional land use designation o~ the General Plao. 2. That the proposed reclassification of subject properties is necessary and/or desirable for the orderly and proper developmeut of the commanity. 3. That o0 one indicated Cheir presence at said public t~eariog in opposition; and that no correspondeace was received in opposition to the subject petiCion. - 1 - PC2009-029 NOW, THEREFORE, BE IT RESOLVED that the Anal~eim City Flanning Commission has reviewed the proposal and does hereby find that this activity is within the scope of Environmental Impact Report (EIR) No. 33Q a program EIR approved in 2004 for the comprehensive update of the City's General Plan and Zoning Code, and that said program EIR adequately describes the activity for the purposes of CEQA to serve as the required environmeotal documentation in connection with this requesY. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby unconditionally approve the subject Reclassification to authorize an amendment to the Zoning Map of the Anaheim Municipal Code tQ exclude the above-described properties from the Transitional (T) zone and the Industrial (I) zone and to incorporate said described properties into the Semi-Public (SP) zone. BE PI' FURTHER RESOLVED, that this resolution shall not constiYute a rezooing of, or a commitment by the City to rezone, Yhe subject properCy; any such rezoning shall req~ire an ordinance of the City Coancil, whicl~ shall be a legislaCive acC, which may be approved or denied by the City Council at its sole discretion. THF. FQREGOING RESOLUTION was adopted at the Planning Commission meeking of March 2, 2009.
