A RESOLUTION OF THE ANAHEIM CITY PLANNING CONIMISSION
DETERMINING THAT A CEQA MITIGATED NEGATNE
DECLARATION I3 THE APPROPRIATE ENVIRONMENTAL DOCUMENTATION
AND RECOMMENDING TO THE CITY COUNCIL ADOPTION OF
GENERAL PLAN AMENDMENT NO. 2008-00467 PERTAINING
TO THE HOUSING ELEMENT
WHEREAS, the Anaheim City Council did adopC The Anaheim General Plan by
Resolution No. 69R-644, showing the general description and extent of possible future development
within the City; and
WHEREAS, the Housing Element is one of the seven General Plan elements mandated
by the State of California, as articulated in Sections 65580 to 65589.8 of the California Govemment
Code ("State law"); and
WHEREAS, the Housing Element identifies and analyzes existi~g and projected
housing needs and includes a statement of goals, policies, qnantified objectives, and scheduled
ptograms for the preservaCion, improvemenC and developmeot of housing for all economic segments of
Cbe community; and
WHEREAS, an October 29, 2002, the Ciry Council, by its Resolution No. 2002-229,
adopCed Che current Housing Element, prepazed for the I998-2005 planning period; and
WHEREAS, on May 25, 2004, tbe CiCy Council, by its Resolution No. 2004-95,
adopted a comprehensive updaCe of the Anat~eim General Plan, with the exception af the Housing
Element, which is zequired to be updated within the timeframes established by State law; and
WHEREAS, Generai Plan Amendment No. 2008-00467 proposes to amend the current
Housing Element in its entirety with the 2006-2014 Housing Element, as required by State law; and,
WHEREA3, the Housing Element is the only General Plan elemeut that requires review
and certification by Che State of California Department of Housing and Community Development
{HCD); and,
WHEREAS, on May 6, 2008, the City Council approved transmittal of the of the Draft
2006-2014 Housing Element to HCD for its review; and,
WHEREAS> on June 11, 2009, HCD issued a IeCter indicatiog that the Draft Housing
Element complies with all State law requirements; and,
WHEREAS, the Section 18.68.050 of the Anaheim Municipal Code requires the Planning
Commissio~ to either sabmit a recommendation for appcoval of said General Plan to the City Council,
or disapprove che amendment; and,

WHEREAS, before the Anaheim City Planning Commission recommends approval of
any General Plan amendment, it must make a finding of fact that the evidence presented shows that all
of the followin~ conditions exist:
(a) The proposed amendment maintains the intemal consistency of the General Plan;
(b) The proposed amendment would not be detrimental to the public interest, health, safety,
convenience, or welfare of Che Ciry;
(c) The proposed amendment would maintain the balance of land uses within the Ciry; and
(d) If the amendment is to the General Plan Land Use Map, ihe snbjeet pfoperty is
pt~ysically suitable to accommodate the proposed modi6cation includiog, but not limited to, access,
physical co~straints, topography, provision of utilities, and compatibaliCy with sunounding land uses;
and
WHEREAS, the Anaheim City Plan~ing Commission did hold a public hearing at the
Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on July 8, 20Q4, at 6:00
p.m., notice of said public hearing having been duly given as required by law and in accordance with
the provisions of the Anaheim Mu~icipal Code, to hear and considez evidence for and against General
Plan Amendment No. 2008-00467, and to investigate and make findings and recommendations in
connection therewith; and
WHEREAS, tt~e Anaheim City Planning Commission, after due consideration,
inspection, investigation and study made by itself, and after due consideration of, and based apon, a11
evidence and reporCS offered at said hearing, does hereby find:
1. That the proposed amendment maintains the intemal consistency of the General Plan, as
the proposed modifications to the Generai Plan are consistent with General Plan goals related to
housing and does not require any amendments to any of the other General Plan elements, with the
exception of possible future amendments proposed by Housing Element Strategies 3F and 3G, which
require review of the Green and Community Design Elements to ensure park and open space typology
and requirements will serve the City's growing population and infll developmenC and Chat the desigo
guidelines adeq~ately provide aesthetic direction for future residential development; and,
2. 'I'he proposed amendment would not be detrimental to the public interest, health, safety,
convenie~ce, or welfare of Yhe City in that the proposed amendment would provide housing poliey, in
compliance with State law, to meet the housing needs for all economic segments of the community for
the 2006-2014 planning period; and
3. The proposed amendment would not amend the General Plan Land Use Map; and,
therefore, does not alter the balance of land uses as cunently identified in the General Plan; and
WHEREAS, the Anaheim City Planning Commission has reviewed the proposa] a~d
does hereby find that the Mitigated Negative Declaration is adequate to serve as the required
environmenYal documentation in connecCion wiCt~ this request upan fi~ding that the declaration reflects

the independem judgme~t of the lead agency and that it has considered the Mitigated Negative
Declaration together with any comments received during the public review process and further finding
0o the basis of the iniYial study and ar~y comments received that there is no substantial evidence that the
project will have a significant effect on the eavironment.
NOW, THEREFOItE, BE IT RESOLVED, that pursuant to the above findings, the
Anaheim City Planning Commission does hereby recommend that the City Council of the City of
Anaheim approve General Plan Amendment No. 2008-00467, amending the Housing Element in its
entirety witb the City of Anaheim 2006-2014 Housing Element, dated duly 8, 2009, a copy of which is
on file with the Planning Department and incorporaCed herein by this reference.
THE FOREGOING RESOLUTION was adopted at the Planning Conimission meeting
of July &, 2009. Said resolution is subject to the appeal provisions set foRh in Chapter 18:60,
"Procedures" of the Anaheim Municipal Code pertaining to apReal ~rocedures.
