Santa Ana, CA 92705, request determination of substantial conformance
with the Anaheim General Plan for the proposed lease of office space.

ACTION: Commissioner Bostwick offered a motion, seconded by
Commissioner Boydstun and MOTION CARRIED (Commissioner Esping
absent), that the Anaheim City Planning Commission does hereby flnd the
County's proposal to enter into a lease agreement with the Anaheim City
School District, to lease approximately 16,000 square feet of office space for a
period of approximately 9 months from the close of escrow to continue
operating the County's Agricultural Commissioner ?rogram upon the pioperty,
is in conformance with the Anatieim GenE~rai ?;an based on a finding that the
agricultural office use is an existing nonconforming use and that the Anaheim
General Plan recognized the continuation of legal nonconforming uses.

ACTION: Commissioner Boydstun offered a motion, seconded by
Commissioner Bostwick and MOTION CARRIED (Commissioner Esping
absent), that the Anaheim City Planning Commission does hereby
recommend to City Council approval of the revised elevations, signage and
landscape plans; and, further, if the City Council approves Conditional Use
Permit No. 4102, that Conditions of approval Nos. 2,14 and 39 of Resolution
No. PC99-42, be retained, to require Commission review of detailed, fully
dimensioned plans and a full set of colored elevation and sign plans as a
Reports and Recommendations item.

Applicant's Statement:
David Rose, Regents Groups, 3870 La Sierra Avenue, Sulte 183, Riverside, CA 92505: They came
before the Commission in March and were denisd which then they appealed in order to try to get through
some of the issues. They voluntarily asked that item be continued from Council review. They ~etumed
with revised architectural improvement to the front of the facade which he feit was a substantial
improvement.
One of the maJor concerns of Commission, specificalhi Commissioner Boydstun as well as the members
of the audience, was the issue of the billboards. They have worked out an arrangement with the property
owner as well as thf 6aase holder of the billboards and are going to voluntarily remove those at a
substantial economic loss.
They are in agreement with all of the secommendations proposed by staff, except for the condition
regarding the closing of the driveways because this becomes an economic issue. If the driveway was
closed then they could not bring their trucks in and out of the site. They can not shut down the site at Ball
Road because the islands are 5 to 10 feet away from the canopy. Other than that they are in ful(
agreement with staff's recommendations.
They are in the process of trying to identify beer and wine licenses to purchase In the area. •',~here are
currently 7 existing licenses in the city of Stanton. Not wanti~ig to cause a problem they are ~ot proposing
to buy anything from the city of Stanton and bring it into the ciry of Anaheim. Therefore, they are going to
be purchasing two or three of iicenses in West Anaheim, then propose to transfer those into the area,
dispose of one or two of those licenses. They are willing to accept a condition that those be active
liuenses and in census tracts that are over concentrated.
Commissioner Boydstun: Stated, for fhe record, she appreciated they getting rid of the billboards.
Commission reviewed the ptans and she understood why they needed the second driveway. However,
she hoped they do not obtain the beer and wine license.

City Planning Commission does hereby determine that the revised landscape
and elevation plans are in substantial conformance based on the following:
(i) That the previously-approved trees will be relocated adjacent to the
freeway to provide a similar landscape enhancement. In addition, the
trees wili be planted at the 24-inch box size instead of the 15-gallon
size.
(ii) That the previously-approved shrub screen will serve as a partial
screen of the new railing. Said screen shall be maintained at a level
necessary to screen the proposed railing as it matures.

Cheryl Flores, Senior Planning: This item was continued from the meeting of May 10th because staff was
un~~~~ io read the species of the trees on the plant palette of the landscape pians that was subm(tted.
Tne revised plans were submitted and the staff report identifies the locatian of 4 replacement trees
adjacent to the freeway. The reason that these trees were removed from against the building was
because there was a requirement in the building code for a ramp to be provided on the south side of the
building and the trees haci to be relocated.

reason this is being brought before Commission now is that they have advertised a conditional
use permit scheduled for June 7th, to expand the existing motel and to retain the current
restaurant with sales of beer and wine, and to construct a new commercial retail center. They
feel that the Commercial, Limited Zone would be the better zone to have in place because it
allows increased setbacks and increased landscaping for this site.

one of the original 4 requests that came before Commission in early March. They met with the property
owner and lease holder of the billboards. They are willing to go along with staff recommendations on page
2, regarding the landscaping. They are in agreement with ali of staff s recommendations, except for page
3, nn. 9, regarding the driveways, which they are unwilling to accept that recommendation. They are
willing to accept a staff recommendation to improve the landscaping on Brookhurst.
Commissioner Boydstun: She was plsased with their decision to remove the billboards. This is an overall

open until 2:00 a.m. Ne has spoken to WAND and they feel the hours recommended by staff are too
restrictive. He requested the hours be extended.
7here is a sign at the site tliat has a permit (page 5, iiem no. 2). if the City insists that they remove it then
they will comply but they would prefer to keep the sign up.
Page 7, item 27, regarding the expiration of the permit. Their minimum lease is 4 years and they request
the permit to expire in 2003.
Public Testimony:
Andrew Lui, owner of subject property, 1458 James Way, Anaheim, CA: He is strongly opposed to
Condition No. 26 (page 7) because as a prope~~ty owner he does not fee~ that he should pay for any Code
Enforcement inspections since he did not request this.
Chairman Bristol: Explained to Mr. Lui that this property has had many violations in the past.
Commissioner Bostwick: The property has cost the City money in terms of Police and Code Enforcement
and Commission did not want a reoccurrence with the new operator.
Commissioner Boydstun: Recommended the condition will be reworded to slate that the owner shall pay
the cost of Code Enforcement inspections as deemed necessary by the City's Code Enforcement Division
to gain and maintain compliance with State and local statutes, ordinances, laws and regulations.
Commissioner Koos: Mr. Lui is ultimately responsible for the situation his tenants create as a property
owner.
There was further discussion between Mr. Lui and Commission regarding Condition No. 26.

Judith Ann Gollette, Chairperson WAND (with the Land Use and Business Development Committee):
They have spoken with the applicant a number of times and have toured the restaurant and bar area.
Some of the same questions that were brought up today are also their concems. They are concerned that
the bar area not be turned into a night club. They also want upscale restaurants with good food, good
prices in West Anaheim and would enjoy having a nice place to go dancing and involvement in the
communiry.
The applicant has stated an interest in working with WAND, schools and businesses in the area. Mr.
Dewan nas been ~ very active member of WAND since he has been with them and has attended all their
meetings. They feel there needs to he some type of regulatory process put on it to ensure the changes
are being made on a regular basis.
Chairman Bristol: Asked Als. Gollette how she felt about the hours of operation?
Judith Ann Gollette: They felt there is no need to be open past 11:00 p.m. during ihe week nor going past
12:00 a.m. or 1:00 a.m. on the weekend. If everything is in complia~ce then perhaps an extension of
hours at a later date might be a possibility. She realizes there is a need for later hours ~n general for
peopie coming from community events but for now until they see an improvement those are the hours they
recommend. They would also not want to see the menu advertise dancing.
Shanti Dewan; Oue to the dinner shows he requested that they remain open during the week until 12:00
a.m. and on weekends at 1:00 or 1:30 a.m. He does not want to be based on the past business owner
who was running a different type of operation. He has had previous experience in other sites in Anaheim
and he has improved other sites (i.e. in Corona Del Mar).
THE PUBLIC HEARING WAS CLOSED.
Commissioner Napoles: A positive first step is that the applicant is going to change the name of the
operation.
Shanti Dew~n: Yes.
Comrriissioner Koos: Stated this is the first prnject since the adoption of the Brookhurst Corridor Overlay
that he felt is compatible and is a positive sign of goad projects beginning to come forward. He is glad to
see this site being cleaned up and hoped that the applicant will prove to Commission that they deserve to
extend the time limitation on his CUP.

• That Condition No.18 be reworded, "That ths hours of operation shall be" followed by the hours
Commission decides.

requirements. Last year they were given another year for the completion of conditions such as removing
canopies, put in new landscaping, asphalt, fence removal and tree sprinkler, and removal of trash
enclosure. They thought they built the trash enclosure according to the ap~roved plan by building a new
c~e. They are not storing inoperable vehicles, every car there is operable. There are 4 cars at the
property at night that are taken out during the day. He asked Code Enforcement to come out to the
property and explain the violations so that they could cooperate and correct the things that they needed to
do in order to be in compliance.
Judith Gollette, WAND: This corner has been brought before Commission several times. This corner is
too small to have two businesses being run there. There are more than 4 cars at the site for sale, and
ti~ey are there all day long. It needs to be either a car repair place or a used car sales lot, not both.
Yahya Cyrus (brother of Shakour Cyrus) Responded to Judith Gollette, it is a busy corner and there are a
lot of customers that come in for various automotive repair problems. The fact that there are two licenses
is not what makes the corner busy, it is the nature of the business, sometimes they are very busy and
other times they are not.
Lauri Cyrus (wife of Shakour Cyrus): They were required to follow through on the conditions last year.
Findings show that they complied with all the conditions. She did not understand why Ms. Gollette says
s~ch things. They were selling gas at the time they asked for the permit and there was more traffic then
than there is now. It is currently only a auto repair and car sale with only 4 vehicles in the front. There is a
problem with language because her husband does not come from this country but they are citizens and
she feels they deserve the same rights as everyone else.
Commissioner Boydstun: Stated that the public has the right to come up and give testimony. Commission
is considering what they have now, that is what their CUP is for, and that is what they are reviewing.

MayoPs office 5 times to attempt to talk to him but was unable to.
Commissioner Boydstun: She has sat on this Commission at every meeting that they have had with the
applicant and she felt he has made great improvement. They want to work with him.

Commissioner Bostwick: The request variance and request for dedication was discussed at the morning
session. Public Warks engineering staff was asked how many people have offered a dedication for these
purposes, and why is this property being requested to do so?
Melanie Adams, Associate Civil Engineer: There are no other properties on Liberty Lane that have
dedicated to 32 feet. She had not been able to determine at what time each one of the buildings were
constructed. The initial review found that the buildings were originally constructed in the 1960's but she
d'sd not know how many buildings were added onto or constructed after the initial development date.
Commissioner Boydstun: If offered a 2 foot wide dedication, curb and gutter it would affect their parking
and cause them to loose parking.
Melanie Adams: If thoy make the irrevocable offer to the City for the dedication, their parking would not be
taken away today. If at a later time, as stated in paragraph 11, if a need arose to have sidewaiks and they
were abie to develop a comprehensive plan for the entire area, at that tirne, the City would do the
reconstruction. Untii then they would be able to use the parking.
Commissioner Bostwick: Asked if they dedicate the property and the cars hang into the Ciry right-of-way,
is there a problem?

Melanie Adams: She did not see a problem but deferred the question to the City Attomey
Selma Mann: Responded she could not answer with regard to the use of the propeity after dedfcation
before 1t is accepted by the City. Prior to the time that the City actually takes action to accept the property
it remains the responsibility of the property owner. If it were an encroachment, they would require an
encroachment permit. With regard to nexus, that is a separate issue, based determin~akion that the impact
of the project that is ccming in is propo~tionate in type, and in amount to what is coming in. Whatever
conditions are being imposed are related to the project. Example, if the traffic is going to increase 10%
then the owner is not required to pay more than 10% of the required improvements.
Chairman Bristol: Asked Ms. Anthony if they are proposing to increase traffic?
Susan Anthony: No, it is simply for storage.
Melanie Adams: If this property were sold to another user, ~vould those uses be able to be one that would
generate traffic, is the building for storage uses for perpetuity?
Commissioner Boydstun: She wondered if the waiver could be removed?
Selma Mann: The applicant is here because he is not able to proceed with the building permit until this
matter is resolved. If Commission is granting a waiver based upon a particular fact that this is a storage
shed that is going to be used for storage with no impact on traffic, and that is the basis for granting ~f the
waiver, Commission may want to have a covenant against the pro~~erty that the waiver is granted based
upon ihat use and if there is a change in use, that would mean the waiver would have to be reconsidered
at that time. Make the waiver expressly conditioned upon the facts that are brought before Commission
that are causing the granting of it.
Melanie Adams: The Public Works would request covenant, someone could come in at a later time and
change the use. There is a covenant it could be recorded with the land and would provide adequate
notice to future property owners.
Susan Anthony: Asked who prepares covenant?
Selma Mann: Explained procedure to the applicant.
Mike Horvath (owner of propetty): The building is strictly for storage of plastic sheet for aircraft interiors.
There will be no additional traffic or people and he does not have a problem with giving them a document
