ACTION: Commissioner Bostwick offered a motion, seconded by Commissioner Napoles and MOTION GAFtRIED (Commissionars Esping, Koos and Vanderbilt absent), that the Anaheim City Planning Commission does hereby concur with staff that the proposed pmject fialls within the definition of Categorical Exemptions, Class 15061 (b) (3), as defi~ed in the State EIR Guidelines and is, therefore, categorically exempt from the requirements to prapare an EIR. Therefore 4he discussion was composed, from staff's no4es ApplicanYs Statement: Paul Kott, 1225 West Lincoln Avenue, Anaheim, CA: Referenced two renderings they provided which were posted on the exhibit wall. Staff recommended sixty conditions of approval relative to their project. He was in agreement with almost all of the conditions except for a few which they are concerned with. City of Anaheim Planning Commission Summary Action Agenda 07-19-99 Paye 4 Condition No.16 requires a modification to the traffic signal at the intersection of Broo~hurst Street and Crescent Avenue to provide for separate phasing for eastbound and westbound traffic on Crescent Avenue. It is in the Redevelopment Corridor Area and the Redevelopment Agency should bear the cost and not the developer since it was going to be done with or without the existence of this project. Condition No. 56 requires the dedication of 7 additional feet adjacent to Gramercy Avenue for street improvements and the improvement ta the right-of-way unless waivers are approved at a separate public hearing. That represents a time burden and he was very surprised to see that as a condition. He requested a modification to the existing hours of operation, in regards to the service station, the staff report states it will be open from 6:00 a.m. to 11:00 p.m., daily. It should read that it will be open 24 hours, daily. He also req~ested 24 hours for the drive-through car wash. Representatives from Carl's Jr., would like to be open 24 hours daily. He also requested the retaii establishment be open from 6 a.m. to 12 a.m. on a regular basis. Condition No. 19 requires the placement of two double-double yellow stripes along Brookhurst Street. He felt that should not be their responsibility. He pointed out an error in the staff report for the record. Paragraph No.10 on page 3 states the floor plan for the service station/convenience markeUcar wash indicates a total floor area of 3,000 square feet (including the car wash). That should read "excluding" the car wash, not including it. Commissioner Boydstun: Indicated it was corrected on the following page. Paul Kott: He has been informed that they are short of parking spaces and this matter can be handled through the filing and approval of an Administrative Adjustment. He asked for a clarification on that, THE PUBLIC HEARING WAS CLOSED. Chairman Bristol: Asked st~ff to clarify Condition Nos.16 and 19 for the petitioner. Alfred Yalda, Principal Transportation Planner: Stated this project will directly contribute to the tra~c on Brookhurst Street. The cost of the modification to the traffic signal would be approximately $5,000 to $5,000. Commissioner Boydstun: Stated Condition No.19 concerning the two double stripes is do to the fact that the Redevelopment Agency has not settled with the Junior High School across the street. She felt Commission should remove the condition and Redevelopment should be responsible for it. Chairman Bristol: Indicated they discussed the possibility of deleting Condition No. 4 at the morning work session. Cheryl Flores, Senior Planner: Condition No. 4 can be deleted because that requirement is covered in Condition No. 3. Ramona Casta~eda, Project Manager, Community Development: In regards to the placement of two double-double yellow stripes along Brookhurst Street, they are requiring this in order to facilitate traffic, a raised median would eventually need to be installed in it's place. Chairman Bristol: A;;ked if the applicant is required to place the double-double striping now, will they also be required to pay for the raised median? Alfred Yalda: Advised there is a possibility that they can redesign it to provide two additional parking spaces. Commissioner Bostwick: Condition No. 56 relates to the waiver of the 7-foot dedication. On the discussion at the morning session, there was a suggestion that this item be continued for readvertisement. If it is adve~tised then the applicant will have to return and pay the readvertisement fee for the additional waiver. It wouid not cost the applicant more money if this matter was continued. Regarding the hours of operation, he did not have a problem with the request to have the service station open 24 hours nor the hours for the retail establishment. Cheryl Flores: She confirmed that they can advertise the additional waivers within a two-week period. Mr. ICott: Requested that they receive approval today except for that one item and have the application fee waived when they apply for the additional waiver. He aiso requested clarification on the amount th~y will be required to pay for the modification of the traffic signal. Alfred Yalda: Regarding Condition 16, the maximum cost for the modification will be $5,000 to $8.000. Mr. Kott: Condition No. 53 requires R&R approval of the signs and asked if that was for the components of the signs and not the location. Chairman Bristol: Responded that is correct. The item that will return as a Reports and Recommendations item to finalize the size and specifics of the signs. The location will remain the same as identified on the plans. ' Commissioner Bostwick: Suggested the following modifications to the conditions of approval: • Delete Condition No. 4. • Modify Condition No.16 to require that the petitioner pay a maximum of $5,000 for the modification of the traffic signal. • Delete Conditiun No. 19. Alfred Yalda: Asked for a clarification as to whether Commissioner Bostwick v/as recommending the Redevelopment Agency pay for the placement of two double-double yellow stripes along Brookhurst Street? Commissioner Bostwfck: He continued recommending with the following modifications to the conditions of approval: ~ • Condition No. 19, he felt if the Redevelopment Agency wants the iwo double-double yellow stripes placed along Brookhurst Street then the F~gency can bear the cost. • Condition No. 27, he recommended the hours of operation be 24 hours for the service station, 6 a.m. to 11 p.m. for the convenience market, 24 hours for the drive-through car wash, 24 hours for the fast food restaurant and 6 a.m, to 12 a.m. for the retail establishment. Cheryl Flores: Stated if this item is cantinued, they can add a conditic~n about the Queen Palm trees to match the Home Depot landscaping. Mr. Kott: He felt that would not be a problem with the developer. He referred to the proposed modification of Condition No.17 on page 2 of the staff report. He stated all the exterior conditioning units will be ground-mounted and requested that Commission consider approval of a composition roof. Other than that, he concurred with staff s recommendations. Commissioner Boydstun: Asked the applicant if the composition roof would match the red tiles? Mr. Schor: Responded yes. Commissioner Boydstun: The roof covering will be a brick red composition with a couple of trees planted to the south and east. Chairman Bristol: Asked Mr. Culp iF he had any problems with any of the recommended conditions of approval? Mr. Culp: Responded he had a problem with Condition No.1. He did not understand why the permit would expire on December 1, 2000 if he has paid all the fees. Chairman Bristol: Resp~nded staff tied this conditional use permit with his lease and asked Mr. Culp if he had a business license? Mr. Culp: They have been trying to obtain a business license since April of 1998. Condition No. 4 requires the reconstruction of the driveway to accommodate 10-foot radius curb returns. The widening of the driveway is a problem because thsy have spent a lot of money on the landscaping. The City approved the design and gave them a sidewalk waiver. . Condition No. 13 refers to the on-site trash truck turn-around area. The turn-around area on his property was designed by the City and they built it according to City specifications. City of Anaheim Planning Commission Summary Action Agenda 07-19-99 Page 10 Commissioner Boydstun: Asked if there is enough room for the trash trucks to come in and out Mr. Culp: Responded trash trucks come in and out safely. Commissioner Boydstun: That is a standard condition that is placed on many projects. Mr. Culp: Condition No.16 is a problem. it requires a 10-foot wide landscaped setback. They do not mind plantir~g trees and he could see why they shouid do that, but that area is covered with decorated concrete that they would like to retain, PUBLIC HEARING WAS CLOSED. Commissioner Boydstun: Asked staff for clarification of Condition No.16. Melanie Adams, Associate Civil Engineer: There appears to be a misunderstanding. The curb location will not change. It will be 32 feet from the center line, the curb will not move. The applicant has been grar,ted a sidewalk waiver that can be revoked with proper notice. It is actually 13 feet from the curb. He would normally be required to install a 6-foot sidewalk and the remaining will be public access landscaping. There is no additional street widening. They do not want him to instal! more tre~s because they would ~ike to see side walks throughout that area. Commissioner Boydstun: Asked if the applicant could install trees in the public right-of-way? Melanie Adams: He should install more trees in his front setback area, Mr. Cuip: The entire floor of thE property is decorated concrete. Chairman Bristol: He has visited the site a couple of times and liked the way the property looked. Greg Hastings, Zoning Division Manager: Staff cuntinues to recommend that there be a 10-foot front landscaped area which would be totally on site. There is currently 2 feet of the landscaping area, an additional 8 feet is required to make up the 10 feet. This is a condition of approval of a previous conditional use p~rmit that was never implemented. Mr. Culp: He thought that the 8 feet of required landscaping was waived with the approval of the sidewalk waiver. Commissioner Boydstun: She noted that the waiver was for the sidewalk. Mr. Culp: They would be willing to comply, but he did not feel that tearing up the concrete for berm planters made any sense. Chairman Bristol: He agreed and asked staff if there is any way to make this work or is the applicant going to be required to comply? Greg Hastings: Since this is an existing situation, it could probably work if Commission considers this as being grandfathered in. He suggested that Commission could include a condition stating that staff will re- evaluate the situation in December of 2000 if this conditional use permit returns for reinstatement. Commissioner Bostwick: Stated, for the record, he was not present on June 21 st but he did listen to the tape and was well aware of the testimony given on that date. Susan Kim, Assistant Planner: Stated this item was initiated by the City as part of the Anaheim Resort Neighborhood Action Plan, created in conjunction with the Community Planning Program. This reclassification pertains to a 0.37-acre property located on the southeast corner of Orangewood Avenue and Mailul Drive. This property is zoned CG (Commercial, General) and designated for General Commercial land uses in the General Plan. The subject property is developed with a retail center consisting of small shops and a restaurant. The Planning Commission and Ciry Council have implemented a policy of reclassifying CG properties to the CL (Commercial, Limited) Zone on a c3se-by-case basis. If this parcel were to be redeveloped, the CL Zone would provide for more appropriate site development standards. In addition, the CL designation would be compatible with the area north of this property which is part of Anaheim Resort Specific Plan, the surrounding commercial properties to the east and west which are zoned CL, as well as the residential properties located south of the subject property. The property owner has been contacted and supports this action. Therefore, staff recommended that this property be reclassified from the CG Zone to the CL Zone. THE PUBLIC HEARING WAS CLOSED. The building has been vacant for the past year and a half. The owner was receptive to a church so the site could be well maintained and well utilized. Commissioner Bostwick: Asked Mr. Cook if the applicant is renting the property? Kwang Cook: Responded yes they are renting the site. Commissioner Bostwick: Asked the City Attorney if a tenant would affects the property tax rolls? Commissioner Boydstun: It is only a third of the square footage of the building that they are going to use. The owner is using it for income propsrty because he is renting it. She could not see how the use would take it off the tax rolls. Chairman Bristol: Several cities have experienced this because many churches can not afford to purchase a property and this is an altemative. Chairman Bristol: Asked Mr. Cook regarding the hours of operation? She spoke with the pastor and he indicated it would be removed. Kwang Cook: Unfortunately there was a misunderstanding on the Reverend's part. Applicant's Statement: Greg Hammill, 414 Fernhill Lane, P,naheim, CA: He is a consultant to Quartz Dealer Direct. Quartz applied in 1993 for a business license at this address. At that timo the business license was requested for auto wholesale/leasing and auto auctiun but due to the fact there was no listing for auto auction they did not include it in the business license. The business has been auctioning cars for the past 6 years on Mondays and Fridays. There are 35 part- time and full-time employees. Code Enforcement has visited the site and the Police have come due to the blocking of traffic on East Street. Quartz was not aware of any parking probiems until March of 1999 when they were cited by Code Enforcement for not having a CUP for their auto auction. They made arrangements with CHOC Hospital on Lincoln and East to use a portion of their lot to shuttle the customers back and forth. They have placed posters and handed ~hem out to customers advising them not to park in the residential area and show them the CHOC parking. They were surprised to find that staff is recommending denial of CUP because staff never gave them any indication of denial at IDC (Interdepartmental Committee meeting). Th~• staff report defines the problem weil but it does not address any solution. Regarding staff s comment about Quartz being detrimental to the surrounding land uses, this is an ML Industrial Zone, and they are not the only ones who use the industrial use. It is being used for the type of business that is permitted in the ML Zone. Item iii, the traffic generated by the proposed use does not impose an undue burden upon the streets. Ninety percent of the cars that come into the facility to be sold are driven in one at a time, only 10% are foaded off of a transpor~ vehicle. The problem is customer parking, it is not that there is an auction, or that it is loud or bothering the neigh~ors or industrial uses, it bothers neighbors because their clients are parking on the streets. There are four solutions to the problem,1 - close the business, 2- relocate which takes time, 3- downsize, which also takes time and 4- provide a shuttle service which eliminates congestion. A benefit of using CHOC is it provides carpooling and eliminates traffic on East Street. It does need to be repafred but there is no need to install slats because no one can see in unless they drive down the ailey. • Item 3, screening the storage area. This is not necessary because no one drives down there except those in the Industrial Zone. Commissioner Boydstun: Asked if he was referring to the fence on the north side of property which is chain link all the way down and if so, that is the part that needs to be siatted. Cheryl Flores: Code requires that all storage areas be screened. Greg Hammill: Indicated they can screen it. On Condition No.10, he requested a maximum of 3'/z to 4 hours for the automotive auctions. All the rest of the conditions were acceptable to owner. They felt their business should not be punished simply because it has grown, but rather to try to find solutions. There needs to be a solution found regarding the parking problem. Sam Governale, 725 Whitewing Lane, Walnut, CA: The loading and unloading trucks takes place about six t;mes a week. If there is an influx, they unload at an auxiliary lot on Anaheim Blvd. then drive vehicles in. As soon as they were made aware that that they were infringing on the parking of their neighbors, they took every effort to alleviate it which he believes they have. They are willing to make chanc~es to the visibility of the vehicles. Opposition: Marilyn Helm, 700 S. East Street, Anaheim, CA: Stated she lives directly across the Quartz dr~veway. In the last 2 years the problems have escalated. They have eliminated some but do off load aut in the street and when they park in the middle of the street she can not get in and out of her driveway. When they first started they were able to get all the vehicles inside the lot, but now there is chaos. It is not noise, it's saTety. They have tried to address the problem by having someone stand in the street and sending them somewhere else, but vehicles stii; come in and park on South Street to the railroad tracks, in the cul-de- sac and at the gas station. She felfi they are in a location that is too small for their needs. James Chambless: 1219 East Diana, Anaheim, CA: She lives at the corner of Diana and Dawn less than 300 feet from site. Residents are conscantly faced with potential hazard. This business has grown tremendously and there is no room for a~rs to park and it has become unsafe. It is a good business, but it has outgrown its locat;on. Residents strcngly support staff's recommendation to deny waiver and she feit Commission should take steps to see tha~ they find a larger location or revoke their permit. Claire Chambless, 1219 East Diana, Anaheim, CA: Some neighbors were not able to make the meeting. Page 4 of staff report, item 26 (ii), states the main problem very well. She is pleased that they are successful but they need to relocate to a larger site. Bernard Gotieib, 1237 East Crestbook Place, Anal~eim, CA: Has been living at his home for 38 years. The applicant has made an improvement on pa~king but only after the street was fully loaded. East Street is not industrial as they stated, it is residential from Ball Road to the 91 Freeway on the east side which is under construction until March of 2000 which has resulted in being very congested. Rarking is not fully alleviated and cars are washed on the lot without adequate drains. The parking situation is much better and they are good neighbors, but they are too big for the site. There was a time when they really did overflow into the residential neighborhood but they are taking steps and have done a good job with it. Greg Hammill: You can not stop people from driving badly, but they can plan by ciosing the front end of the establishment so that vehicles can not park across the driveway or cause problems. They need to find a solution until they find more space. This business provides a necessary function in the City. Sam Govenale: They are not in the retail business, they are a wholesale auto auction. The only retail done is to those neighbors d'crectly :n the area to give them a break on buying a car at a cheaper price. Regarding drainage, there is no more that trickling water from the front driveway, no more than would be from someone watering their lawn because their drainage is set up to go out into the back alley. Sidney Bickel, owner of the property: Stated that an applicant for a bus company for this property was also denied 6 years ago. If this is turned down and occupants are forced to move, she will have a difficult time replacing the tenant. Alfred Yalda: Rsked where the 35 employees park and where do their customers that come to the auction park7 It appears that they are impacting the neighborhood. Sam Govenale: Emaloyees park on the inside perimeters or outside parking lot on Tuesdays through Fridays. On Mondays employee vehicles are taken to CHOC parking lot, along with 90% of the customers which are then shuttled. On Fridays all visitors are parked withi~ perimeters. Vehicles used to be parked bumper to bumper but that is no longer done due to shuttie use. On average there are 90 to 100 dealers that participate on Mondays. Commissioner Boydstun: Suggested mailing a notices to all dealers advising them of where !he parking is located, about the shuttle service, and not to park in the East Street neighborhood. THE PUBLIC HEARING WAS CLOSED. Chairman Bristol: Asked the applicant what kind of maintenance was done on the site and what time the auciions are held? Sam Goven~le: Vehicles are washed for auction days. Auctions are held at 4:30 p.m. on Monday and it is aver between 7:30 or 8:00 p.m. On Fridays it is 10:30 to 1:00. Melanie Adams, Associate Civil Engineer: Asked applicant to describe the washing operatior. Sam Govenale: Water drains through the back alley, and cars are washed in their spots with buckets and rags using only water. Melanie Adams: Requested a condition be added regarding washing operation in case they want to use soap or degreasing in the future so that it does not cause a probl~m in the storm drain system. Commissioner Vanderbilt: Asked if an a~proval was needed for a washing situation like this? Melanie Adams: If they are only using water it is not a problem but if they are using soap or degreasers it would pose a problem. Sam Govenale: They are ~nly ~sing water, most cars are only on the premises for a day or two before the auction. Most cars arrive from the dealers fairly clean and ready to sell. Dealers are presenting the vehiclss ready to sell. If it needs to be completely detailed it goes to Supershine down the alley. Chairman Bristoi: Asked if he had a reciprocal parking agreement with CHOC on Lincoln? He asked if those who go to the auction wouid not be driving to their site but instead will go right to CHOC? Sam Govenale: It is not a lease, it is indefinite on a month-to-month basis. It is arobably safe to say that on Monday, buyers park at the CHOC parking lot. Chairman Bristol: Advised he was at the site recently and there were 19 cars in front, tandem parking. He spoke to someone by the n~me of Joe and he indicated the 2 cars in front were employees, the rest were auction vehicles. Commissioner Boydstu~i: She was also at the site ~nd Joe told her they were shifting cars around to get them in the right order for the auction. She was there for a while watching them and that appeared to be what they were doing. Sam Govenale: The cars should not have been there overnight and that is what they were doing with the cars out front. ' Alfred Yalda, Principal Transportation Planner: They recommended this item be continued until the petitioner provides a comprehensive traffic study including a parking study showing where all employees park. They should not be parking on an off site facility. If they are it should be a recorded agreement with all other facilities. If that off site has extra parking and if it exceeds the municipal code, they have to have a recorded reciprucal agreement. Chairman Bristol: He suggested that the applicant prove that the parking is not impacting the residents. Commissioner Bostwick: Advised the a~plicant needs to have a signed agreement with CHOC that meets City requirements of executing a reciprocal agreement. They also need to have a plan in place to chain off the driveway to parking out front on Friday's and Monday's from noon to 7 p.m. He afso suggested giving a couple of years on the CUP and in the meantime try to find a larger space in a different location, Redevelopment can help with that. Chairman Bristol: The fact that there are people there directing traffic and it is a residential area Alfred Yalda: The only people who are supposed to direct traffic are people who work for Police Department, no one else should be directing traffic on any City public street. Ssm Govenale: They will work with the dealers to direct and train them to get them used to the procedure. Tim 0'Neil offered her a 6-foot wall to separate her property from Walgreens but she is still concerned about the lighting due to the wall. She also questioned whether or not there will be access from Center Street. Oue to cars being parked on Alana Way, they can not see cars coming from either direction so she asked for a red curb in order to be able to see out. Commissioner Boydstun: Advised that they never approved any business in that residential area. Don Yourstone, Senior Code Enforcement Officer: Advised Commission that legal action against that residentiai home is already in progress and should be disposed of within the next 30 days. They are also looking into other parking requirements on other businesses in the area. Chairman Bristol: Asked Mrs. Beckman what side of Ward she was on and was she aware that the plans indicate an alley and was she concerned about lighting in the ~Iley or lighting in genera~? Mrs. Beckman: Advised that there is a re-routed alley that will go right by her house. She is concerned about the lighting of the alley in general. Her house and her neighbor's are the only two residential houses left. There are a lot of transients in the alley and she needs lighting. Commissioner Boydstun: Suggested she call Code Enforcement because the garages are on the alley and Code Enforcement has dawn to dusk lights that can be mounted on their garages. Mrs. Beckman: Advised she is aware but an electrician must install and asked if the City could install a light there? Commissioner Boydstun: Responded no, but the City would provide the lights. Commissioner Vanderbilt: Suggested the applicant consider working with Ms. Beckman on that Commissioner Bostwick: Advised that there will be lights on the alley side of Walgreens.
