WHffitBAS, the City Plaaning Commission of the City of Anaheim did receive a verified
Fetition for Variance from MR. and MRS. LBSTER B. HBRR, 543 Janss Way, Anaheim, California,

of certain real property situated in the C3ty of Anaheim, Coun4y of Orange, State of
Californiu, as described in Bxhibit "A" or as follows: Lot 53, Tract No. 2237

WF~tBA3, the City pianning Commission di3 hold a public hearing at the City Hall ia
the City of Anaheim on July 24, 1961 at 2:00 o~clock P.M., notice of said
public hearing having been duly given as required bylaw and in accordance with the provi-
sions of the AaaYieim Municipal Code, Chagtes 18.68, to hear and coasider evidence for and
agninst said proposed variaace and to invest3gate and ma,ke Findings and recommendations
in connection therewith; and
W}IDRBAS, said Commission, after due inapecticn, investigation~aad study made by it-
self and in its behalf, and after due consideratior. of all evidence and reports offered
as said hearing, does find and determine the £ollowittg facts:
i. That ~he petitioner requests a varisnce from the Anaheim Municipal Code:
8ection 18. 20.030 (3 A) to pezmit encroachment of 20 feet in the required 25 f oot rear
yard area in osdex to construct a family room addition.
2. That there are exceptioaal or extraordinary circumstances or conditions
applicable to the property involved or to the intended use of the ~~operty that do no#
apply geaerally to the property ar clas~ of use in the same vicinity and zone.
3. That 4he requested variance is necessary for the preservation and ea3oqmeat
of a 8ubstantial property right possessed by other property in the same vicinity and
zone, and denied to the property in question. •
4. That the requested variance will not be materially detrircen4al to the public
welfare or injurious to the property or improvements in such vicinity and zone in whi.ch
the property is located,
5. That #he requested. variance wiil not adversely affect 4ha Comprehensive
Generai Plan.
6. '!'hat no one appeared in opposition to subject petition.
