Petition for Variance from JBRRY A, and SALLHB A. HUPP, 828 Palcon, Anaheim, California,
Owners
of certain real property situated in the Ci#y of Anaheim, Couaty of Orange, State of
Cslifornia, as described in Bxhibit "A" or as follows: Lot 11, Tract No. 3946

Wf~RBAS, the City Planning Commission did hold a public hearing at the City Hall in
the City of Anaheim on September 18, 1961 at 2;00 o'clock P.M., notice of said
pub.Lic hearing having been duly given as required by7aw and in accordaace with the provi-
aioas of the Anaheim Munic3pal Code, Chapter 18.68, to hear and consider evidence for and
againat said proposed variaace and to investigate and make findiags and recommendations
in connection therewith; and
WF~RBAS, said Commis~ioa, after due inapection, investigatioa,and study made by it-
self and in its behalf, and after due consideration of all evi~xence and reports oFfered
es said hearing~ does find and determine the following facta:
1. That the petitioner requests a variance from the Anaheim Municipal Code:
3ection 18.24.030 (1-a and 3) to permit an encroachment of five (5) feet into the required
front yard and an encroachment of five (5) feet into the required rear yard.
2. That there are exceptional or extraordinary circumstaucea or c:•~,nditions
applicable to the property involved or to the intended uae af the property that do not
apply generally to the property or class of uae ia the atme viciniiy and zaae.
3, .That the requested variance ia aecessary for the preservatioa and en,~oyment
of a aubetantial property right possessed bq other property ia the same vicinity end

4. That the requeated varisnce will not be materiaily detrimental to the pubiic
welfare or in3urious to the property or improvementa in such vicinity and zone itt which
the property is located.
5. That the requested variance wiil not adv2rsely affect the C•smprehensive
Generai Pian.
