A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 1437 BE GRANTED
~'° WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petitio_~ for Varience
;: from GUY L, and DBLLA N. COOPHR, 360 South Deanna Street, La Habra, California, Owners of
;~, certain real property situated in the City of Anaheim, County of Orange, State of :,alifornia,
~~ as described in Hxhibit "A" or as follows: Lot Nos. 5 and 6 of Tract No. 2377, and further
"~ described as 1757 and 1761 West Ball Road

WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Anaheim
on January 8, 1962 et 2:00 o'clock P.M., notice of seid public hearing having been duly given es required
by law end in accordance with the p~ovisions oE the Aneheim Municipal Code, Chepter 18,68, to hear and conaider
evidence for and against said proposed varience end to investigete and meke findings and cecommendetions in connec-
tion therewith; and
WHEREAS, seid Commission, after due inspection, invesUgation, end study mede by itself end in its behalf,
end after due consideretion of all evidence and ieports offered as seid hearing, does find end detecmine the following
facts:
1. Thet the p~titioner cequests a veciance From the Aneheim Municipel Code: 5ectinn 18.32,060 to permit
construction of two story multiple family residential development on subject property.
2. Thet the~e are exceptlonal or extcao:dinery circumstences or conditions applicable to the property involved
or to the Intended v.se of the property thet do not apply generally to the property or class of use in the same vicinity
end zone.
3. Thet the iequested varience is necessery for the preservatlon end enjoyment of a substential property right
possessed by other propedy in the seme vicinity and zone, and denied to the pmperty in question.
4. That the requested varience wiil aot be meterielly detrimental to the public welfate or injurious to the prop-
erty or imp:ovements in such vicinity and zone ir which the propedy is located.
5. Thet the tequested verience will not adversely effect the Comprehensive General Plen.
6. That the owner of abutting property requested that the development of the front
portion of subject property be limited to one story in height..

' Petition for VariencQ, upon the following conditions which are hereby found to ba a necessary prerequisite to th~ pro-
` posed use of the subject property in order to preserve the safety and generel welfare of the Citizens of the City of
`' Aneheim. ~;
;~ 1. Development substantially in accordance with Hxhibit Nos. 1, 2, 3, and 4.
~ 2, Payment of $25.00 Park and Recreatior. Pee per dwelling unit to be collected as part
of Builuing Permit.
~i 3, Provision of trash storage areas as determined by the Department of Fublic Works,
~ Sanitation Division, which are adequate in size, accessible to trash-truck pick-up, and
' adequately ~nclosed by a;telid fence or wall, prior to Final Building Inspection.
