A RE50LUTION OF THE CI'i'Y PLANNING COt~'AISSION OF THE CITX OF ANAHEIM
THAT PETITION FOR VARTANCE N0. 1439 BE DENIED
WfiEREAS, the City Plenning Commission of the City of Aneheim did receive e veri~ed Petition for Variance from
M. 0. and ESTHER C, WANGBNSTEEN, 103 Bast Center Stieet, Anahei2, California, Owners; James P.
Waiker, 1311 South Los Angeles Street, Aaaheiin, California, Agein~•of..certain real property
sittsated in the City of Anaheim, County of Orange, State of California, as descriUed in Exhibit
"A" or as follows: Legal description, Bxhibit "A", attached hareto, incorporated in file of
subject petita.on and referred to herein as though set forth in full
; and
WHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the Clty of Anaheim on
January 22, 1962 et 2:00 o'clock P.M., notice of aaid public heering heving been duly given es :equired by
lew and in acco:dence with the p:ovisions of the Aneheim Municipal Codc, Chaptet 18.68, to hear and consider evidence for
and egainst said pcoposed variance and to investigate end make flnding's and recommendetions in connection thecewith;
and
WiiEREAS, said Commission, efter due inspection, investigetion, and study made by itself and in ita behaif,
and efter due consideretion of ell evidence end reports o#fered es said hearing, does find and determine the following
facts:
1. That the petitio!ier requests a varie~ce from the Aneheim Municipal Code: $ection 18.32.06Q which
prohibits the construction of twoWstory buildings on subject property, to permit said
construction; Section 18.32.070 which requires that the minimam liveable floor area of a
one-bedroom apartment sha11'be not less than 700 square feet, to permat the construc4ioa of
three (3) one-bedroom apartment units having a live~able floor area of 625 square feet; and
Section 18.32,090 which requires that subject property shall be separitted from properties
claa i,'±.ed in the,single family residential zone by a masonry wall, to permit proposed
devei.~nent without said wall construction,
2. That there are no exceptiona.l or extraordinary circumstaaces or conditions
applicable to the property involved or to the intended use of the property that do not
apply generally to the property or class of use in the same vicinity Ftnd zone.
3, That the requested variance is not necessary for the preser~~ation and en,~oyment of a
substantial property right possessed by other property owners in the ~ame vicinity and zone,
1nd denied to the property in quest3.~n. •
4. That the requested variarece wiil be materialiy detrimental t•~ the public welfare
or injurious to the property or improvements in such vicinity and zone in which the property is
located.
5. That the vacant property to the south classified in the R A, Residential Agricuitural,
Zone may develop for single family residential homes which would be ma~de more difficuli by the
requested two~story construction.
6. That no hardship whatsoever has been indicated by the applicant to warsant any
approval of a substandard R-3 development,
7. Th~t the rights of proper~y owners in the vicinity of subject prop~rty wuuld best be
protected by tk~ establishmen5: of muitiple family development in full confor.mance with all
R-? Code requiremen~s,
8. That verbal and written opposition was recorricd against subject petition.
