lew and in eccordence with the p:ovisions of the Mahsim Municipal code, Chapter 18.64, to hear aad coaeIder ev;denoe
for and against seid proposed conditional use and to investigete and meke findings epd recommendetions in connect;cn
therewith; and
WHEREAS, said Commission, after due inspection, inveatigation, end stady mede by itself end in its behalf, ead
aQer due coneideration of ell evidence and repo~ts offered at said headng, does find and determine tha followiag fects:
I. That the pmposed use is prope:ly one for which a Conditionnl.Uae Peimit iB authorized by Wis Code, to
wit: an apartment-hotel with restaurant and cocktail lounge.
2. That the proposed use will not adveasely affect the edjoining lend uses ead the grotvth and development of
the erea in which it is propoaed to be loceted.
3. That the size and shepe of the site proposed for the uae is edequete to allow the fuli development of the
proposEd use in a meeuter no! detrimentel to the perticular erea nor to the peace, health, se¢ety, and general welfere
ofthe Citizens of the City of A~~aheim.
4. That the traffic. generated by the proposed use will•not impose an undue burden
upon the streets and highways designed and improved to carry the traffic in the area,
5. That the~granting of the Conditional Use Permit under the conditions imposed, if
any, will not be detrimental to the peace, health, safet'y, and general welfare of the
citizens of the City of Anaheim,
6. That the specific waiver of Code, Section 18.40.020 is hereby deemed necessary
for the waiver of the thirty-five (35) foot height limitation in the C-1, Neighborhood
Commercial, Zone in order to permit a maximum building height of thirty-seven (37) feet in
order to develop the subject property in accordance w:th plans presented, said waiver
permitted under the authoritq governed by Section 18:6~F.070 of the Anaheim Fiunicipal Code.
7. That no one appeared in opposition to subject petition. '

1, Development substantially in accordance with fiKhibit Nos. 1, 2, and 3,

northerly property line except for those areas reserved for ingress and egress to subject

6. Payment of $2.00 per front foot for street lighting purposes on Ball Road.
7, Payment of a Park and Recreation fee of $25.00 for apartment units only, to be
collected•as part of the Building Permit.
8. Provision of trash storage areas as determined by the P°partment of Public
• Works, .Sanitation Division, which are adecjuate in size, accessibie to trash-truck pick-
up, and adequately enclosed by a solid fence or wall, prior to Final Building Inspection,
9. Provision of the necessary fire hydrants as required by the City of Anaheim .

highway right-of-way line of Ball Road, said landscaping plans to be submitted to and
subject to the approval of the Superintendent o~', Parky~ay Maintenance and Lo be installed

11. Time limitation of one hundred eighty (180) days for the accomplishment of
Items 4, 5, and 6.
