THAT PETITION FOR VARIANCE NO. 1466 HE GRANT~D
WHEREAS, the City Planning Commission of the City of Anaheim did receive e vedfied Petition for Vedaaca
from HAROLD E, and MATHILDA FOXy 2428 Transit Avenue, Anaheim9 C~lifornia, 4YNER$ t~f certain
real property situated in the City of Anaheim, County of Orange, State of C~lifornia, as
described in Exhibit "A" or as followsa Lot Noo 106 in Tract 1940 and further described
as 2428 Transit Av;:nue

WHEREAS, the City Plenning Commiseion did hold a public headng et the City Hell in the City of Anaheim
on April 309 1962, et 2:00 o'clock P.M., notice of aeid public hearing having been duly given es required
by lew end in accordence with the pcovisions of the Maheim Municipel Code, Chepter 18.68,to hear and consider
evidence for end egaInat seld proposed varience end to investiBnte end meke findings end recommendetions in connec-
tion therewith; end ~
PlHEREAS, seid Commtaelon, efter due inspectlon, investiQetlon, end study mede by itself end in ita behalf,
and efter due consideretion of ell evIdence and reports offered as seid headng, does find end determine the followIng
fecte:
1. That the petiHoner requesto a variance fmm the Anaheim Munictpal Code: Section 18 0 24 0 030 (1) to
permit the ODNSTRUGTION OF A SIX FOOT FENCE ENCIASING A PROPOSED SWIMMING POOLa
2. That there ere exceptional or extreordinery circumstances or conditiona eppliceble to the propedy involved
or to the intended use of the property thet do not epply generelly to the pmperty or class of use in the seme vicinity
and zone.
3. Thet the requested variance ie nnceesary fer the peeservation end enjoyment of e eubstentiel propeety right
poasessed by other property in the seme vicinlty end zone, end denled to the property in questlon.
4. That the requested varience wili not be metedelly detrimentel to the public welfere or lajudo~a to the prop-
edy or improvements in such vicinity and zone in which the proQecty la loceted.
