A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
., THAT PETITION FOR CONDITIONAL USE PERMIT N0. 234 BE DENIED
WHEREAS, the City Planning Commission of the.City of Anaheim did ceceive a verified Petltion for Conditional
Use Pem~itfrom VERA MARIE S1'ARMER, 1109 East North Street, Anaheim9 California, and BEVERIDGE
G. CHAMBERS, 1102 East North Street, Ananeim, California, Ownersf DAVID A. RUSSELL, 272
Waterview Strce'c, Playa del Rey; Celifornia, Agent of certain real property situated in the
City of Anaheim, County o£ Oranqe, State of California, as described in Exhibit "A" attached
hereto and referred to he.rein as though set forth in full

WHEF.EAS, tne City Plenning Commission did hold e public hearing et the City Heil in the City of Aneheim on
May 14' 1962, at 2:00 o'clock P.M., notice of said public hearing heving beep duly given as :eqniced by
lew end in accordance with the pmvisions of the Anaheim Municipel Code, Chepter 18:64, to hear end consider evidence
for and egainst said proposed conditional use and to investigete end meke findings end recommendetions in connection
the:ewith; end
WHEREAS, seid Commission, after due inspection, investigetion, end study made by itself end in its behalf,
and after due consideration of all evidence and eeports offered at seid hearing, does find end detecmine ffie following facts:
1. Thet the proposed use is properly one for which a Conditional Use Permit is authorized by this Code, to wit:
establish a service station.
2. That the proposed_usa will adversely aff ect the adjoining land uses and the growth
and developm~nt of the area in which it is proposed to be located.
3. That the size and.shape.of the site proposed for the use is adequate to allow the
full development of the proposed use in a manner not detrimental to the particular area nor
to the peace, health; safety and general welf are of the citizens of the City of Anaheim.
4. That the traffic generated by the proposed use will impose an undue burden
upon the streets and highways ,9esigned and improved to carry the traffic in the area.
5. That the granting of the Conditional Use Aermit under the conditions imposed, if
any~ will be detrimental to the peac~., healthy safety~ and general welfare of the citizens
oi the City af Anaheim.
6. That two pexsonss one representing 83 property owners ad~acent to subject property,
appeared before the Commission in opposition to subject petition.
7. That the proposed petition would constitute an encroachment in a residential area,
and would not be in accordance with the proposed General Plan.

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Plenning Commiasion does hereby deny subject
Petition for Conditlonal Use Petmit on the basis of the efo:ementioned findings.
