A RESOLUTION OF THE CITY PLANNING COMIi'IISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT N0. 23~ BE DENIED

WHEREAS, the City Planning Commission of the CIty of Aneheim did receive a verified Petition for Conditional
~ Use Pennitfrom CHARLES R. SIMON, 1204 East La Palma Street, Anaheim, California, Owner;
; DAVID A. RUSSELL~ 272 Waterview Street, Playa del Rey, California, Agent of certain real property
'' situatpd in the City of Anaheim, County of Orangei State of California~ as described in Exhibit
"A" attached hereto and referred to herein as though set forth in full

WHEF.EAS, the City Planni.ng Commission did hold a public hearing et the City Hell in the City of Anaheim on
May 14~ 1962~ at 2:00 o'clock P.M., notice of seid public heariag having beep duly given as required by
lew and ii~ acco:dance with the provisions of the Anaheim Municipel Code, Chepter 18.64, to hear and consider evidence
for ar.d against said proposed conditionel use and to investigate and meke findiags and recommeadetions in connection
therewith; end
WHEREAS, seid Commission, efter due inspectian, investigetion, and study made by itself ead in its behelf,
and after due consideration of ail evidence and reports offered et said hearing, does ~ind and dete:mine the following feds:
1. That the proposed use is properly one for which a Condifional Use Permit is euthorized by this Code, to wit:
estabiish service stationa
2. That the proposed use will adversely affect the adjoining land uses and the growth
and development of the area in which it is proposed to be located.
3. That the size and shape of the site proposed for the use is adequate to allow
the full development of.the proposed use in a manner not detrimental to the particular
area nor to the peace, health, ~afety, and general welfare of the citizens of the City of
Anaheim.
4. That the_granting of the Conditional Use Permit under conditions imposed, if any,
will be detrimental to the peace, health,: safety, and general welfare of the citizens of
the City of Anaheimo
5. That the traffic generated by the proposed use wiil impose an undue burden upor.
the streets and highways designed and improved to carry the traffic in the area.
6. That •three persons appeared in opposition to subject petition, one representing
63 neighbor.ing property owners, and oae persnn appeared..3n f avor of sub3ect petition.
7. That the ~oposed Petitio~ would constitute an enc.roachment into a residential area,
and would not be in accordance with the proposed General Plan.
