I _ j t.^~ RESOLUTION N0. 329~ SERIES 1961-62 A RESOL[JTlON OF THE CITY PLANNIDTG COMMISSION OF THE CITY OF ANAHEIM ,, THAT PETITION FOR VARIANCE N0.1477 BE GRANTED WHEREAS, the City Planning Commission of the City of Aneheim did receive a veriGed Petition for Veriance from MR. and MRS. H. D. ALDERDICE, 2654 Palais Road, Anaheim, California, pwner; NELSON-DYE CONSTRUCTION INC., 300 East Katella Avenue, Anaheim, California~ Agent of certain real prop- erty situated in the City of Anaheim, County of Orange, State of California as follows; Lot No. 20 in Tract 3104 and further described as 2654 Palais Road, Anaheim, California ; and WHEREAS, the City Plenning Commission did hold a pnbHc headng et the City Hell in the City of Aneheim on Mdy 28~ 1962~ si 2:00 o'clock P.M., notice of seud public heariag having been duly given as required by law and in accordance wlth the provislona of the Meheim Municipal Code, Chepter 18.68,to hear and considee evldence for and egaiast said proposed varience and to investigete and meke findings and recommendetions in connec- tion the~ewith; and ; ~ 9YHEREAS, said Commiesion, efter due inspection, investigetlon, and study made by itself end in its behalf, • end efter due consideration oE all evidence and zeports offered es seid headng, does find and determine the following facts: , I i 1. Thet the petitioner cequests e verience from the Aneheim MunicIpel Code: SeCtion 18.24.030 (3) to permit a three and one-half (3~)foot encroachment to construct an addition to residence on j subject property. 2. Thet there are exceptionel or extreordinery circumstencea or conditions appliceble to the property involved or to the intended use of the propecry thet do not epply genereliy to the property or cless of use in the seme vicinifry end zone. 3. That the requested veriance is necessery for the preaervation and enjoyment of a substentiel property right poaseased by other property in the eame vicinitr,~ end zone, and denied to the ptopedy in question. 4. Thet the requested varience wIll not be materially detrimet~tel to the publlc welfate or injurious to the pmp- edy or improvements in such vlcutity end zone in which the property is loceted. ~ 5.
