NHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Aaaheim oa
August 20~ 19629 et 2:00 o'clock P.M. notice of seid public heariag heving been duly given as requi:ed .bp
law end in accordance with the provisions of the Anaheim Municipal Code, Chepter 18.72, to hear and consider evideace
for end against said ptoposed reclassificetion end to investigete and meke Gndings ead recommeadations in connectioe
therewith; and ,
WHEREAS, said Commission, after due inspection, investigation, and study made by itself end in its behalf, and
efter due consideration of all evidence and ceports offered at seid hearing, does find and determine the following facts:
Y. Thet the petitioner proposes a reclassification oE the above descdbed pmperty from the R-A~ Residential ?
Agricultural~ Zone to the C-2, General Commercial, Zone to establish a hotel and apurtenant
facilities.
2. That the proposed re;:lassificatlon of subject property is neceasery and/or desirabla for the orderly ead pco-
per development of the commtulity.
3. That the proposed reclessiflcetion of subject property does properly relate to the zones and their peemittnd
uses locally esteblished in close proxlmity to subject property and to the zones aad their permitted uses geaecally estab-
liehed throughout the community.
4. That the proposed.rec,lassification of sub~ect property does~require dedication for
and standard improvement of abutting streets because said property does relate to and abut
upon streets and highways which are proposed to carry the type and quantity of traffic, which
will be generated by the permitted uses, itt accordance lHith the circi:lation element of the
General Plano
5. That the use as proposed at ti~e time the original petition an subject property ~vas
approved•by the Commission was assumed to be primarily for restaurant purposes only,•that the
cocktail 1~unge would be incidental to the serving of food, and that the ~.ouunission passed said
petition about t}uree months ago knowing that churches and schools were within six hundred (6Q0}
feet of sub~ect property but that it would be an action of the Alcoholic Beverage Control
Board to rule on the close proximity of said churchea and schools.
6. That no one from the nearby churches appeared•in opposition to subject petition.
7. That one person repxesenting two neighborhood organizations appeared in opposition
to sub~ect petitione

110W, THEREFORE, BE xT RFSOLVED thet Yhe Aneheim City Pleaning C mmission does hereby recommend

to the City Council of the City of Aneheim that subject Petition for Reclassi$cation be approved and, by so doing,
~ that Title 1&Zoning of the Anehetm Muaicipel Code be amended to exclude the above descdbed property fro the
R-A,.Residential Agricultural,. Zone.3nd to_incorporate said described property in the ~-2,

,~ 1. Dedication of fifty-three (53~.feet from the monumented centerline of Ball Road (20 feet
existing).
~i 2. PrepaFation of street improvement plans and installation of all improvements for Ball Road,
~ subject to the approval of the City Engineer and in accordance with the adopted standard plans
i on file in the off ice of the.City Engineero
3. Payment of $2v00 per front foot for street.lighting n~~oses on Ball Road.
4. Prov:sion of standard trash storage areas as determined by the Department of Public Works,
Sanitation Division, priur to Final Building Inspectiono
5. Installation of fire hydrants, as determined to be necessary by the City of Anaheim Fire
Department to provide adequate f ire protection.
6. Time limit~tion of one hundred eighty (180), days for the accomplishment of Item Nos. 1, 2,
3, and 10.
7,. Development substantially in accordance with Exhibit Noso 1, 2, and 3. '
8. Provision of s six ~6) foot masonry wall on the west, south and east property lines of sub-
ject proper•i.y, and with the provision of a forty-two (42) inch masonry u~all on the northerly ;
property line, except for those areas reserved for ingress and egress to subject property prior
to Final Building Inspection.
9. Installation of.plantinq in the proposed planting area abutting the planned highway right-of- `
way line of Ball Road, s~id landscaping plans to be submitted to an8 subject to the approval of
the Superintendent of Parkway Maintenance and to be installed prior to Final Building Inspection.;
10. Recordation of deed restrictio~s limiting the C-2 use of sub,ject•property to'bn sale" of ~
liquor in conjunction with the serving of food in the restaurant only, or any C-1 uses. j
