A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION ~OR CONDITIONAL USE PERMIT 287 BE GRANTED
WHEREAS, the City Planning Commission of the City of Meheim did receive u verified Petition for Conditional
Use Permit fmm CARL .KARCHFR~ .12U0 iiorth Harbor Boulevard, Anaheim, California~ Owner of cer-
tain real property situated in the City of Anaheim, County of Orange, State of California,
being the Westerly 260.00 f=et of the Southerly 239:66 feet of Lot 5 of Miles Rancho, per
map thereof recorded in Book 4, Fage 7 of Miscellaneous ldaps, records of Said County. NOI'Ee
For the purpose of this description the Westerly and Soucherly lines of said Lot 5 are
assumed to be the centerlines of Harbor Boulevard and Romneya Drive, shovm on said map as
unnamed streets adjoining sa~d Lot on the West and South

1YHEREAS, the City Planning Commisaion did hold a public hearing et the Clty Hell in the City of Aneheim on
August 20~ 1962 at 2:00 o'clock P.M., notice of said public hearing having been u'ul;y given ar required by
law and in accordence with the provisions of the Aneheim Municipel code, Chepter 18.6?, to hear and consider evidence
for end against said ptoposed conditional use and to iavestigate and meke findings end cecommendetions in connection
therewith; end
WHEREAS, seid Commission, atter due inspection, investigation, and study made by itself and in its behelf, and
after due conslderetion of all evidence and reports offeced at said headng, does find and determine the following facts:
1. Thet the proposed use is propeely one for which a Conditionel.Use Permit is authodzed by this Code, to
wit: establish a drive-in restauranto
2. Thet the proposed use will not edversely effect the adjoining lend uses end the growth and development of
t}:e erea in which it is p:oposed to be loceted.
3. Thet the slze and shepe of the.site proporsed for the use is edequate to uifow the full development of tbe
proposed usr in a manner not detdmental to the particular erea nor to lhe peace, health, safety, end generel welfere
of the Citizens of the City of Meheim.
4. Thet the gcanting of the Conditional Use Pemut under the conditions imposed, if eny, will not be detrimental
to the peace, heelth, eafety, and genewl welfece of the Citizens of the City of Aneheim.
5. That the t.raffic generated hy ths proposed use will not imp'ose an undue burden
upon the streets and highways designed and improved to carry the traff ic in the area.
6. That the proposed parking spaces as shown on Exhibit Noe 1 are hereby approved
under the authority granted in Codee Section 16o64v070e

NOW, THEREFORE, HE IT_RESOLVED that the Anaheim City Plenning Commission does hereby grant subject
Petition for Conditionel Use Pecmit, upon the following conditians which ace heceby found to be e necessary ~rerequisite ~

to the proposed use of the subject pcoperty in or6er to p:eserve the safety and general welfare of tF~e Citizens of the
City of A;~aheim: . ~
1. Dedication of forty-five (R5) feet from the monumented centerline of Harbor Boulevard, i
(30 feet existing)o
2. Payment of S2.OQ per front foot for street lighting purposes on Romneya Drive and
Harbor Boulevard.
3, Iristallation of sidewalks and driveways on Romneya Drive and Harbor Boulevard in
accordance with the adopted standard plans on file in the off ica of the City Engineer. i
4. Provision of standarci trash storage areas as determined by the Department of Public
Works, Sanitation Division, prior to Final Building Inspection.
5. TimF limitation of one hundred eighty (180) days for the accomplishmen;t of Item Nos. ~

6. D2velopment substantially in accordance with Exhibit hoso 1, 2, and 3, except that all
air condi~`ioning units shall be completely enclosed in order to shield the units from view i
from the street.
7. Inst~llation of treewells in the parkway portion of the Romneya Drive and Ha~bor
Boulevaxd rights-.of-way abutting subject property, plans for said landscaping to be
submitted to and subject to the approval of the Superintendent of Parkway kiaintenance, and 'S
said landscaping to be installed prior to Final Building Inspection. ~
