WHEREAS, the City Pienning Commission of the City of Aneheim did receive e verlEied Petition for Conditionel
Uae Permit from JAMES W. NICHTER, 1713 Poplar, Anaheim, California, Owners ,70HN D. VON DER
NEIDE, 924 North Euclid Street, Anaheim, California, Agent of certain real property.sit-
uated in the City of Anaheim, County of Orange, State of California, described as follows;
Lot No. 6 in Tract 1428, and further described as 102 Larch, Anaheim, California
; end
WHEREAS, the City Planning Commission did hold a public heering at the City Hell in the City of Aneheim on
October 1~ 1962~ at 2:00 o'clock P.M., notice of seid public hearing having been duly given as cequized by
lew and in accorde~;ce with the provisions of the Anaheim Municlpal code, Chepter 18.64, to heer end consider evidence
for and against seid proposed conditianel use ac~d to investigate end meke findings and recommendetions in connection
therewith; and
WHEREAS, said Commission, af~er due inspection, investigaUon, end study'made by itself end in its hehelf, end
efter due consideration of ell evidence end cepoets offered at seid hearing, does find and determine the following facts:
1. That the proposed use is properly one for which a Conditional.Use Permit is euthorized by this Code, to
wit: a day care child nurser.y for six or more children.
2. That the proposed use wili not edversely affect the adjoining lend uses end the g~owth end development of
the erea in which it is proposed to be located.
3. That the size and shepe of the site proposed for the use ia adequate to allow the full development ofthe
proposed use in a manner not detrimental to the particuler atea nor to the peace, health, safety, and general welfare
of the Citizens of the City of Anaheim.
4. Thet the granting of the Conditional Use Permit under the conditions imposed, if eny, will not be detrimentel
to the peace, health, safety, and generel welfare of the Citizens of the City of Anaheim.
5. That the traffic generated by the proposed use will not impose an undue burden
upon the streets and highways designed and improved to carry the traffic in the area.
6. That no one appeared in opposition to sub3ect petition. ~

NOW, THEREFORE, BE IT RESOLVED that the ';caheim City Planning Commission does hereby grant subject
Petition for Conditional Use Permit, upon the following conditions which ere hereby Eound to be a necessery prerequisite
to the proposed use of the subject pcopecty in order to preserve the safety end general welfere of the Citizens of the
City of Anaheim: •
1. Development substantially in accordance with Ezhibit Nos. 1, 2, and 3 as amended.
2. Provision of off-street parki. paces for two cars.
3. Construction of a six (6) foot masorry wall a~.ong the north boundary of sub3ect property
prior to Final Building Inspection.
4o Maintenance of landscaping as a condition of use.
5. All signs shall be limited to one sign with a maximum area of eight (8~. square feet.
6. Sub,ject to the writteq approval of the State Department of Social Welfare.
