WHEREAS, aeid Commiesion, efter due inspection, investigetion, and study mede by itself aad in its beh~lE, and
efter due consideration oE all evidence and repod6 offered at said headng, doee fiqd and deteemine the following.facte:
1. That the petitioner proposes a reclessification of the above deecribed pmpeety from t6e R-A~ Residential
Agricultural, Zor.e to the C-1, Neighborhood Cortm~ercial, 2one £or Parcel No. 1, to establieh
a neighborhood shopping facility, and to the R-3, Multiple Family Residential, Zone on Parcel
No. 2 to establish a planned unit multiple family residential deveTopment.
2. That the proposed reclessificetioa of •subject p~operty is neceseary and/or deeireble for the oiderly end pro-
per development of the community.
3. Thet the propoaed reclassiEicetton of aubject propedy does propeely relate •to We zoaes end their permitted
uses locally established in cloae proximity to subject propecty and to the zones end their permitted usee geaerally eateb-

4. That the proposed.reelassification of subject property does xequire dedication
for and standard improvement of abutting streets because said property does relate to and
abut upon streets and highways which are proposed to carry the type and quantil;y of traffic,
which will be generated by the p~rmitted uses, in accordance with the circulation element of
the General Plan. ,
5. It is recommended to the petitioner that revised plans, incorporating all applicable
conditions of approval, be presented to the City Council.
6. That two persons appeared in conditional opposition to subject petition, but the
opposition was subsequently withdrawn.

recommend to the City Council.of the City of Anaheim that.subject Petition for Reclassification
be approved and,,by so doittg, ~that Title 18-Zoning of the Anaheim Municipal Code be amended
to,exclude the above describ~d property from the R-A, kesidential Agr.icultural, Zone and to
incorporate said described property in the G 1, Neighborhood Cotmnercial, Zone for Parcel
Noo '1 and R-3y Multiple Family Residential, Zone for Parcel I~a. 2 upon the following conditions
which are hereby found to be a necessary prerequisite to the proposed use of the subject
property in order to preserve the safety and general welfare of the Citizens of the City of
Anaheimo
1< Dedication of Fifty-three (53) feet from the monumented centerline of Magnolia
Avenue (50 feet existing).
2o Installation of sidewalks and driveways on Magnolia Avenue and Winston koad in
accordance with the adopted standard plans on file in the office of the City Engineer.
3o Payment of $2000 per front foot for street lighting purposes on Magnolia Avenue and
Winston Road or installation of street lights on Magnolia Avenue and Winston Road in accord-
ance with,a street lighting plan approved by the Director of Public Utilities.
4. Payment of a Park and Recreation Fee of $25.00 per dwelling unit to be collected as
part of the Building Permito
5a Provision of standard trash storage areas as determined by the Department of Public
Works, Sanitation Division9 prior to Final Building Inspection of both the Multiple Family
and Coromercial developmentso
6o Installation of fire hydrants, as determined to be necessary by the City of Anaheim
Fire Department, to provide adequate fire protection.
7a Sub3ect to the approval n:° Petition for Conditional Use Permit No. 330.
8. Dedication of a proposed cul-de-sac stub, said stub to be a sixty-four (64) foot
right-of-way with a paving width of forty (40) feet curb to curb. The property line radius
shall be fifty (50) feet and curb radius shall be thirty-eight {36) feet.
9~ Dedication of first alley north of Winston Road which shall be twenty (20) feet wide
and shall be located as shown on Exhibit No. 1.
10. Dedication of the alley around "Section B", which shall be twenty (20) feet wide,
with ten (10) foot cutoffs, and which shall be located within the perimeter drive with aIl
excess width being ad3acent to the garages.
lla Preparation of improvement plans and installation of all improvements for the
cul-de-sac street northerly of Winston Road and alleys as indicated in Condition Nos. 9 and 10,
sub~ect to the approval of the City Engineei and in accordance with the adopted standard plans
on file in the office of the City Engineer.
12o Time limitation of one hundred and eighty (180) days for the accomplishment of
Item Noso 19 2, 3, 9 and 10,
13a Provision of a f ive (5) foot public utility easement along the northerly and
easterly boundary of the subject prcperty to adequately serve the sub3ect,property and
other properties, at the time of the installation of the service facilities.
14o Construction of a six (6) foot masonry wall between the proposed C-1, Neighborhood
Commercial, Zone and the R-39 Multiple Family Residential, Zone to prohibit ingress and
egress between the two developments~
15. Detachment of the proposed trash storage areas from the garages or fire proof
construction of said trash storage areaso
16~ Provision of six (6) foot masonry walls along the east boundary.of sub3ect property
where garages do not abut said property line.
17~ Reduction of the proposed_.commercial..floor area to meet Code,parking requirements
in order to provide a periphery drive around.the.c~mmercial deve2opment.
18n Revision of building "C" apartments to provide a minimum seven hundred (700) s~+iare

21o Identification of the materials to be.used on.the.elevations, in addition to
