THAT PETITION FOR VARIANCE NO. 1543 BE DENIED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance fcom
FORTUNA"PO.R..MARTINEZ~ 506 East Cypress Street, Anaheim, California, Owner; ALBERT HELLER,
10650 Beach Boule.vard, Stanton, Ca13f.ornia, Agent of certain real property situated in the
City of. Anaheim, County of Orange, State of Cali.fornia, described as Lot No. 7 and 8, Block 4,
of the Santa Fe Tract, and ~urther described as 506 East Cypress Street, Anaheim, California

WHEREAS, the City Plenning Commission did hold a public headng at the City Hall in the City of Anaheim on
January 7~ 1963~ et 2:00 o'clock P.M., notice of seid public hearing having bem duly given as :equired by
law andin eccordence withthe provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for
nnd against said proposed veriance end to investigete and meke finding's and zecommendetions in connection the:ewith;
end
WHEREAS, said Commission, after due inspection, investigetion, and study made by itself and in its behelf,
end after due cortsideration of all evidence and reports offered es said hearing, does find and detecmine the following
fects:
1. Thet the petitioner cequests a verience from the Anaheim Municipal Code: Section 18.32.030~ which
requires that buildings fro~t to rear shall be separated by a distance of twenty (20) feet;
Section 18.32.100, which requires that garages shall be located not less than fifteen (15)
feet from the centerline of an abutting alley; and Section 18.80.080, which requires that
the minimum livable floor area shall not be less than 1,225 square feet, to permit the
construction of a single family dwelling unit on the rear of subject property a distance of
eighteen (18) feet from an existing single family dwelling on the front portion of subject
_ property, having a garage located eight and one-half (8~-) feet from the centerline of the
abutting alley, and containing 935 square feet.
2. That the construction of a substandard size dwelling unit without adequate rear
yard setback would be incompatible with the units under construction to the east of subject
property.
3. Thai: one person appeared in opposition to subject petition.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim CiEy Planaing Commission doea heieby deny subject
Petition for Varieace on the basis of the eforementioaed findings.
