WILLIAM C. 0'RIELLY~ 417 North Harbor Boulevard, Anaheim, California, Owners; RICHARD LAYNE TOM~ A.I.A.~ 1665 West.Katella Avenue, Anaheim, California, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; end WHEREAS, the City Plenning Commission did hold a public hearing at the City Hell in the City of Aneheim on January 21 ~ 19639 at 2:00 o'clock P.M., notice of said public hearing having been duly given as cequiced by law and in accordence with the pcovisions of Lhe Anaheim Municipal Code, Chaptec 18.68,to hear and considec evidence for and against said ptoposed va~iance and to investigate and make findings and recommendations in connec- tion therewith; end WHEREAS, seid Commission, after due inspectioa, investigation, and study made by itself end in~ its behelf, and after due consideretion of ell evidence end cepo:ts ofEered as said hearing, does find and detecmine the following facts: 1. That the petitioner requests a variance from the Anaheim Municipal Code: Section 18.40.020~ which stipulates that the structural height of any building constructed in the C-1, Neio,hborhood Commercial, Zone shall not exceed two and one-half stories or 35 feet, i:o permit the estab- 1_shment of a three-story professional office building not to exceed fifiy l~~j iee~ iii height on sub~ect property. 2. That there are exceptional or extraordinary circumstences or conditions applicable to the pcoperty involved or to the intended use of the p:operty that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the :eq~ested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in tIie seme vicinity and zone, and denied to the ptopecty in question. 4. That ihe requested veriance will not be materially detrimental to the public welfare or injurious to the pmp- ecty or imp:ovements in such vicinity and zone in which the pcoperty is located. 5. That the requested varience will not adversely affect the Compcehensive General Plan. 6.
