A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0.1544 BE DENIED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition fot Variance from
DALE FOWLER, 1417 North Ross, Santa Ana, California, Owner of certain real property situated
in the City of Anaheim, County of Orange•, State of California described as PARCEL N0. 1: I.ot
2 of Tract No. 787, as per map recorded in book 24 page 9 of Miscellaneous Maps, in the office
of the county recorder of said county. PARCEL N0. 2s An undivicied 1~20th interest in that
portion of Lot No. 10 of Tract No. 787, described as follows: Beginning at the northwest
corner of I.ot lOz thence.easterly along the north line of said lot a distance of 50 feet; thence
at right angles southerly a.distance of 25 feet; thence at right angles to the west margin of
said lot, a distance of 50 feet; thence north to the point of beginning~ and being appurtenant
to Lot 2 above described

WHEREAS, the City Planning Commission did hoid a public hearing at the City Hall in the City of .<inahr.i-.: r<~
January 21, 1963, at 2:00 o'clock P.M., notice of said public hearing having been duly given a<_ :.c~~isrey ~,-
law end in eceocdance with the provisions of the Anaheim Municipel Code, Chapter 18.68, to hear and consider eyic:4: ;. ~, t..L
and egainst said proposed variance end to investigate and make finding's and recommendations in connection ;' -Y' ;,
and
NHEREAS, seid Commission, after due inspection, investigetion, and study made by itself and in ics :;ehalf,
and efter due consideration of all evidence and reports offered as said hearing, does find and determine 4he following
facts:
1. That the petitioner requests a variance from the Aneheim Municipel Code: Section 1R.~2.060~ which
limits the structural height of any building on subject property to one story, to establish
a two--nine-unit two-story apartment building on subject property.
2. That there are no exceptional or extTacrdittary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not apply generaliy
to the property or class of use in the same vicinity and zone.
3. That the requested variance is not necessary for the preservation and enjoyment of
a substantial praperty right posses=_ed by other property in the same vicinity and zone, and
denied to the property in qu2stion.
4. That the requested variance would be incompatible to the development of property
which is in close proximity to single family development, and that Anaheim Municipal Code
requires single story within one hundred fifty (150) feet on any single family residentiai
dwelling.
5. That cne person appeared and a telegram signed by two persons was received in
opposition to subject petition.
