THAT PETITION FOR VARIANCE NO. 1547 BE GRANTED

WHEREAS, the City Planning Commission of the Clty of Aneheim did receive a verified Petition Eor Variance
from EMIL Eo MAZANEC, 1302 Y~est Center9 Anaheim, Ca'liforniay Owner of certain real property
situated in the Citp of Anaheim, Couniy of Orange, State of California, described as Lot
Noo 2 in the Eygabroad Tract, and furthe.r described as 1302 West Center St•reet, Anaheim,
California

WHEREAS, the City Plenning Commi~sion did hold a public heering e~ tha City Hell :a the City of Aneheim
on Februar.y 4~ '1963y at 2:00 o'clock P.M., notice of seid public hearing having been duly givert es required
by law and in eccordence with the provisions of the Aneheim Municipel Code, Chepter 18.68,to hear and consider
evidence fcr end egainst said p~oposzd variance and to investigete end make findings and recommendntions in cannec-
tion therewith; and
WHEREAS, seid Commission, efter due inspection, investigation, and study made by itself end in its behalf,
end after due consideration of all evidence end ceports offered es said heering, does Eind and determine the following
fects:
1. That the petitioner:equests a varience from the Aneheim Municipal Code: Section 18.40a010 which stipu-
;~ lates permitted uses in the G2, Genei•al Commercial, Zone; Section 18032.080 (2),
;~ which requires a 7~ foot sideyard; and Section 18,.32„010, which prohibits ingress and egress
from the abutting street, to establish a t~!o-story f ive unit apar•tment building with a westerly
five foot sideyard and one garage having access to Centsr Street o^ ~ubject property.
2. Thet there are exceptionel or extraordinary circumstances or conditions applicable to the p:opecty involved
~; or to the intended use of the property thet do not epply generelly to the proFerty or cle~;s of use in the seme vicinity

NOW, THEREFORE, BE IT RESOLVED i.hat the Anuheim City Pienning Commission does hereby grant subject
Petitlon for Variance, upon the following conditions which are hereby found to be a necessery p:ecequisite to the pro-
posed use of the subject property in order to preserve the safety and generel welfere oEthe Citizens oEthe City of
Mehelm.
1. Payment of a Park and Recreation Fee of $25.00 per dwelling unit to be collected
as part of the Building Permito
2. Provision of standard trash storage areas as determined by the Department of
?ublic Works, Sanitation Division, prior to Final Building I~spection.
3. Payment of $2,.00 per front foot for street lighting purposes on Center Street.
4e Time limitation of one hundred and eighty (180) days for the accomplishment of
Item No. 3.
5. pevelopment substantially in accordance with Exhibit Nos. 1, 2, and 3 as amended
herein.
6o Relocation of the proposed stairway from the second floor so as not to encroach
into the required easterly side yarda
7. Sub3ect to the reclassification of sub~ect property to the R-3, Multiple Family
Residential, Zone prior to Final Building Inspection.
