PANNIER, 1650 West Ball Road, Anaheimy California, Owner; MORT GREENy 600 North Euclid, Suite 645y Anaheim, California, Agent of certain real property situated in the City of Anaheim9 County of Orange, 5tate of California, described as that portion of Lot No. 25 of the Anaheim Investment Company's Tract, as shown on a map tiiereof recorded in book 7, pages 33 and 34, Miscellaneous Maps, records of said Orange County, more particularly described as followss Beginning at the Northwest corner of said Lot No. 25 (said corner also being the intersection of Ball Road and Euclid Avenue) thence along the North line (IIall Road) of said Lot No.. 25, North 89° 26' 50" East 657a23 feet to a point, said point also being the Northeast corner of said Lot No. 25 (also being the intersection of Ball Road and Palm Lane) thence along the East line (Palm Lane) of said Lot No. 25Y South 0° 00' 50" westy 671.47 feet to a point; said point also being the Southeast corner of said Lot Dfoo 25, thence along the South line of said Lot No. 25, South 89° 34' 27" Westy 657005 feet to a point; said point being the Southwest corner of said Lot No. 25 (also being the intersection of Pa1m Lane and Euclid Avenue) thence along the west line (Euclid Avenue) of said Lot No 25 North 670.02 fee~ to'the true point of beginning; EXCEPTING THEREFROM the North 200.00 feet of the West 200.00 feet; and WHEREAS, the City Planning (:ommission did hold a public hearing at the City Hall in the City of Aneheim on February 4~ 19639 at 2:00 o'clock P.M. notice of said public hearing having been duly given es required by law and in eccordance with the provisions of the Maheim Municipel Code, Chapter 18.72, to heer and consider evidence for end egeinst said pioposed reclassification end to investigate and make findings and :ecommendations in connection thetewith; and WHEREAS, said Commission, after due inspection, investigation, and study mede by itself and in its behelf, and after due consideretion of all evidence and reports offered at said hearing, does find and determine the following fects: 1. That the petitioner proposes a reclessificetion of the above described property fcom the R-Ay Residential Agricultural, Zone to the R-3, rvfultiple Family Resideitial, Zone to permit the establishment of a two-story planned-unit multiple family residental development. 2. That the proposed rer.lessification of subject property is necessery end/or desireble for the orderly and pro- per development of the community. 3. That the proposed :eclessification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones end their permitted uses generally esteb- lished throughout the community. 4. That the proposed reclassification of subject property does not require dedication foi and standard improvement of abutting streets because said property does relate to and abut upon streets and highways which are proposed to carry the type and quantity of traffic which will be generated by the permitted uses, in accordance with the circulation element of the General Plan. 5. That the Commission recoimnends to the City Council that every effort be made to allow the palm trees on Palm Lane to remain, by the petitioner resolving with the Fngineering L~e.partment, the best location for curbs, gutters, and sidewalks to maintain the proper street width and still preserve the palm trees in their present location. 6. That one person appeared in opposition to subject petitiona Rl-A -1_ ~ _~. -° . - . . ,?a~~ n • ~ _ ~, ~ ~~J NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Planniag Commission does heceby cecommend to the City Council of the City of Anaheim thet subject Petition for Reclassification be epproved end, by sa doing, thet Title 1&Zoning of the Anaheim Municipal Code be emended to exclude the above described properry from the R-A, Residential Agricu'ltural, Zone and to incorporate said described property in the R-3, Multiple Family ResidentialY Zone upon the following conditions which are found to be a n~cessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the citizens of the City of Anaheim~ 1. Preparation of street improvement plans and installation of all improvements for Palm Lane, subject to the approval of the Ci±y Engineer and in accordance with the adopted standard plans ~ on file in the office of the City Engineer~ 2. Installation of sidewalks and driveways on Ball Road and Euclid Street in accordance with the adopted standard plans on file in the office of i:he City Engineer~ 3. Paymeit of $2~00 per front foot for. street li.ghting purposes on Bail Road, Euclid Street and Palm Lane, or i.nstallation of street lights on Ball Road, Euclid Street and Palm Lane, in accordance with a st.reet lighting plan approved by the Director of Public Utilities~ 4. Payment of a Park and Rec:r.eation Fee af $25,.00 per dwelling unit to be collec±ed as part of t'he Building Permit~ 5. Provision of standard trash storage areas as dete•rmined by the Department of Public Works, Sanitation Division9 prior to Final Bui'ldirig Inspection., 6. Installation of fire hyd•rants, as dete:rmined to be necessary by the City of Anaheim Fire Department, to provide adequate fire protectiono 7. Access drives shall be a minimum of 21 feet in width with~adequate angle cut-offs provided, or a minimum of 28 feet in width if no cut-offs a•re provided and, in all casesy shall have a minimum vertical clearance of 14 feet~ 8. Subject to the approval of Petition for Conditional Use Permit No~ 362. 9. Time limitation of one hundred eighty (180) days for the accomplishment of Item Nos„ 1, 2, and 3~ 10.
