BE APPROVED WHEREAS, the City Planning~ ~Commission of the City of Anaheim did receive a verified Petition for RecIessifica- tion£rom ARI'HUR and EIAISE HpRMpN, WILLIAM A. and LUCILLE E. HAyNES, RALPH F. HARIIT.~, and JAMES WESTRUM, 2139-C West Ball Road, Anaheim, California, Owners; J. RICHARD HUFFMAN, 2139-C West Ball Road, Anaheim, California, Agent o£ certain real property situated in the City of Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and rei~rred to herein as though set forth in full ; and WHE~'EAS, ;he City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on February 18~ 1963~ at 2:OU o'clock P.M. notice of sn;d public heacing heving been duly given as cequired by law ar,d in accordance with the provisions of the Ms;'~eim Municipal Code, Chaptec 18.72, to hear and consider evidence for and against said pioposed reclessificetion and to investigate and make findings and rernmmendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigatior, and study made by itseif and in its behalf, and e$er due consideration of all evidence and reports offered at said hearing, does flind and determine the foilowing facts: 1. That the petitioner proposes a reclassification of the above described property from the R-A~ Residential Agricultu:al, Zone to the R-3, Multiple Family Residential, Zone on Portion '°A" and to the C-1, Neighborhood Commercial, Zone on Portion "B", to establish a two story planned us~it multiple family residential development on Portioc "A° and a commercial building on Portion ~~ B~~ ~ 2. Thet the proposed reclassification of subject property is necessary and/or desirable for the orderly and pra per development of the commwity. 3. That the proposed reclessification of s;ubject p:opedy does pmperly relate to the zones and their pem~itted uses locelly established in close proximity to subje~t property and to the zones and their permitied uses generally estab- lished throughout the community. 4e That the proposed reclassification of subject property does not require dedication for and standard improvement of abutting streets because said property does relate to and abut upon streets and highways which are proposed to carry the type and quantity of traffic, which will be generated by the permitted uses, in ac~ordance with the circulation element of the General Plano 5. That two persons appeared in opposition to subject petition, one of whom presented a patition signed by thxrty-four (34) persons. . ~ i.. -..i., T . I ~ ' J .=~' , ~ ~ ~: + ~ ~x I ' ~ i / t,-,} ; ~ NOW, THERERTHE9 BE IT AESOLVID that the Anaheim City Planning Commission does heret,y recom- j mend to the City Council o: the City of Anaheim that subject Petition for Reclassification ' be approved and, by so doing, that Title 18-Zoning of the Anahei.m Municipal CodE be amended to c~-~lude the above described property from the R-A, Residential Agricultural, Zone and to incor,;orate said described property in the R-3, Multiple Family Residential, Zone on Portton "A", and C-1, Neighborhood Commercial, Zone on Portion "B" upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in nrder to preserve the safety and general welf are of the citizens of the City of Anaheima lo Preparation of street i.mprovement plans and installation of all improvements for Lincoln Avenue, suhjec•t to the approval of the City"Engineer and in accordance with the adopted standard plans on f ile in the office of the City Fngineer. 2o Payment of $2s00 per front foot for street lighting purposes on Lincoln Avenueo 3< Provision of a three (3) foot overhang easement along the easterly, westerly, and southerly ' boundaries of the sub3ect property to adequatiely serve the subject property and other proper- ties, at the time of the installation of the service facilities. ' 4o Payment of a Park and Recreation Fee of $25s00 per dwelling unit to be collected as part of the Building Permita 5o Provision of standard trash storage areas as determined by the Department of Public Works, Sanitation Division, prior to Final Building Inspection. 6o Installation of fire hydrants, as determined to be necessary by the City of Anaheim Fire Department, to provide adequate fire protectione 7, Access drives shall be a minimum of twenty-one (21) feet in width if adequate angle cut- offs are provided, or a minimum of twenty-eight (28) feet in width if no cut-offs are pro- vided, and, in all cases, shall have a minimum vertical clearance of fourteen (14) feet. 8o Subject to the approval of Petition for Conditional IIse Permit No~ 373. 9~ Time limitation of one hundred eighty (180) days for the accomplishment of Item Noso 1, 29 and 30 10, Provision of shake roofs for all buildings proposed for subject property. 11. Construction of a six (6) foot masonry wall along the south and east property lines where subject property abuts single family development, prior to Final Building Inspection. 12. Provision that all drainage from the proposed carports or its equivelent construction on the rear property line shall be directed away'from the single family development. 13o Provisian that the interior walls of the proposed carports shall be stuccoed, that enclosed storage cabinets shall be provided along the rear wall of each carport, and that adequate bumper guards shall be provided to protect the interior wall of the propo~ed car- ports from damagee 14. That deed restrictions be filed limiting the use o£ the commercial development.to business and professional uses only. 15o Provision of a six (6) foot landscaping strip abutting the setback on the Lincul.n Avem~e frontage, plans for said landscaping to be submitted to and subject to the approval of the Superintendent of Parkway Maintenance, and said landscaping to be installed prior to Final Building Inspectiono 16. Provision of a thirty-five (35) foot setback from the planned highway right-of-way of Lincoln Avenueo 17o Installa±ion of tree wells at forty (40) foo~L intervals in the parkway portio.^, of the Lincoln Avenue frontage, plans for said landscaping to be submitted to and subject to i:he approval of the Superintendent of Parkway Maintenance~ and said landscaping to be installed prior tQ Final Building Inspectiono 18a Development svbstantially in accordance with Exhibit Nos. 1, 2, and 3 except as amended herein, shall be subject to Development Review approvalo THE FOREGOING RE50LUTION is signed and approved by me this 18th day of February, 1963.
