M~GAU(~iY, 2966 West Lincoln Avenue, Anaheim, California~Agent of certain real property situated in the City of Anaheim, County of Orange, State of California as described in Hxhibit 'A" attached hereto and referred to herein as though set forth in full ; and WHEREAS, the City Planning Commission did hold e public heering et the City Hall in the City oE Aneheim on April 1, 1963 at 2:00 o'clcck P.M., notice of caid public hearing having been duly given as required by law end in accordence with the p~~visions of the Meheim Pdunicipel Code, Chapter 18.68,to hear and consider evidence for and egainst said proposed variance and to irevestIgete and make findings end cecommendations in connec- tion therewlth; end WHEREAS, said Commission, after due ir.spection, investigation, end study made by itself and ia its behalf, and after due consideration of all evidence and cepods offered as said hearing, does find and detecmine the follov~ing facts: 1. Thet the petitioner requests a varience from the Anaheim Municipal Code: Section 18.320 060~ which limits the st•ructu:ral height to one story, and Section 18032~09~, which requires the construction of a six (6) foot masonry wall along the eastern boundary to permit the establish- ment of a two-story mu'ltiple family subdivision without a six (6) foot masonry wall on the east boundar.y of subject property~ 2. That there ece exceptional or extrao:dinary circumstences or conditione appliceble to the property involved or to the intended use of the property that do not epply genzrally io the property or class of use in the same vicinity end zone. 3. Thet the cequested variance is necessery for the preservation and enjoyment of a substentiel property right possessed by other pcoperty in the seme vicinity and zone, and denied to the property in question. 4. Thet the requested variance will not be meterielly detcimentel to the publlc welEate or lnjurious to the pmp- erty or improvements in such vicinity and zone in which the property is loceted. 5.
