't WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Pe'ltion for Varience
~! from AR1V0 H. STOVAI.L, 1771 Monita Drive, Ventura, California, Oivner; RUSSELL JAY and/or
; M. L. A1~GAUGHY, 2966 West Lincoln Avenue, Anaheim, California, Agents of certain real
~' property situated in the City of Anaheim, County of Orange, State of California, described
as; The Northeast q¢arter of the Northeast quarter of the Northwest quarter of Section 14,
To•,vnship 4 South, Range 11 West, in the Rancho Los Coyotes, as shovm on a Map recorded in
Book 51, page ll of Miscellaneous Maps, Records of said County; and also shoum in Book 36,
page 22 of Records of Surve•y, Records in the Office of the County Recorder of said County,

WHEREAS, the City Planning Commission did hold a public hearing et the City Hall in the City of Anaheim
on April Y, 1963 ' at 2:00 o'clock P.M., notice of said public hearing having been duly given as required
by law and in acrnrdance with the pcovisions of Yhe Anaheim Municipal Code, Chapter 18.68,to hear and consider
evidence for and against seid proposed variance und to investigate and make findings and recommendations in connec-
tion therewith; and
WHEREAS, said Commission, eEter due inspection, investigation, and study made by itself end in its behalf,
and after due consideretion of all evidence and ceports offered as said heering, does find and detecmine the following ~
Eacts:
1. That 4he petitioner requests a varience from the Anaheim Municipal Code: Section 18e32.060~ which '
limits the structural height on any property to one story within 150 feet of R-A, Residential '
Agricultural, zoned property, and Section 18~32~090, which requires the construction of a six 'F
(6) foot masonry wall along the.north.boundary line of subject property to permit the establ3sh-
ment of a two-story multiple family residential subdivision without a six (6) foot masonry wall
on the north and south boundaries of subject propertya ;
2. That thece are exceptional or extreordinary circumstences or conditions appliceble to the property involved
or to the intended use of the propesty that do not apply generally to the property or class of use in the.same vicinity
and zone.
3. That the requested variance is necessary for the preservation and enjoyment of a substentiel property right
possessed by other property in the seme vicinity and zone, and 8cniad to the property in question.
4. That the requested va:iance will not be materielly detrimentel to the public welfate or injurious to the prop-
erty or impmvements in such vicinity end zone in which the property is located.
5. That the cequested variance will not edversely affect the Comprehensive General Pien.
6„ That one pe.rson appeared in oppositivn to subject petition.

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby grant subject
F'etition for Verience, upon the following conditions which ace hereby found to be e necessery precequisite to the pro-
posed use of the subject pcoperty in order to preserve the sefety and general welfe:e of the Citizens of the City of
Anaheim.
lo Subject to the reclassification of subject property to the R-3, Multiple Family
Residential, Zone as approved and completed under Reclassification No. 62-63-96.
THE FOREGOING RESOLUTION is signed and approved by me thi day of April, 1963.
