Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and
referred to herein as though set forth in full
; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Aneheim on
April 15~ 1963, at 2:00 o'clor}: P.M., notice of said public heatIng having been duly ~ven as required by
1~ ~ in ~ce with the provisions of t3~e Aaeheim Municipal Code, ~hepter 18.65, to hear and consider evidence for
aad ageiast said proposed variaace aad to investigate and meke finding's and recommendations in rnnnection therewith;
and
WHEREAS, said Commissioa, after due inspection, investigation, and study made by itself and in its behalf,
and aftcr dne considerat:on of all evidence und ceports off'eced es seid hearing, does find end determine the following
facfs:
1. That the petitioaer requests a variaace from the Anaheim Municipul Code: Sectiott 18.2Q.010, which
stipulates permitted uses in the R~, Residential Subuxban, Zone, Section 18.20.030 (4-a),
which requires that R-0 lots shall have a minimum width of ninety (90) feet, and Section
18020,030 (4d), which requires that any dwelling unit established on en R-0 parcel shall
have a minimum livable floor area of not less than 2000 square feet, to ermit the division
of subject property into two parcels, each having less tnan a ninety (90~ foot frontage and
to permlt the construction of a triplex on the proposed easterly half of sub3ect property,
each dwelling unit ther~in containing less than 2000 square feet of livable floor area.
2o That the proposed lot s~lit would be incompatible with the residential surburban
development in the area.
3o That there are nQ exceptional or extraordinary circumstances or conditions
zpplicable to ihe property involved or to the intended use af the property that do not apply
generally to the property or c2ass of use in the same vicin3ty and zone.
4o That the requested variance is not necessary for the Freservation and enjoyment
of a substantial prnperty right possessed by other property in the seme vicinity and zone, and
denfed to the praperty in question.
5. That the requested variance will adversely affect the Comprehensive General Plano
6. That insufficient development plans were submitted to substantiate the request
for the establishment of dwelling units containing less than 2000 square feet.
7. That three persons appeared representing twenty-five (25) persons in the Council
Chamber, and a petition signed by seventy-nine (79) persons was received in opposition to
subject petition.
