E. Wo and ROBERT S. BARNES9 310 Emerald Bay, Laguna Beach, California, Owners; '-.~ ROBERT S. AARNES, 1016 Noxth Broadway, Santa Ana, California, Agent of certain reai ~~ property situated in the City of Anaheim, County of Orange, State of California, as ~ described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; end WHEREAS, the City Planning Commission did hold a public hearing et the City Flall in the City of Anaheim on April 29, 1963, at 2:00 a'clock F.M., notice of said public heering heving 6een duly given es requi:ed by law end in accordence with tfie provisions of the Anaheim Municipal Code, Chapfer 18.68,to hear end consider evidence for end ageinst said proposed variance and to investigate end meke findings and recommendations in connec- tion therewith; and WHEREAS, said CommissIon, after due inspection, investigetion, aad study made by itself end in its behelf, end aEter due consideration of all evidence and reports offered as seid hearing, does find and dete:mine the following facts: 1. That the petitioner re~uests a va:iance fmm the Anaheim Municipel Code: Section 18032.080 (3) ~ which requires a rear yard of not less than twenty-five (25) feet in depth and Section 18032.120, which requires 1-~ garages per dwelling unit, to permit the establishment of an apartment building with carports~ " 2. That thece are exceQtional or extrao~dinery ciccumstences or conditions appliceble to the prope~ty involved or to the intended use of the property that do not apply generally to the pmperty or ciess of use in the same vicinity and zone. 3. ~'het the :equested variance is necessary foe the pceservation and enjoyment of e substantial property right possessed by other property in the seme vicinity and zone, end denied to the propecty in question. 4. Thnt the requested varience will not be materially detrimentel 4o the public welfate or injurious to the prop~ erty or improvements in such vicinity and zone in which the propedy is located. 5. That the requested varience will not adversely aff~ct tne Comptehensive General Plan. ', 6.. Development substantially in accordance with Exhibit Nos. 1 through 4. ~ 2. Subject to the reclassification of subject property to the R-3, Multiple Family I~ Residential, Zone as approved and completed under Reclassification No. 62-63-2. 3. Provision that the rear and side walls of the proposed carports shall be stuccoed, enclosed storage cabinets shall be provided at the rear wall of each carport, and that ' ~ adequate bumpex guards shall be provided tb protect the interior wall of the proposed carports from clamage.
