duly given as requir~d by law and in accordance wit:~ the provisions of the Anaheim Municipal
Code' Chapter 18~689 to hear and consider evidence for and against said proposed variance and
to irrvestio,ate and make findings and recommendations in connection therewith; and
NlHEREAS9 said Commission9 after due inspection9 investigation, and'study made by itself .
and in its behalf, and after due consideration of all evidence and reports offered at said
hearing9 does find and determine the following factsa
la That the petitioner requests a variance from Ordinance Noe 13339 which *equires that
any construction on sub3ect p•roperty be of masonry or similar fire resistant material9 and
from Commission Resol.ution Noo 551, Series 1962-639 under which Variance Noa 1523 was approved
in accordance with plans9 to permit the construction of a frame and stucco ranch style
service station on sub9ect property wi•ih a relocation of driveways and block wall constructiono
2o That there are exceptional or extraordinary circumstances or conditions applicable
to the proper.ty involved or to the intended use of the property that do not apply generally
to the property or class of use in the same vlcinity and zoneo
3o That the requested variance is necessar,y for the preservation and en3oyment of a
substantial property right possessed by other property in the same vicinity and zone9 and
denied to the proper+,y in questiono
4o That the requested variance will not be materially detrimental to the public welfare
or injurious to the Froperty or improvement;s in such vicinity and zone in which the property
is locatede
5o That the requested variance will not adversely affect the Comprehensive General Plano ~
6o That it is hereby recommended to the City Council that Ordinance Noe 1333 be amended 7
to permit the proposed service station constructiono ~
