RESOLUTION NO, 861, SERIES 1963•-64 1~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. '1594 BE GRANTED WHEREAS, the City Planning Commission of the City of Anehelm did receive a verified Petition for Variance from CHARENCE Wo & IDALEP. Ro BACKUS9 537 Sherwood Drive9 Anaheim, California9 Owners; FRED Co LANE9 710 South Raitt, Santa Ana, California, A~ent of certain real property situated in the City of Anaheim, Count~v of Orangey State of Californiay described as the Southerly 15 feet of Lot Noo 28 and aIl of Lot No~ 29, Block A of Lairds Subdivision, ar.d further described as 417 South Melrose,9 AnaheimY California . ; and WHEREAS, the City Plenning Commission did hold e public heerine at the City Hall in the City of Anaheim on August 59 1963y at 2 00 o'clock P.M., notice of said public heering having been duly given es re~uiced by lew and in eccordence with the p:ovisions of the Anaheim Municipal Code, Chepter 18.68,to hear and consider evidence Eor and egainst said proposed veriance and to investigate and make findings and recommendetions in connec- tion therewith; end WHEREAS, seid Commission, after due inspection, investigation, and study made by itself and in its behaif, end efter due consideration of all evidence and ceports offered as seid hearing, does find and determine the following facEs: 1. Thet the petitioner cequests a varience from the Anaheim Municipal Code: Section 18~800080 which requires a minimum livable floor area of 1225 square f'eet, to permit the construction of an additional 810 square feet singie-•femil.y dweTling with a ten (10) foot buildi.ng seNara-~ tion~ and a five (5) foot side yard on the sea~ of s•ubject propertya 2. Thet thece a:e exceptional or extraordinary ciccumstences or conditions appliceble to the propecty involved or to the intended use of the pcoperty that do not epply generall~ to the property or clase of use in the seme vicinity and zone. • 3. That the cequested varience is necessery for the preservation and enjoyment of a substential property right possessed by other property in the same vicinity and zone, and denied to the propecty in question. 4. Thet the :equested veriance will not be meterially detrimentel to the public welfate or injurious to the prop- eriy or imp:ovemenis in sucn viciniiy and zone in wnictt iae property is Iocaied. ~ 5.
