WHEREAS, the City Ylenning Commission did hold a public hearin~; at the City Hall in the City of Aneheim on
AugUSt 5~ 1963~ at 2:~0 o'cloch P.M. notice of said public hearing having been duly given es required by
la,w and in accordance with ffie pcovisions of the Anaheim Municipal Code, Chepter 18.72, to hear and consider evidence
for and egelnst seid ptopcsed reclassification end to investigate and meke findings and cecommendetions in connection
the:ewith; and
WHEREAS, seid Commission, efter due inspection, investigetion, end study made by itself and in its behelf, and
after due considec3tion of all evidence and repo:ts offered at seid hearing, does Eind and determine the following fects:
1. Thet the petitionee proposes a reclassification of the ebi~ve desccibed property from the R-A9 Residential
Agricultural, Zone, to the R-3, Multiple Family Resident9.a1, Zone to permit the establish-
ment of a two-story apartment building with carports on :~ubject propertya
2. Thet the proposed reclessificetion of subject p:operty is necesssiry end/or desirable for the orderly ~nd pra
per development of the ca,nmunity.
3. Thet the peogosed reclassification of subjact preperty does pmperly relate to the zones end their permitted
uses locelIy established in close proximity to subject pruperty end to the zones and their permitted uses generaily estab-
lished throughout the community.
4o That the proposed reclassification of subject property does require dedication
for and standard improvement of abutting streets because said property does relate to
and abut upon streets and highways which are proposed to carry the type and quantity
of traffic, nrY~ich will be generatec', by the oermitted uses; ir. accerdance :vith the circu-
lation element of the General Plane
5a That the petitioner, stipulated to the elimination of the two parking spaces
at the southwest corner of sub~ect property, in order to provide an adequate •turning.radiuse

NOW, TfiEREFORE, BE IT RESOL'JED that the Anaheim City Pleaning Commission does hereby cecommend
to the City Council of the City of An.heim that subject Petition for Reclassi£~caUon be approved and, by so doing,
thet Tifle 1&Zoning of the Anaheim Nlunicipel Code be amended to exclude the abova desciibed property from the
R-A, Residential Agriculturai, Zone and to incorporate said described property in the R-3y
Multiple Family Residential, T.one upon the following conditions which are hereby found to ;
be a necessary prerequisite ;,o the proposed use of subject property in order to preserve
thA safety and general weJ.fare of the citizens of the City of Anaheimo
1. That the owner of s~bject prope•rty shail deed to the City of Anaheim a strip of land 45 feet:i.
in width from the cen•~;erline oi' the street along Western Avenue9 for street widening purposeso
2o That st.reet impro+~ement plans shall be prepared and all engineering requirements of the City'
of Anaheim along Western .Avenue9 such as curbs and gutte•rsy sidewalks, street gradinq and pavings',
drzinage facilit~es, or cther appurtana~t wror•k, shall be completed as required by the City En-
gineer and in accordance with standard plans and,specifications on file in the office of the Cit~i
Engineerq and that a bond in an amount and form satisfactory to the City of Anaheim shalt be j
posted with the City to guarantee the installation of said enginee.ring requiremeni:so
3o That the owner of subject property sha11 pay to the City of Anaheim the sum of $7_~00 per

4o That the oompletion of t;hese reclassification pl•oceedings shall be subject to the grant-

5o That Condition Nos~ ly 2, and 3, above mentioned, shall be r,omplied with within a period
of 180 days from date hereof, or such further time as the City Council may granto
6o That subject property shall be developed substantially in accordance with plans and speci-
fications on file with the City of Anaheim, marked Exhibit Noso 1 throuyh 8~ ;
7o That the two parking ~paces at the southwest ~orner of subject property she11 be eliminated "
in order to provide an adequate turning radiuso
8o That the petitioner shall initiate reclassif.ication pror.eedings to rezone that parcel front- +
ing on lincoln Avenue, wes{. of the existing service station and formerly a part of subject prop- ;~
erty to the C-lY Neighborhood Commercial, Zoney prior to the public hearing of Reclassification
Noo 63-63•.9 by the City Councilo
