WFiEREAS, the City Planning Commission ef the City of Aneheim did receive a verified Petition for V[triance

WH~.FEAS, the Ciiy Planning Commission did hold a public hearing at the City Hall in the City of Anaheim
on August 59 19639 et 2:00 o'clock P.M., notice of seid public hearing having been duly given as required
by law and in accordance with the provisions of the Maheim Municipal Cada, Chapter 18.68,to hear end considec
evidenae for and against said p:oposed vaciance and to investigate and make findings end recommendations in connec-
tion therewith; and
WFIEREAS, said Commissinn, after due inspection, investigetion, and study mede by itself and in its behalf,
and after due consideeation of all evidence and reports offered as said heering, does fInd end determine the following
facts:
1. That the petitioner tequests a variaace fmm the Anaheim Municipal Code: SeCtioa 1So32~ 060 w}liCh
requires a one-story height limitationy and Section 180320120 which requires 1~ garages
per. dweliing unit to pexmit the construction of a two-story apartment buiiding with carports
on sub3ect proper.tyo
2. That there are exceptionel or extraordinary circumstences or conditions appliceble to the property involved
or to the intended use of tt~e property that do not epply generelly to the prope:ty or class of use in the same vicinity
end zone.
3. Thet the cequested verience is n~cessary for the pceservation and enjoyment of e suostential property right
pos~essed by oFher property in the seme vicinity end zone, and denied to the property in question.
4. That the requested veriance will not be materially detrimental to the public welfate or injuriouc to the pmp-
erty or improvements in such vicinity end zone in which the property is located.
5. That the cequested variance will not adversely affect the Comprehensive General Plan.
6~ That the single story height limitation was waived within 150 feet of single
family development, based on thef act that no opposition was received f•rom the nearby
residen•ts, and that the prope•rty owners primarily affected by the encroachment of said 150
feet appeared in favor of subject petitiona

PIOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Planning Commission does hereby grant subject
Petition for Varience, upon the following conditions which a:e hereby found to be a necessary prerequisite to the pm-
posed usa of the subject property in order to preserve the safety and general welfare of the Citizens of the City of
Anaheim.
lo That the owner of subject property shall pay to the City of Anaheim the sum of $25.00
per dwelling unit to be used :or park and recreation purposes, said amount to be paid at
the time the building permit is issuedo
2o The.t trash storage areas shall be provided in accordance with approved plans on file
itt the ofrice of the Director of Public V~orks, prior to final building inspectione
3o That Variance Noo 1596 is granted subject to the completion of Reclassification Noo
63-64-19a
4o That firs hydrants shall be installed as required and determined to be necessary by
tha ~'hief cf the Fire Department, to be installed prior to final building inspectiona
5o That subject property shal? be developed substantially in accordance with plans and
specif ications on f ile with the City of Anaheim, marlced Exhibit Noso 1 through 80
6e That the interior walls of the proposed carports shall be f inished with exterior
building materials, that enclosed storage cabinets shall be ittstalled along the rear
wall of each carport, and that suitable bumper guards shalll~e installed to protect the
interior walls of the proposed carports, all of which shall be done prior to final

7o That a six (6) foot masonry wall shall be constructed along the north, west, and
