A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT475 BE GR.4NTED
WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Conditionel
Use Permit from WILLIAM JENNIAGS & VIOLEI' MARGOERITE"'MESSBCAR, 446 South Poplar, Brea, Cali-
fornia, Owmers; ROBERT S< GARDNER, 823 West Balboa Boulevard, Balboa, California, Agent
of certain real prcperty situated in the City of Anaheim, County of Urange, State of Cali-
fornia, described as Lot No~ 3 of Tract No, 162, as per map recorded in book 12, page 6 of
Miscellaneous Maps, in the office of the County Recerder of said Countys EXCEPT the east
88000 feet thereof; ALSO EXCEPT an undivided 5/6 interest in and to a 14 inch pipe line
extending along the front of said lot and tract

WHEREAS, the City Plenning Cammission did hold a public hearing at .the City Hell in the City of Aneheim on
September 16~ 1963~ at 2:00 o'clock P.M., notice of said public hearing having been duly given es cequired by
law end in accordence with the provislons of the Maheim Municipel code, Chepter 18.64, to heat end consider evidence
for end against aeid proposed conditionel use and to inve~tigete and make findings end recommendations in connection
therewith; and .
WHEREAS, seid Commissioa, efter due iaspection, investigetion, end study mede by itself and in its behelf, end
after due consideration of all evidence and reports offered at eaid heering, does find and determine the following fects:
1. That the propased uae is properly one for which a Conditional.Use Permit is authotIzed by this Code, to
wit: establish an autumatic car wash operation and sale of gasoline on subject property.
2. That the p:oposed use will not adveisely a£fect the edjoining laad uses and the growth end developmen? of
the acea in which it is proposed to be located.
3. 'Y'het the eize and shepe of the site propoaed for the use is adequeta to ellow the full development of !he
proposed use in a manner not detrimentel to the perticular ecea nor to the peace, health, sefety', and general welfare
of the Citizens of the City of Aneheim. .
4. Thet the granting of the Conditionel Use Permit under the conditions imposed, if any, will not be detrimentel
to the peace, health, saEety, and yeneral welfare of the Citizens of the City of Aneheim.

NUW, THFREFOAE, BE IT RESOLVID that the Anaheirn City Planning Commission does hereby
grant subject Petition for Conditional Use Permit, upon the following conditions which
are hereby found to be a necessary prereauisite to the proposed use o£ the subject
propErty in order to preserve the safety and general Htelfare of the Citizer.s of the Ci•iy
of Anaheim: ~
1. That the owners of subject property shall deed to the City of Anahe'sm a strip
of land fifty-three (53) feet in width from the centerline of the street, alor;g Ball
Road, for street widening purposeso
2a That street improvement plans sha11 he orepar.ed.and all engineering rE:quirements
of the City of Anaheim along Ball Road, such as curbs and gutters, sidewalks, street
grading and paving, drainage facilities, or other appurtenant work shall be completed
as required by the City Engineer and in accordance with standard plans and specificai:ions '
on file in the office of the City Engineer; and that a bond in an amount and form satis-
factory to the City of Anaheim shall be posted witi~ ihe City to guarantee the installa-
tion of said engineering requirementso
3. 1'hat the owners of subject pioperty shall pay to the City of Anaheim the sum of
ffi2000 per front foot along Ball Road for street lighting purposese
4o That trash storaye areas shall be provided in accordance with approved p~ans on
file in the office of the Director of Pu~blic Works, prior to final building inspecticn.
5o That Condition Noso 1, 2, and 3, above mentioned, shall be complied with within
a period of lA0 days from date hereof, or such further time as the Commission may grante
6~ That subject property shall be dQVeloped substantially in accordance with plans
and specifications on file with the City of Anaheim marked Exhibit Noso 1 and 2, provided
that the proposed flag supports shail be eliminated where the supports extend above the
roof line of the proposed s•tructure9 provided that the proposed car wash structure may
be construct°d to a maximum length of 200 feet, and provided that the vacant property southerly;
of the proposed parking area shall be paved with asphalt, excepting the westerly six (6)
feet adjacent to an existing masonry wa119 which shall be landscaped as requested by the
petitioner9 prior to final building inspection~
7a That treewells shall be provided at approximateiy forty (40) foot intervals
in the Bal'1 Road parkway abutting subject property, that plans for said treewells and
planting of tree: thereiny shall be submitted to and approved by the Superintendent of
Parkway Maintenancey and said treewells shall be plarrted with trees prior to final •
buildin9 inspectiono
fto That a six (6) foot strip of land shall be landscaped and said iandscaping ~
maintained in tt,e f:ont bu3lding setbaclc of subject property, and that plans for said ?
landscaping •r.s, indicated on Exhibit Noo 1, on file with the City, shali be submitted to `
and approved by the Superintendent of Parkway Maintenance, and that said landscaping ~
shall be installed prior to final building inspectiona ~
9o That a six (6) foot masonry wall shall be constructed along the east and south '
property lines prior to final building inspectiono
10~ That development and maintenance of the proposed service station shall be sub-
stantially in accordance with adopted Service Station Minimum Site Development Standardso i
llo That the fxont building setback shal'1 be developed as indicated on Exhibit Noa 19
in order that the existing building setback established to the wes ubject property ~!
may be maintained~
